Lowly Federal Magistrate Orders Comey Prosecutor to Turn Over all Grand Jury Materials, Claiming a "Disturbing Pattern" of Prosecuting a Democrat

Actually the magistrate claimed a disturbing pattern of misleading claims, but I think my translation is more accurate.

This corrupt operator is looking to disqualify the prosecutor, believing that if she is eliminated, no one at the DOJ will be willing to prosecute the Deep State Fixer James Comey.

A federal magistrate judge has ordered the Justice Department to turn over grand jury materials to former FBI Director James Comey as he fights criminal charges, pointing to possible government misconduct as reason to grant the unusual relief.

Judge William Fitzpatrick referenced several apparent missteps by Lindsey Halligan, the interim U.S. attorney hand-picked by President Trump to pursue charges against his foe, that may have threatened the proceeding's fairness.

He said that Comey's right to due process outweighs the typical secrecy afforded to grand jury proceedings, directing prosecutors to hand over the materials by the end of Monday.

It's always Democrats who are discovered to have stronger rights than the ordinary citizen. A phantasmal "intent" requirement was falsely read into the Espionage law to save Hillary Clinton -- by James Comey, of course.


"The Court recognizes that the relief sought by the defense is rarely granted," Fitzpatrick said. "However, the record points to a disturbing pattern of profound investigative missteps, missteps that led an FBI agent and a prosecutor to potentially undermine the integrity of the grand jury proceeding."

We never grant these motions, but a key Democrat Deep State operative is making it now, soooo.

Though Fitzpatrick did not name Halligan, a different federal judge confirmed at a hearing last week that Halligan was the only prosecutor to present evidence against Comey to the grand jury. Fitzpatrick also said that just one prosecutor was present.

The judge wrote that "the prosecutor" made at least two statements to grand jurors that seemed to be "fundamental misstatements of the law."

The remarks themselves were redacted in the court filing. But Fitzpatrick said they came in response to grand jurors' questions and were directly related to communications involving Comey.

One of the remarks, the judge said, implied that Comey does not have a Fifth Amendment right to decline to testify at trial, which may have led grand jurors to believe that it is Comey's burden, not the government's, to prove guilt beyond a reasonable doubt.

That statement was made in response to "challenging questions" from grand jurors, Fitzpatrick continued, suggesting grand jurors may have believed that even if Halligan could not answer their questions, Comey would later have to.

The other remark "clearly suggested" to grand jurors that they did not have to rely on the record before them and could be assured that the government had more, and possibly better, evidence that would be presented at trial, the judge said.

Fitzpatrick also raised concern about the actual indictment returned.

Halligan initially sought to charge Comey with three counts, but a grand jury rejected one of those charges. The top prosecutor prepared a second indictment, removing that count, which was accepted by a magistrate judge.

But Fitzpatrick said the record seems to indicate that the grand jury did not review the actual indictment that was ultimately returned, throwing the case into "uncharted legal territory."

The remark was, NO DOUBT, about how Comey was required to testify truthfully before CONGRESS. Someone may have slipped and said the word "trial" instead of "congress". The whole case hinges on whether he lied to congress, so no doubt someone said, "can he lie to congress?"

The second concern is preposterous - the jury saw three charges and rejected one so they redrafted the charging document with two of the three charges. The jury doesn't have to then vote on THAT. Not typically.

Federal judges substituting their own non-evidentiary extra-judicial opinion for that of those charged with making the decisions.

Without knowing criminal law, I can see that 99.99% of the time these demands for the grand jury proceedings are denied on the simple principle that the prosecution still bears the burden at trial.

The grand jury is not an adversarial proceeding and the standard is pretty low to bring charges.

Yet, this clown judge is turning the GJ into a full-blown mini-trial. Specifically to give Comey a way to taint and scuttle the whole prosecution.

What's ridiculous is these same judges were bending over backward to help along the prosecution of Trump.
Trump is just 1 of endless examples of how the prosecution miniplates, deceives and plies the grand jury to get an indictment.
That the judge admits that it's rare to reveal but he's allowing this tells you how corrupt this judge is.

