Breaking: Clinton Judge Dismisses Indictments of Both James Comey and "Big Tish" James, Claiming the US Attorney Prosecuting Them Was Unlawfully Installed

Of course.

A federal judge on Monday dismissed the criminal cases against former FBI Director James Comey and New York Attorney General Letitia James, concluding that the prosecutor who brought the charges at President Donald Trump's urging was illegally appointed by the Justice Department.

The rulings from U.S. District Judge Cameron McGowan Currie halt at least for now a pair of prosecutions that had hastened concerns that the Justice Department was being weaponized to pursue the president's political adversaries and amount to a stunning rebuke of the Trump administration's legal maneuvering to install a loyal, and inexperienced, prosecutor willing to file the cases.

The orders make Lindsey Halligan the latest Trump administration prosecutor to be disqualified because of the manner in which they were appointed. Both defendants had asked for the cases to be dismissed with prejudice, meaning that the Justice Department would not be able to bring them again. But the judge instead dismissed them without prejudice, though it was not immediately clear if or how the Justice Department might attempt to revive the prosecutions.

Quick note: When a Republican-appointed judge rules against Trump, the media always points out he's a "Bush appointee" or "Trump appointee" (as just happened in the Texas redistricting case).

When it's a left-wing judge appointed by a Democrat, the media suddenly forgets how to use Google.

But a court system only exists to manage a society efficiently, predictably and non-violently. When it becomes inefficient, unpredictable and actively shields the violent while hounding the law-abiding, its days are numbered. There's no reason not to prefer the neighborhood lynch mob. They are at least efficient (so they check one out of three boxes).

I'm not sure that's how it works. At least in the civil world, if you file a claim within the statute of limitations, and the claim later gets dismissed (for whatever reason), you can refile the claim regards if the SoL has run out in the meantime.

I expect that's the same rule in criminal cases.

It is unexpected, given the culture of lawlessness. When a member or beneficiary of the generally lawful party rules in accordance with the law, it is completely ordinary and therefore neither notable nor newsworthy.

While I actually concur with the host's assessment and believe that lawful and sensible judges *should* have their party affiliations noted, I concur for opposite reasons. Good behavior, lawful practices, sensible activities and consistent, legal opinions *should* reflect well on the generally lawful party. Only the fact that such things are routine and ordinary makes them not "newsworthy."

She was a rich kid. I think the yuge bump in net worth is the result of her getting a stake in one of the family companies. IIRC. That doesn't mean she's not a corrupt grifter, but she didn't corruptly grift to the tune of $25M.

She didn't get rich through insider trading or anything, but a split of ownership of the company she owned with her ex-husband.

A construction company.

Also, she said that Trump shouldn't be so ardent in getting illegal workers. This was purely a moment of purity of heart and principles on her part and had nothing to do with her company probably using illegal labor.

In short - very, very few. You have to be a bone-deep Statist to become a judge in the first place, and at the federal level, the bench is so ripe for abuse that it takes a very strong moral bearing to resist the urge to let that Statist freak flag fly at full, turgid staff.

She's a temporary appointee outside the 120 day window statute has described as the proper limits of temporary appointments for USAs.

This statute is likely in violation of the president's appointment powers. He either gets temporary appointments until the Senate acts, or the post is empty until the Senate acts.

The technicalities of interim prosecutor appointments. Because Congress isn't doing its job, Trump has relied on interim appointments for a lot of his prosecutors. Halligan was hastily appointed just days after the earlier interim appointment's term ended.

Even the DOJ acknowledged this may have been a "paperwork error."

This is not the way things are supposed to work. Which means the "rules" governing them are gonna be easily bent by activist judges.

There is not but the main point is that teh blue slip policy allowing blue state senators to prevent DAs and District court judges from coming to a Judiciary vote is essentially unconstitutional.

No such provision exists in the Senate formal rules, the blue slip veto is not historically based as it is a recent 20th century innovation. It was created to prevent desegregation by Southern Democrat senators preventing Republican appointed district court judges intent on returning to the rule of law. The veto by senatorial courtesy meant that only milk toast GOP judges got appointed during that time.

So,thus Democrats, as always, abuse the rule while expecting the GOP as usual to cave and whine when the Democrats obliterate the understanding if it causes them any trouble.

If you read the decision above, the judge is claiming that judges in the Eastern district have the right to appoint the prosecutor, not Trump. Same issue as Habib in NJ. Congressional statute, gave the judiciary the right to fill DA offices when Congress did not permit a president to fill them. The overlapping conflicting law is the executive vacancies statute that permits temporary appointments for 120 days to fill vacancies.

This judge decided to favor his own black robed tyrants rather than what the Constitution clearly states, the president is the head of the executive branch and as such major officers, like DAs must be appointed by the president, not filled by judicial busybodies.

It requires a majority vote from the Senate. Getting the majority to agree to allow recess appointments seems to be...difficult.

Started in Obama years to prevent the president from recess appointments under McConnell. One Scotus case, from foggy memory dealt with Obama recess appointments to the National Labor Relations Board, I think. That resulted in the Court declaring that the Senate must be in recess for at least three days for the recess clause to kick in. Also a recess between Congresses after adjournment until a new Congress. Case is NLRB v. Canning.

I think Obama appointed members with less than three days between Senate Sessions but I would have to dig up the case to confirm.

Get rid of it. It can be replaced simply like we did for lecturers in our department where you are assumed to have continuity (requiring a finding with due process of misbehavior on the job aka cause) rather than an absolute right to keep your job.

I would also amend the Constitution to require 8 year terms for district court judges, 12 perhaps for circuit courts, and 20 for Scotus. And allow reappointment and reconfirmation for judges that do good. Otherwise, you need someway to reign in judges either by allowing political branches or states to overrule specific judicial rulings on constitutional grounds without having to go through impeachment (worthless) or the rigorous requirement of amending.

Muscle to fat ratio. Very lean and muscular types have trouble swimming as the density of muscle tissue higher than water means that they don't float as easy without constantly swimming. Fat is less dense than water so easier to float up to a point.
