You can, of course, always reduce the impact of white voters, as California just did. In fact, it's legally required.A three-judge federal panel ruled that the redrawn Texas congressional redistricting map was "racial gerrymandering" and ordered the state to use 2021 maps for the midterm elections. Since it's a federal voting rights case, the only appeal is to the Supreme Court. It's unclear whether the high court will have time to rule before the 2026 primary filing deadline next month. "Any claim that these maps are discriminatory is absurd and unsupported by the testimony offered during ten days of hearings," Republican Gov. Greg Abbott, a Republican, said in a statement. "This ruling is clearly erroneous and undermines the authority the U.S. Constitution assigns to the Texas Legislature by imposing a different map by judicial edict." Texas state law allows for partisan gerrymandering. Republicans claimed that the map was being redrawn to give them a partisan advantage and to "better reflect Texans' conservative voting preferences -- and for no other reason," said the governor. The Supreme Court ruled in 2019 that the courts could not intervene if a map was drawn to give one side a partisan advantage. "The public perception of this case is that it's about politics," U.S. Judge Jeffrey Brown, a Trump appointee, wrote in the ruling. "To be sure, politics played a role in drawing the 2025 Map. But it was much more than just politics. Substantial evidence shows that Texas racially gerrymandered the 2025 Map." Indeed, it's a lot easier to prove "racial gerrymandering" based on the number of voters of color in a new district compared to the last one. It doesn't matter if many of those black and Hispanic voters would vote Republican. The Voting Rights Act only recognized the color of the voter's skin.GOP-aligned people filed a lawsuit against the California gerrymander that Gavin Newsom just put into action. They allege that gerrymander is also a racial gerrymander, packing Republican-leaning -- and largely white -- voters into as few districts as possible. How much do you want to bet that that lawsuit gets laughed out of court, resulting in the de facto rule that Democrats are allowed to gerrymander but Republicans aren't? ... California Gov. Gavin Newsom was openly gloating about the decision. He had just rammed through his own Democratic redistricting map that would reduce the nine Republicans currently serving in the 52-member California congressional delegation to four. "Donald Trump and Greg Abbott played with fire, got burned -- and democracy won," Newsom said in a statement Tuesday. "This ruling is a win for Texas and for every American who fights for free and fair elections."We'll see if the Supreme Court accepts cert on an expedited basis. In the congressional gerrymandering fight between Republicans and Democrats ahead of the 2026 midterm election, a number of states are keeping watch for a potential game changer from the U.S. Supreme Court. During the rare rehearing of a Louisiana redistricting case in October, the court's conservative majority appeared inclined to weaken the Voting Rights Act's Section 2 protections against racial discrimination in the political mapmaking process. Such a ruling could spark a new wave of congressional redistricting, especially in the South, where voting is often racially polarized and Section 2 has long prevented the dilution of Black minority voters' collective power. Without the current Section 2 protections, Republican-led southern states may undo districts where Black voters have a realistic opportunity of electing their preferred candidates, who are usually Democrats. This redrawing could give the GOP a sizable boost, as the party seeks to keep control of the House of Representatives. When the Supreme Court would release its decision is crucial. Time is running out to redo maps, which have to be finalized ahead of a state's filing deadline for candidates seeking to run in a primary election for the midterms. "The earlier the decision comes, the more likely the decision is before the date for candidates to declare that they're going to be running, and the more time there is for legislatures to meet and consider maps and redraw their maps," says Nick Stephanopoulos, a professor specializing in election law at Harvard Law School. The next batch of filing deadlines arrives in December. Still, Stephanopoulos notes these cut-off dates are "just products of state law." VRA Section 2 simply doesn't apply in the ruling. Hispanic isn't a protected class under Section 2, and the argument in the ruling is about urban/rural Hispanic populations.

A few years ago, democrats in Texas wanted to gerrymander a majority Hispanic district in West Texas and the southern Panhandle. The problem was it was a majority Hispanic area already and they were voting for republicans.

OT: So, got the free turkey today. If you have a store card and have not gotten one yet, I would do so soon b/c there may not be any freebies next week. No turkey over 13.1lbs this year, so spouse will be a little sad with what he's calling the "Tiny Tim" turkey...(usually I do 16-18, and last year was 24 b/c when I bought the same time as now, there will littles and bigs and no in betweens...now, no bigs, either). Yeah, the Texas ruling isn't going to stand. California made race the determining factor and their entire redistricting effort is going to fail because of that - SCOTUS has had just about enough of anything based upon race or sex.
As for Indiana - Trump screwed the pooch there. The Indiana Hose, which is way more MAGA than the Senate wasn't thrilled with Trump's salvos. The Senate essentially told him to get fucked. We run our elections clean, and we worked hard to clean up the mess of district goofiness when the dems ran the state. A little known thing, the democrats ran away from the state to prevent a quorum over an issue I cannot even remember. The voters have still not forgiven them. The dem party in Indiana died that day and has never recovered. The GOP isn't going to go against what they have used as a governing measuring stick. I saw it. I did something similar in HS in the mid-70s when a bunch of us went to Daytona Beach for Spring Break. Most of us were underage for getting into the bars, but we all brought our driver learner permits with us, even though we all had real DLs. The learner permits were issued on paper, unlike a laminated DL. I changed the birthdate to make us all older than the age restriction. A couple of pencil marks before soaking the paper in water and letting them dry. That's all it took. Every doorman at the bars checking IDs let us in. I was a hero for awhile. This is been the way of things for ages. About a decade ago, the Pennsylvania legislature drew up a new districting. This is within the PA Constitution. Only the legislature can re-district by majority. The Democrats filed suit, and it went up to the PA Supreme Court (which swung Liberal). They not only shot it down. The PA SC hired (without authority) a hack political science prof from Stanford to come in and re-draw the districting. He, of course, was a leftist, and proceeded to fold safe red districts into urban centers. When it was all said and done, the majority party in PA lost a handful of seats in the US Congress.
The US SC did not hear the case. And, btw, the NC Supreme court saw this and since their SC leaned left at the time, they hired the same Stanford hack to do the exact same thing in that state. A handful of other red states with left leaning Supreme Courts did the same over the last decade. Don't expect any relief from the US SC. 1946, 1994, 2010 were all huge swings to the GOP in mid-terms. 2014 mid-terms created a 60 seat R majority. There is usually a swing to the opposing party after losing. Utah has a worse problem with its judges. So Utah has four congressional seats. and there is really only one "Democrat hot spot" in the state: Salt Lake City and neighboring Summit county. But that's a lot of people. So the districts all have a part of Salt lake, leading to 4 Republican seats, but slightly more liberal than preferred... still Republican. The Democrats in Utah scream, over and over, that it's not fair they are "diluted" and don't get one of the four seats. And now they have a judge who flat out said it's illegal to gerrymander Democrats out of a seat. No race, just flat out "Democrats are over 25% of the state, so they have to get at least one seat" and the judge literally threw out the state districting map and implemented one drawn up by a Democrat firm in Virginia to give Democrats a "safe seat." Of course all the local and national leftists praise the judge... but refuse to adopt that kind of reasoning in any Democrat run state like California. And disgust. It will take a lot to undo that. And that's my honest take. My unscientific assessment is that the scales have been heavily tilted to the left for much of my life and that has led to my current pessimism. It'll take a lot of 'wins' to re-balance me.
