Trump Declares All Biden Autopen Documents Null and Void
I don't know how the courts will handle this.
Trump made the announcement on his Truth Social platform, as he often does. The Friday afternoon post stated, "Any document signed by Sleepy Joe Biden with the Autopen, which was approximately 92% of them, is hereby terminated, and of no further force or effect. The Autopen is not allowed to be used if approval is not specifically given by the President of the United States." It is unclear how significantly this could impact governmental programs and policies, but certainly it will shake up the federal government. Next, Trump went so far as to say that Joe Biden was so totally incompetent mentally and physically that he had nothing whatsoever to do with the autopen scandal and would be lying if he said he did.I suspect they will claim that any document with the claimed signature of the president is presumptively real and therefore lawful, and that any undoing of that presumption must be on a case-by-case basis and by clear and convincing proof.
The president insisted, "The Radical Left Lunatics circling Biden around the beautiful Resolute Desk in the Oval Office took the Presidency away from him. I am hereby cancelling all Executive Orders, and anything else that was not directly signed by Crooked Joe Biden, because the people who operated the Autopen did so illegally. Joe Biden was not involved in the Autopen process and, if he says he was, he will be brought up on charges of perjury. Thank you for your attention to this matter!"

Then they can sue Trump or whoever. But that could be years down the road. Until then, who knows?

The federal government has essentially unlimited resources in litigation- if, as ace suggests, the courts presume authenticity, the government can produce evidence to rebut the presumption with government lawyers on salary (like me) and these jerks can spend their own bucks attempting to refute. But facts in evidence already demonstrate the process for autopen approval wasn’t followed, so good luck!

My non lawyer understanding is that EOs can be reversed by the next POTUS regardless. Biden canceled a lot of good things from the first Trump term with counter EOs.
There may be specific EOs that Trump wants to undo; by making the statement that every pardon and EO that was signed by autopen is null and void, the commies don't have one narrow target to focus on so the key counter EOs Trump wants to issue have more chance to succeed, especially if the commies focus on making sure the pardons for evil gnome Fauci et al are not overturned.

And again, they are not instant. Just like your check deposits are held 3 days even though in theory, the money can move in an instant.
Money can be held...and even if you don't stop the very 1st transaction, once an account gets flagged after a transaction, you can prevent any further ones.

Money can be held...and even if you don't stop the very 1st transaction, once an account gets flagged after a transaction, you can prevent any further ones.

In order for a system to work even under this new rule, the remittance has to be $2k or more ($1,999 wires fly under the radar), the sending institution has to identify and flag suspicious transfers (I'm skeptical), and the gov't has to immediately react and stop the transfer. Highly unlikely all three of these things will happen.

In seriousness, Trump should have a team reviewing all autopen pardons and determining which were given to deserving people then Trump should re-pardon them officially so they don't have a cloud of doubt over them.
Same for the stuff that needs to remain in place - reissue under Trump's official signature so there is no doubt.

Legal type question... to give someone Signature Authority, don't you have to submit documents saying who it is given to, and scope, and dates?

This might end up being entertaining in an indirect sort of way. This may sound like an unrelated non-sequitur, but the Federal Govt. uses the same legal philosophy and stance relative to Asset seizure.
When the Feds seize your assets, the money becomes the defendant. To get your money back, you become the plaintiff and have to make the case that you should have it back.
Similarly, Trump is saying signing with an autopen does not legitimize the intention. Therefore, the signed item becomes the defendant, and those affected by what was signed are under the obligation to prove its legitimacy.
The case presented in trying the legimize items signed by the autopen may end up crashing the Fed's asset seizure racket.
