Treasury Department’s Crime Unit Announces Crackdown on Cross-Border Transfers of “Funds Derived from Unlawful Employment” Sent by Illegal Aliens

There has been a flurry of announcements from the Trump administration in recent days regarding its battle against illegal immigration and how to address the tens of millions of people in the U.S. illegally. Amidst the talk of benefits being cut off and visas being suspended, there was another monumental move that was just announced.

Specifically, the Treasury Department’s Financial Crimes Enforcement Network (FinCEN) just sent an advisory to money services businesses (“MSBs” which handle international wires stating that the requirement for preparing and submitting a Suspicious Activity Report (“SAR” for “cross-border funds transfers” also applies to “funds derived from unlawful employment” in the United States. In more simple language, this means money earned by someone who may not legally work in this country is prohibited from being wired out of this country. This is a huge development.

The threshold for the SAR reporting requirement is $2,000 in aggregate, which means that “structuring” a series of smaller wires is also prohibited if the total exceeds $2,000. The regulation related to structuring states that “a series or pattern of such transfers that collectively suggest an intent to evade the SAR threshold must be reported.” In other words, the total amount of all wires must be reported. In addition, attempting to structure wires is itself a suspicious activity that must be reported.

As noted by FinCEN, these international wires frequently include payments to the smugglers who brought the “migrants” across the border, which effectively rolls to the drug cartels and crime syndicates. FinCEN calls these syndicates “Mexico based transnational criminal organizations.”

“FinCEN Issues Alert on Cross-Border Funds Transfers Involving Illegal Aliens” [Treasury Department FinCEN Press Release – 11/28/2025]

Today, the U.S. Department of the Treasury’s Financial Crimes Enforcement Network (FinCEN) is issuing an Alert as part of Treasury’s effort to prevent the exploitation of the U.S. financial system by illegal aliens in the United States seeking to move illicitly obtained funds. Annually over the past several years, the United States has witnessed a significant volume of cross-border funds transfers, including remittances from individuals located in the United States, and has taken multiple steps this year to highlight risks presented by cross-border financial activity.

Money services businesses should be vigilant in identifying suspicious financial activity involving illegal aliens who present significant threats to national security and public safety,” said Under Secretary for Terrorism and Financial Intelligence John K. Hurley.

This Alert is consistent with Executive Order 14159, Protecting the American People Against Invasion. Money services businesses (MSBs) are generally required to file a suspicious activity report for a transaction that involves at least $2,000 and that the MSBs know, suspect, or have reason to suspect is relevant to a possible violation of law or regulation. This includes the cross-border transfer of funds derived from unlawful employment or otherwise derived from funds the MSB knows, suspects, or has reason to suspect were illicitly obtained in the United States.

The full report issued by FinCEN to money services businesses is at this link, including this explanation for their action, “FinCEN has taken multiple steps this year to highlight the risks involved with cross-border financial activity, particularly transactions that benefit Mexico-based cartels, several of which have been designated as Foreign Terrorist Organizations.”

Freightwaves and its CEO Craig Fuller have done a great job covering the many problems related to the explosive growth of illegal, foreign truck drivers that are behind the wheel on American roads. In a piece over the weekend, Mr. Fuller discusses the impact of this new regulation on the trucking industry and beyond, since much of the unlawful earnings of those foreign truck drivers are wired back to their home countries.

Of the estimated 11–14 million undocumented immigrants in the U.S., roughly 60% to 70% regularly send remittances, totaling approximately $160 billion annually—an amount exceeding the GDP of many countries. Mexico, Guatemala, Honduras, and El Salvador alone receive over $100 billion combined.

By explicitly criminalizing funds derived from unlawful employment, the Administration aims to choke off this massive financial flow. When these flows are severely restricted, the financial incentive to remain in the U.S. shadow economy evaporates, resulting in a collapse of the economic model of illegal immigration.

But what if the employees of companies that do international wires simply turn a blind eye and do not complete the Suspicious Activity Reports required by the Treasury Department? That would be a bad decision. Wires leave an easily traceable trail under Treasury’s purview, and there could be harsh penalties for those who don’t comply. More specifically, the executives of companies who don’t comply could go to jail. As reported by Freightwaves:

• Compel any financial institution to hand over records without a warrant (via National Security Letters).
• Unilaterally freeze assets.
• Impose civil penalties of $250,000 per transaction.
Criminally prosecute executives for “willful blindness.”

Conservatives seeking to de-incentivize illegal immigration have long advocated for the imposition of severe remittance taxes on foreign wires sent by illegal aliens. This Treasury Department action prohibiting the international wiring of “proceeds from unlawful employment” will have much the same impact.

for what it is worth, remittances sent to family in Mexico and Guatemala (and one other, I forget) are deductible in federal tax returns as "family support" -- however paperwork does have to be filled out to support the claim

I'm confused about the stopping power needed for feral hogs. My friend bow hunts a lot and I've encouraged him to pack his 9mm when he goes in case he runs into a feral hog on the way to his blind. But I've had others suggest that a 9mm wouldn't be enough to bring down a hog?

61 As I mentioned last week, I'd be more excited about this if (i) there weren't already safeguards in place to combat illegal or suspicious transfers, which are routinely ignored, as well as restrictions against hiring illegals in the first place, which are almost always ignored; (ii) we can't seem to do even the most basic vetting of violent, murderous illegals physically inside our own borders, and in fact give them CDLs and RealIDs that citizens have a hard time getting; and (iii) the existence of work-arounds like IVTS/hawala and app-based cash transfers.

