Judge Stays "Insane" Magistrate's Defense of James Comey

Yesterday I reported that a lowly magistrate -- a helper judge that hears motions on behalf of the judge -- made a "rare" grant of a motion to turn over all grand jury evidence to James Comey's team of angry Democrat lawyers. He claimed that despite such orders almost never being granted -- he admitted it was "rare" -- he felt that James Comey's rights "outweighed" the standard guarantee of grand jury secrecy.

This lowly Democrat magistrate searched desperately for some kind of infraction on the part of the prosecutor that he could claim was serious enough to justify this "rare" step. This partisan magistrate claimed there were "misstatements of law" in the grand jury case, which is common, which is why it is "rare" to invade grand jury secrecy, even on behalf of a politically-connected, Deep State protected accused.

But ah, how that changes when James "No Intent/8647" Comey is in the dock.

Generally not a ground to invalidate an indictment.

Misstatements of law by prosecutors in front of the the GJ is a subject that has a LOOOOONG history of litigation.

Not a new topic and defendants rarely win on it.

Bear in mind, grand juries are entirely one-sided, prosecutor-controlled affairs, with no opposing counsel or judge to bring up misstatements as they occur, so these are common and usually not something judges -- or even lowly magistrates -- pitch a fit about.

Nonsense.

Magistrate Judge William Fitzpatrick--appointed by partisan DC-area Democrat judges in 2022--is going out of his way to carry water for James Comey.

Fitzpatrick--through his highly irregular ruling--is grasping at straws to make his findings that Lindsey Halligan (somehow) did something wrong.

She did not.

Fitzpatrick is even pretending there is missing evidence.

Is there any basis for his conspiracy theory?

They know the evidence against Comey is damning.

He lied to Congress to coverup his clear corruption in politicizing and weaponizing intel agencies and law enforcement to take out political enemies--the biggest scandal in American history.

So they are doing everything they can to stop Lindsey Halligan.

Lindsey Halligan is clearly over the target.

The Justice Department must appeal this fact-free and lawless ruling by Fitzpatrick.

The Deep State protects its own.

Halligan filed for an emergency stay, which was granted.

This doesn't mean the matter is settled, just that the government is now afforded the opportunity, which the lowly magistrate didn't think they should have, to rebut the insane claims of the defense.

And an actual judge will take a look at the lowly bureaucrat-magistrate's shoddy work.

Stayed for now to allow arguments. Lawfare by judges is relying upon the distaste for appellate courts to engage in interlocutory appeals so you get abuses of injunctions, bail terms, etc. over and over again. And those lawyers/judges/activists are going to be the first ones up against the wall when the rule of law is destroyed by their actions of abusing it.

They never see the forest for the trees. It is if they think critical legal studies point that all law rests on who has power and who has not doesn't apply to them.

The remark was, NO DOUBT, about how Comey was required to testify truthfully before CONGRESS. Someone may have slipped and said the word "trial" instead of "congress". The whole case hinges on whether he lied to congress, so no doubt someone said, "can he lie to congress?"

The second concern is preposterous - the jury saw three charges and rejected one so they redrafted the charging document with two of the three charges. The jury doesn't have to then vote on THAT. Not typically.

Both excuses are absurd. The main problem is Comey is very obviously utterly guilty. He definitively lied to congress, more than once. His own words prove it - it requires no testimony from anyone. He literally said, under oath "I never did this thing" then wrote e-mails describing how he did that very thing. Open and shut case.

69 Positive development, but I wouldn't get my hopes up. Judge Nachmanoff is another Biden appointee and almost surely a leftwing nut.

As I mentioned yesterday, my read is that Halligan did whatever she had to do to get a reluctant GJ to indict a guy that is probably a hero to most in the area.

That doesn't necessarily make the indictment infirm, as prosecutors do a lot of bullshitting and possibly even lying to GJs. But I think if people see how the sausage is made in this instance they would be surprised.

In my experience, "real" judges often offload tedious tasks -- or tasks they don't want to deal with -- to magistrate judges.

Things like discovery disputes, in camera reviews, settlement/mediation, etc. As a lawyer, I usually didn't like going before MJs, but I kept my mouth shut because you don't want to piss off the MJ or the main judge.

I do think it's odd that a MJ would get first crack at a potentially dispositive and highly unusual motion like Comey's here. I smell a rat.

Most IT corporate and government managers do not want to pay nor manage massive DDOS protections required nowadays. So they outsource it just like cloud storage.

That being said, I use Cloudfare as an alternative DNS server along with Google from my router and Cloudfare DNS encrypts all web communications if not the IP to and from servers cutting the ISP out of the loop. Works well enough for me.

Depends, often the thing that upsets the convicts the most is being wrongfully convicted by underhanded prosecutorial means rather than paying the price for crimes they do commit.

A lot of prison wardens actually like inmates using the legal libraries to file cases--keeps the inmates busy and out of trouble. Caselaw also requires inmates to be able to access good legal libraries so as to draft their petitions. If I somehow ended up inside, that is what I would probably gravitate toward for self preservation--helping inmates out.

Knew a former state AG convicted for misstating how their public relations fund was spent and that is basically what he did inside and after. Helping inmates with their legal issues.

Federal magistrate judges have to have at least 5 years good standing in their state bar. State magistrate judges depend on the state, and sometimes there are no requirements of having a law degree or legal experience.

That runs well enough especially with 32gb of RAM. Still have it on dual boot with a computer to run Dragon Dictate version 13. Later versions don't work well as in forgetting prior training.

I do use aftermarket virus and malware software though and am cautious about where I actually surf with it.

I still have a computer running Windows 7 downstairs for stat programs if needed aka Stata and Stat Transfer. Win 7 has the ability to decently emulate XP SP3 or so which allowed the program to work.

The problem, as always, is that the legislature is in favor of the judicial orders and against their voters.

An example at the state level here in Alabama was the the judicial order by a state circuit judge that wealthy school districts had to fund poor ones. The voters of wealthy districts were made and the legislature made 'oh what can you do' noises. Well, for one, the circuit judges are creatures of the legislature so, how about eliminating this circuit to moot it's judgements?

By the time that amendment was ratified, only a few state legislatures still selected them.

Partisan fights leaving vacant Senate seats, massive corruption in state legislatures over selection, and public demands led most states to use some sort of popular vote to select the state's candidates who were then ratified by the state legs.

I don't see any groundswell for overturning that amendment.

Something that might have more effect is an amendment forbidding people outside of a jurisdiction from donating to that state or district's candidates.

Until we can limit the power of the Federal government, I am going to have to oppose this. As long as a Senatorial election in New Jersey can have more effect on my life that the one here in Alabama (and it does since we are just going to get one or another Chamber of Commerce Republican here) I need to be able to participate there.

Using that rationale, why ban foreign contributors.

If the intention is to make politicians responsive to their constituents, then allowing massive donations outside of that jurisdiction (common among Dems nowadays) essentially screws the people of that state.

Contra the idiotic Buckley v. Valeo decision equating money and speech, giving money is an ACTION, not speech itself and nothing says that wealthier out of state donors should have a bigger megaphone than citizens in the state where they are elected.

And another wearying appeal to higher courts where that judge will be reversed. That particular issue was resolved even before the ACW with enforcement of the fugitive slave law. States cannot deny federal access to state or other facilities for legitimate law enforcement actions.

Sanctuary states are in fact unconstitutional by their very nature--whatever you think about immigration, it is clear that enforcement of it is an enumerated federal power that overrides the 10th. A state cannot be commanded to enforce federal immigration law but nor can it hinder the federal government in doing so.
