Communist Spy Asset and Adulterer Eric Swalwell Referred to the DOJ for Mortgage Fraud

Imma be honest with y'all, I think this is the weakest such referral yet.

Unless he's did what "Big Tish" James and claimed multiple properties to be his primary residence in applying for reduced mortgage rates, I think he skates.

The basic claim here is that he said his DC residence was his "primary" residence and got a $1.2 million mortgage. The purported inconsistency is that a California representative is supposed to be primarily domiciled in California. But he's claiming his DC mansion is his primary residence, so he's not actually a California resident! And if he's telling the truth about being primarily domiciled in DC, he can't be a Representative from California!

Uhhhh... I mean, kind of? I don't think it will hold up. Again, not unless he is claiming both a California home as his primary residence for mortgage purposes along with his DC house. In that case, there's a clear inconsistency between the representations he's making to banks.

But... yeah I don't know if maintaining a residence in California while claiming primary residence in DC is "fraud."

Maybe his alleged "constituents" in California have reason to not vote for him, given that he legally considers himself a DC resident, but... I don't think he's guilty of criminal fraud based on only this.

Sort of like Donald Trump's "fraud" on Deutsche Bank for giving his collateral properties a supposed over-evaluation is really Deutsche Bank's bitch to pitch, not Soros DA Alvin Bragg's. But then, the left thought that was a perfectly reasonable prosecution, sooooo...

Rep. Eric Swalwell (D-Calif.) was hit with a federal criminal referral for alleged mortgage and tax fraud related to his purchase of a $1.2 million home in Washington, DC, that he claimed as a primary residence, The Post has confirmed.

Federal Housing Finance Agency Director Bill Pulte in a Wednesday letter to Attorney General Pam Bondi requested an investigation of Swalwell based on allegedly false and misleading statements he made about the purchase, NBC News first reported.

The California Democrat was able to secure millions of dollars' worth of loans and refinancing based on the primary residence declaration in DC, a source familiar with the referral said.

The designation could constitute mortgage fraud, insurance fraud and state and local tax fraud, among other charges, the source noted.

In addition to the Department of Justice criminal referral, FHFA's inspector general is probing the alleged mortgage fraud.

"As the most vocal critic of Donald Trump over the last decade and as the only person who still has a surviving lawsuit against him, the only thing I am surprised about is that it took him this long to come after me," Swalwell responded in a statement.


"Like James Comey and John Bolton, Adam Schiff and Lisa Cook, Letitia James and the dozens more to come -- I refuse to live in fear in what was once the freest country in the world," added the California congressman, who is now the fourth Democratic official to be targeted for mortgage fraud by the Trump administration.

Swalwell not only committed mortgage fraud — he deemed himself INELIGIBLE to be a member of Congress, as he declared his DC residence his primary residence.

No public record searches show a home owned or leased by Rep. Swalwell in California.

Members of Congress are required under Article I, Section 2 of the U.S. Constitution to be “inhabitants” of the state they represent at the time of their election.

Rep. Swalwell was not and IS not an inhabitant of California, it seems.

66 I do have to say, though, that this looks like a technicality. If DC was in Texas, where the legislature doesn't meet all that much, then sure - the legislator from Odessa (say) shouldn't have his primary residence in Austin.
But Texas has the luxury of letting DC do its foreign policy and trade policy. Texans don't need a legislature running throughout every year.
DC does, like it or not. So whoever is representing Odessa to DC might actually need to spend most his/her time over there.
If it's a legal fiction that the Odessa rep has its "home" among the cows and high school football stadium, when it's actually living around Capitol Hill or Georgetown most of the time; then it holds true for that flatulent gasbag from California too.

I'm not seeing where that is required. There's a requirement that a representative be an "inhabitant" of the state they represent at the time of election. But "inhabitant" seems to be something less than "primary domicile."

Not that I see...everyone here wanted it to end from top to bottom. VA was losing so much money, and some won't come back (like the defense contractor folks furloughed between Oct 27 and Nov 1). Gov is 100% backing Kaine, and she won in a landslide, so that's keeping things quiet, even if there are malcontents.

Still has the plastic skeletons out from Halloween, but now they're wearing Santa hats.

If that holds up, I'll imagine we'll have one hell of cat fight next year.

I'm in Canada and Thanksgiving is over so I'm finishing putting up the outside lights now. Usually it's the day after Halloween but it's been a horrible year.

Beautiful party with my friends yesterday. The kids love to decorate the tree. I'm pretty much all set for Christmas now.

I still have one more time to do leaves but I do want to put out spotlights. Spotlights shining up into the hige trees look very beautiful. Mom and I were transitioning to all LED lights.