I still think we should be going very hard after employers who hire illegals in the first place, and nip the problem in the bud. But despite all the supposed safeguards in place to stop illegals working, there are tens of millions of illegals making more money that poor citizens. If we can't stop illegals from making money, I'm not optimistic we can stop them from sending it overseas.

No set of rules or procedures, no matter how strong in theory, will be successful if they're not followed.

I like this idea. Even if you are here legally on a work visa why shouldn't there be a tax equivalent to the middle class tax rate on money that your drain out of our country to send to a foreign country. But I suppose congress would have to do this.

You have to prove that the employer knowingly accepted fake id, etc for the I-9 form for employment. Very hard to do unless you start sending undercover ops to trap unscrupulous hiring managers. And that takes a long time to whack a mole.

We seized accounts and charged many organizations with financial crimes using these tools, where the US Attorney's Office would cooperate. There were businesses operating solely to facilitate transfers on funds from the US to foreign countries on behalf of illegal aliens.

Yup. Bank fraud detection systems are extremely sophisticated.

But they have to *want* to look for it. It is absolutely a solvable problem. But you can be damn sure that the big banks and money transfer outfits have absolutely *no* desire to solve it.

The big telcos could stop most spam calls. They don't care. The bill gets paid, so fuck you. Same thing with these outfits. Until they are made to care - say, with billion-dollar fines and executives going to prison - they will not.

There is surely a way for AI or automated systems to do it, much like credit card companies flag -- and immediately stop -- suspicious charges. Happened to me last week. Booked 3 tix to Hawaii on Delta, under my Delta FF program, like I do 4-5x a year. They still stopped the charge dead. But in their case, their own money is on the line, so they actually care about stopping fraud. In the government's case, apparently nobody cares about stopping fraud, or illegals, or anything. Just the opposite.

You have to prove that the employer knowingly accepted fake id, etc for the I-9 form for employment. Very hard to do unless you start sending undercover ops to trap unscrupulous hiring managers. And that takes a long time to whack a mole.

Cut off the money for illegals public and otherwise, you get faster results in self deportation. Which is the most efficient of all because it avoids the whole tangled legal process.

At the heart of it, is the Chamber of Commerce types and asshole individual business critters that rely on a model of cheap disposable labor so they can make more profit. And they paid off their Congress critters to make that happen by giving a figleaf over what everyone knows is going on.

But that figleaf is big if gubmint decides to prosecute. It requires either direct whistleblowers or catching the asshole hiring managers in the act.

Nope. Financial issues are a different matter and money crossing borders is subject to a host of laws not requiring intent. A fair number of people have run afoul of the Fincen in making regular withdrawals from their accounts that Treasury believe was for the purpose of evading reporting laws. On financial matters, from asset seizure to other regulations, the government inverts the burden of proof to make you show that you were innocent. Civil versus criminal burden is far lower so government wins far more than it loses.

Ask gun dealers about the power of FinCen or why pot dealers even in states where it is legal, have to deal in cash.

As the Trustee of my brother's estate I was required to enroll that entity in FinCEN as well with the same warning about being charged $500/day.
This Biden initiative didn't even have the rules of the program written other than the fine and method of enrollment.
My accountant wouldn't participate for fear of participating in a program that didn't have defined rules yet and referred me to an attorney. The attorney fee to initiate the registration was $500 for each submittal.
I filed the damn forms myself in about 30 minutes.
It required photo ID and SS/EIN numbers in both submittals too.

Well, the government hates guns, so they go after it hard.

Unless they actually go after WU and the others, and imprison some of their executives for it, this will not change. There is zero desire to enforce any of this by those making money on it. Time will tell if FinCEN does anything more than just file this order in the circular file. I doubt it, but then I usually do.

A lot of the career types at Treasury ended up getting fired over their resistance to having their magic money machines investigated. The risk for the big transfer outfits is that they can be punished to the extent of gutting their legitimate business. Suddenly the incentive is not to do that. Before this action, ignoring illegal activity was a no brainer because there was no risk in doing so.

Bureaucrats including those in business, hate risk and being blamed/fired for accountability. So I think we will be pleasantly surprised by compliance.

But... there's not really anything congress could do here. All the laws are already on the books. All the immigration controls and mechanisms have been passed. I don't think a lot of people realize just how much money is made in sending money and wires overseas. They say $160B (with a "b") is sent by illegals every year. I suspect it's 2-3x. 344 I have heard that the food delivery guys are inundated with illegals now, looking for work that doesn't go on record. Juan can get you your tacos, most of the time, if he can figure out where you live and an talk to the people at the restaurant.

I ordered some food a while back, the guy delivering it called me and spoke only Spanish. How he figured that was going to work out, I can only speculate about. To this day I have no idea what on earth he was saying, the food got delivered.

It's very common around here, the area in close proximity to a frigging bio research lab.

But it was probably caused by a pangolin having sex with a monkey in a wet market.

I think it was because in general they were seen to have turned themselves into the rentier class. That is acceptable when there is extra money sloshing around, but when the Kingdom is bankrupt they became overly expensive parasites.

It looks like it would be.

So many of these movies coming out make me think 'Frozen.' Now what my subconscious means by that is... movies openly made for a specific demographic that I do not fall into- and I am fine with that, but also kind of disturbed. It is not appealing in any way- which is odd for a piece of media.

Des Moines police detectives are asking for the public's help locating a man wanted for gun and drug charges.

Police believe Dameian Buckner, 36, was in possession of two handguns and 'delivery quantity' marijuana when officers responded to investigate a report of gunfire at his home.