I would have to look it up but I believe that his order violates federal law. Grand jury proceedings are secret by nature and definition. Once they are compromised anyone can question their conclusions because they are not convicting a person they are merely voting on whether the prosecutor has presented enough evidence to warrant charges and a trial.

That is, the "why" they resigned is not admissible as those who resigned can be called to testify.
But here is the clown judge, not just taking that out-of-court statement and also allowing it as true.

Then compounding that clear error by impugning the current prosecutor by implication.
Because he intends to keep his thumb on the scale the whole trial.

*Think of how many defendants would love to have an "expert" testify to the jury that the prosecution shouldn't have brought the charges; that they would have resigned instead. That's the elephant the judge is placing on the scale in favor of Comey.

So, my friends' cat Snowflake comes in here a couple of times a day. Runs to the top of the stairs and purrs constantly as she's petted and told how much she's loved.

In winter, she has a nice cat house with an electric blanket.

Horde gamblers need to take bets on if I end up with a cat by the end of Canadian winter. I'm not a cat person but Snowflake and her mother Starry just let me pick them up, hold and cuddle them whenever they see me.

Yep he is trying to nullify the grand jury indictment on a technicality. If he can do this and make it stick all the way through SCOTUS we as a country are well and truly fvcked.


First of all any past, present or future grand jury indictments can and will be questioned in literally tens of thousands of cases and client attorneys will demand to see everything a grand jury saw, said or voted on. They will then be able to tie up the courts for decades claiming unjust prosecution.

This is the judge tasked with overseeing issues in the Comey indictment. Fitzpatrick's almost 25-year tenure in the DOJ overlapped with at least a few Comey defense attorneys and with Comey himself when he served as deputy attorney general then FBI Director.
Fitzpatrick left the US Attorney's Office for the Eastern District of Virginia in 2022 and went straight to the bench. Usually when this happens in other jurisdictions--such as what I saw in DC courthouse where at least 1/3 of the judges had worked in the DC US Attorney's office prosecuting J6ers and Trump associates--judge routinely side with the government and make their life easy.

And if like mine there are probably not any docs from it in any case. Minutes are not taken in grand juries in TX. No personal notes could leave the jury room. If any were taken and often they were not.

My #1 problem with TX grand juries is that the defense is not allowed to present anything, nor show up.

The seriousness of this judicial overreach cannot be expressed enough. Even at mass weekend, the priest offered intentions for a judiciary that returned to impartiality. Usually the Catholic Church takes a long time to get with the program. But I think most people feel liberty slipping away, and it’s being stolen by unelected judges…….

That was my experience as well. Served on grand jury for six months. Listened to more than 450+ cases. 98% were drug-related in some way. Even the felonious thefts were all about stealing something and selling it for money to pay for drugs.

I read a very long and detailed article about the demise of the UK a couple of months ago. The writer, no particularly "religious" herself, nonetheless implied that 50 years of intentional slamming of religion by the powers that be had crippled the morals of that country. In particular, she noticed that not just "advertising" but that murals and all sorts of official and non-official "art" now covered much of the streets and public areas, and much of it was outright sexual depravity. Once one removes religion from the public thought, it opens all sorts of doors.

That's because the defense attorneys get their day in court if charges are brought. A grand jury is not a court and can't decide guilt or innocence. They are just deciding if the prosecutor has enough evidence to warrant a trial. I do know that some of the stuff that was brought before the GJ my wife sat on no indictments were issued. From what she said it was not a slam dunk 100% lock for the prosecutors every month.

I went before voir dire once and the prosecutor went into her series of questions. She asked point blank what we would think if the State did not present all of its evidence. I let her have it, and quite eloquently. I knew I was out.

The next dude who raised his hand in objection to her statement then said "Yeah, what he said". I thought "If the bailiff doesn't walk me out of here in five minutes I will be in shock." He didn't, but I wasn't seated on that jury. Surprise, surprise. Never have been seated on a petit jury.
