The Department of Homeland Security on Wednesday defended an Immigration and Customs Enforcement (ICE) officer who fatally shot someone in what the agency says was self-defense.
"Today, ICE officers in Minneapolis were conducting targeted operations when rioters began blocking ICE officers and one of these violent rioters weaponized her vehicle, attempting to run over our law enforcement officers in an attempt to kill them--an act of domestic terrorism," DHS Assistant Secretary Tricia McLaughlin said in a statement. "
An ICE officer, fearing for his life, the lives of his fellow law enforcement and the safety of the public, fired defensive shots."

"This is the direct consequence of constant attacks and demonization of our officers by sanctuary politicians who fuel and encourage rampant assaults on our law enforcement," McLaughlin added.

Apparently the term for this is being an ICE Informer. As near as I can figure out, these are the people that show up and create all the chaos with the screaming, whistles and impeding the ICE agents from doing their work. Of course, being an ICE Informer means the person has received extensive training in this well-recognized field and has demonstrated through written and field tests they are qualified to conduct this role. This is unlike people who just show up where law enforcement is conducting an operation and trigger a riot.

The MSNOW reporter on the scene stated that he was told by an ICE Informer that the driver of the car was also an ICE Informer. So it seems one law enforcement agent shot with another law enforcement agent. MN Atty. General Keith Ellison is going to do everything he can to to bury this ice agent in prison for the next 50 years.

Incorrect thinking. If you conceed the first shot is justified then the rest are. This is not civilian self defense. Agents are authorized to use deadly force to effect felony arrests. If you say the first shot was self defense, she attempted murder. If she did not surrender, using the car to resist arrest flee justifies any additional shots. I have no idea how this idea that you CANNOT shoot someone "in the back" and have the shoot be legal became so widespread.

First of all, prosecutors often have a very broad definition of, "the back." Imagine a plane perfectly dividing a person in half from the top down. They will define anything in the rear half of the body as, "the back," including what normal people would call, "the side."

Second, just watch any video of gang bangers shooting at each other as they run around, shooting wildly. They'll point the gun out to their side and shoot. They'll point the gun to their rear as they're running and shooting. Just because someone is generally turned away from you doesn't mean they're not an active threat.

No, it won't. Because of the very close proximity of the shots. Basically, there have been instances where a body can literally turn just before the bullet hit them. This is not a citizen self defense case btw, this was a fleeing felon the moment she stepped on the gas and nearly hit the ICE officer. Yep. the Magic word is reasonable and the use of force must be proportionate to the degree necessary to stop the attack. Once the attack is over, then you cannot continue to engage unless the threat reappears. Never as a regular citizen ever try to stop a fleeing felon, burglar, etc. And yes, I know about TX law--it has a number of legal jeopardies attached via caselaw which lawyers know and the general public does not.

Don't shoot someone over stealing something or even if they are exiting the house after breaking in because the threat to you is essentially over.

Do call the police to make a report in such instances even though it is a hassle. You don't want the perp claiming that you were the one trying to use illegal force against them.

Imagine if she had a gun instead of a car. The ICE agents tell her to drop the gun. In place of reversing the car she unholsters it. Again the ICE agents tell her to drop it.

She then raises it at the ICE agent in front of her and the ICE agents begin shooting.

While you are a troll, I used to teach Criminal Procedure for over twenty years to yutes. Once you commit a forcible felony to a cop, then the cop is allowed to shoot until the threat is stopped and that includes risks to others.

Idiots play this game all the time when they try to flee cops at high speed and then encounter either a PIT stop or run over spike strips and lose control which deads them. A fleeing car in the operation of perps is in itself a lethal weapon and a menace.

You need to read TN v. Garner where Scotus defines when police may use lethal force to stop a fleeing criminal. It is when a forcible felony has occurred and hitting a cop with your car whether you intended it or not in the course of your other crimes (failure to obey a lawful order to stop, dragging an officer a few feet while not stopping, etc. ). That made her a fleeing felon armed with a dangerous weapon, the car. Thus, she got deaded.

