Trump Declares All Biden Autopen Documents Null and Void

I don't know how the courts will handle this.

Trump made the announcement on his Truth Social platform, as he often does. The Friday afternoon post stated, "Any document signed by Sleepy Joe Biden with the Autopen, which was approximately 92% of them, is hereby terminated, and of no further force or effect. The Autopen is not allowed to be used if approval is not specifically given by the President of the United States." It is unclear how significantly this could impact governmental programs and policies, but certainly it will shake up the federal government.

Next, Trump went so far as to say that Joe Biden was so totally incompetent mentally and physically that he had nothing whatsoever to do with the autopen scandal and would be lying if he said he did.


The president insisted, "The Radical Left Lunatics circling Biden around the beautiful Resolute Desk in the Oval Office took the Presidency away from him. I am hereby cancelling all Executive Orders, and anything else that was not directly signed by Crooked Joe Biden, because the people who operated the Autopen did so illegally. Joe Biden was not involved in the Autopen process and, if he says he was, he will be brought up on charges of perjury. Thank you for your attention to this matter!"

I suspect they will claim that any document with the claimed signature of the president is presumptively real and therefore lawful, and that any undoing of that presumption must be on a case-by-case basis and by clear and convincing proof.

I guess some leftwing ratfuck judge could enjoin Trump's declaration as to all the EOs -- and probably will -- but that probably won't stand. The basis of Trump's voiding the EOs is that Biden didn't sign them, didn't know about them, etc. That would require an individualized, case-by-case inquiry into each EO at issue.

This could be a bigger deal overall than we think.

There may be specific EOs that Trump wants to undo; by making the statement that every pardon and EO that was signed by autopen is null and void, the commies don't have one narrow target to focus on so the key counter EOs Trump wants to issue have more chance to succeed, especially if the commies focus on making sure the pardons for evil gnome Fauci et al are not overturned.

Considering Trump's propensity for making his signings into spectacles and the central issue of the autopen for Biden, I doubt there's any autopen on any official, authorizing document.

Umm, yea. That's my point. By striking all the EOs down in one shot, anyone affected by any EO is now in limbo as to whether that EO is still effective or not. So they either all have to sue for declaratory judgment, or wait until they are affected by conduct inconsistent with the EO and then challenge it in court.

Is this real? It doesn't make sense as it's written. How do you "seize" a remittance? A remittance has already been made and the money is now out of the country. I guess there could be new rules that require proof of citizenship or legal status before making a remittance, or the remittance will be "seized" before it's sent. But I doubt that could be enforced in any real sense.

You seize it at the middleman level. You require all foreign sent money to have a check of someone's citizenship (be in the bank or online service handling it). Anyone who is not gets the money removed and sent to Treasury where it is held until either the citizen can correct the error or it is confirmed illegal.

Remittances are not instant, so there's time to thwart the process...

Money can be held...and even if you don't stop the very 1st transaction, once an account gets flagged after a transaction, you can prevent any further ones.

It's not real "banks" that send the vast majority of these kinds of remittances. Pedro isn't walking into Citibank to count out his filthy cash money to send to some Mexican shithole. Most of these remittances are sent by shadier players will an incentive to look the other way. Hell, their entire business model is based on catering to illegals.

I also think a lot of money is moving around through cashapp-type apps without using remittances at all.

Buddy's niece married a Mexican fellow his parents have lived here forever and have green cards. It was assumed that Maurice also had one. Until recently those old laws didn't mean anything.

Last month he was stopped because of a bad tail light. Ruh Roh.
They ran a check. Bingo, no green card. He has never been in Mexico. His mom went with him for a little while to help him acclimate to the culture. He's really a nice guy. fafo.

An autopen signature on government documents from the president's office have never been challenged in court, so it's unique and unexplored legal territory.

Things like power of attorney and other authorities to sign in someone else's name could provide some guidance, but I don't think it would actually track that closely.

The president's power is plenary on most of the things he's signing. It's not plenary, assuming he's mentally competent. That qualification isn't in Article II.

I suspect that a pointed challenge on a specific autopen signature that had no documentary backup would lead, eventually, to an overturning of it as invalid.

The vast amount of wires I've seen and done personally -- including some very significant amounts -- are completed in less than an hour. None were illegal, but some did involve foreign accounts associated with problematic locations (Russia, etc).

221 This might end up being entertaining in an indirect sort of way. This may sound like an unrelated non-sequitur, but the Federal Govt. uses the same legal philosophy and stance relative to Asset seizure.

When the Feds seize your assets, the money becomes the defendant. To get your money back, you become the plaintiff and have to make the case that you should have it back.

Similarly, Trump is saying signing with an autopen does not legitimize the intention. Therefore, the signed item becomes the defendant, and those affected by what was signed are under the obligation to prove its legitimacy.

The case presented in trying the legimize items signed by the autopen may end up crashing the Fed's asset seizure racket.

It would be the ugliest raw politicking.

I've actually tripped lefties up on the abortion issue and made them re-think everything. When the Supreme Court was about to reverse Roe v. Wade, and libs around here were going hysterical about it, I had several conversations along these lines:

Lib: "Women should have bodily autonomy! I don't want right-wingers telling us what to do!"
Me: "Yes, there shouldn't be laws or rulings in which one political side can impose their will the whole nation! That's unfair."
Lib: "Yeah!"
Me: "But that's exactly what Roe v. Wade was - one side imposing their will on the whole nation."

Me: " And what if some future president uses that precedent to impose an abortion ban nationwide? Nationwide bans are scary."

Me: "It's better for each state to decide on their own policy. You wouldn't want some right-wing southerners to have the power to ban abortion in California, would you? Of course not!"
Lib: "Yeah!"
Me: "So let's get rid of Roe v. Wade and no state can ever boss around any other state."

If they take this to court that might mean putting Biden on the stand. If he's too ill for that, as I suspect he is, then they would have to prove hi fitness some other way, like medical records.