The old common law rule before TN v. Garner was simply shooting an escaping felon. Committing what is called forcible felonies warrant up to lethal force to stop in every state.

Doesn't mean cops have to and in some cases, like trying to stop idiots in cars driving dangerously to escape being caught, are not in accordance to individual jurisdiction policies, they keep the old common law because of liability.

And those officers get qualified immunity too courtesy of Scotus.

I don't remember the details, but I think the plunger went in the mouth -- that wasn't disputed. Yes, he was a fag, but still there is something wrong when they tune-up a guy in the back room to that degree. Do it in an alley or something.

From what I read, Diallo was just a bystander. They were not approaching him until he showed up to see what was going on. Maybe he was a rapist, still. The story told (as I recall) is that one cop stumbled, another yelled "gun" for no reason, and they all started shooting.

I defend this current shooting, and Chauvin, and I did from day one, but still, not all shootings are legit and I think those two incidents from NYC are not worth defending.

I had these arguments from students every time there was a police shooting. All the cameras around now make it a helluva lot easier to teach.

But the general rule is cooperate with the cops regarding their orders within reason (you do not have to admit to anything nor consent to a search of the car) to avoid any Courtroom of the Street where the cop is the judge, jury, and executioner if need be. Save it for the real courthouse if you are justified.

Cars, whether you think they are not, are considered lethal weapons when in operation. You cannot decide in the courtroom of the street to suddenly leave a cop when they are telling you to stop. You have to stop, you cannot try to move around vehicles to escape, and you have to definitely stop if an officer is in front of you. Its over. Now the reckoning of the charges will commence and the toll rises as you try more and more to get away. And the sentence can be all the way to death. No appeal.

I hope this saves some lives but generally this spiel and the funnier Chris Rock video, gets through to some folks .

She had it coming by playing a stupid game. She had plenty of time to stop initially but she played a stupid game, then she thought she would flee, that only gave her a split second to make a decision that would end up being fatal for her.

You take the ride downtown and get home for supper instead her ride was to the mortuary.

The ironic thing is that any seasoned street thug knew the rules that she ignored because of her karen 'privilege'. Too many of these gits think they are immune to law enforcement becuz they are some moral exemplar.

And you are wrong. For a citizen correct, for an officer stopping a fleeing violent felon, which she was regardless of intent. Once she started that car and did not obey a lawful order to stop, she set the train in motion so her actions are viewed in a continuous decision tree after the initial illegal decision not to stop when an officer is reaching inside to do so. That, in an off itself are two crimes, then hitting the officer, whether or not intention, is a forcible felony of assault on an officer, then further trying to flee made her a fleeing forcible felon.

She put the bullets in her own body by her decision to run.

Once she started that car and did not obey a lawful order to stop, she set the train in motion so her actions are viewed in a continuous decision tree after the initial illegal decision not to stop when an officer is reaching inside to do so. We already played this game in the case of Lon Horiuchi. He was indicted in Idaho for shooting Randy Weaver's wife and son. He faced a trial, before the trial, federal government raised supremacy clause because Horiuchi did the shooting under his official duties of the FBI, the trial judge ended the trial before a jury. Idaho appealed and the 9th sent it back to Idaho for a ruling on whether qualified immunity existed, by that time, a new prosecutor was in office and dropped the state charges.

End result, which is much more murky than this as Lon who was shooting from a great distance had no personal threat, avoiding arrest, or other charges to file against the wife or son, was not tried, then these ICE agents are very unlikely to be. The case would be in federal court, not state in that case.

The woman in question committed a long line of offenses starting when she tried to flee--she failed to obey a lawful order to stop, she assaulted the officer while driving away with his arm inside the car doing a lawful attempt to stop her, she escalated the fact that she tried to pull around cars to affect an escape, she either intentionally or unintentionally hit an ICE officer whose job at that point was to stop a felon.
