Sefton: sefton at cutjibnewsletter.com | Wednesday Morning Rant![]() We voted early last week here in Texas. 17 constitutional amendments on the ballot. I skipped one because I could not understand what they were trying to accomplish the language was so convulated. This is so common with ballot language that you can set your watch by it. Somebody wants to put one over on the public, and so writes something so confusing that they get the outcome they want through pure inscrutability. It isn't even as simple as "vote for or against or sit it out," because depending on how it is written, any of those things can be what the con men who wrote it actually want. The "see who's for it and decide accordingly" approach is usually better, but even that is still fraught with peril. Here's an example from the great state of California: Eliminates Recently Enacted Road Repair and Transportation Funding by Repealing Revenues Dedicated for those Purposes. What does that mean? If you concluded, "repeals a tax cut and raises taxes," go collect your winnings. You're one of the few who would read, "tax hike" instead of "tax cut" based on that language. There are countless examples, and it is representative of one of the most opaque and corrupt part of the elections process. But what to do about it? Law is complicated (on purpose, but nonetheless it is complicated) and consequences can be hard to judge. Differences of opinion are real, and many are valid. It's a tricky problem. I have periodically thought about this problem, usually when confronted with appalling ballot language in Colorado (that state is terrible on this front). One idea I've had is what I call the "C-Average Standard." First, create ballot language according to whatever rules apply today. Then, the finalist language is distributed to high schoolers at schools within the jurisdictions subject to the ballot measure, at least one high school per school district. The students to whom the ballot language is distributed must have a "C" average - a GPA of 2.0-2.75. Not the total dumbasses, but also not the top students. The "average" students. Have them read it and then describe its effects. No computers. No phones. Test-taking rules. If more than 5% or 100 students - whichever is smaller - fails to accurately interpret the effect of the ballot measure, the language is rejected and the sponsors have to try again. Do it until C-average high school students can understand the issue. If the ballot writers fail to develop comprehensible language before the ballots are printed, the measure is canceled and does not go to a vote at all. The "C-Average" standard would have resulted in a total rewrite of the example above. It looks like a tax cut, and that's what a lot of people would say about it. If you don't know in advance that the "recently enacted road repair and transportation funding" law that was to be repealed was a cut to the gas tax, there's no way you would know. The ballot language makes sure of that, because it was written by con men looking to put one over on the voting public. What would you do about deceptive ballot language? Is it a solvable problem at all? Comments(Jump to bottom of comments)1

We had one I voted down yesterday, with words to effect of "let us invest this fund in the stock market."
My ears perked up, I rightly asked why would a Constitutional amendment be required to invest a fund - it sounds like the public rightly does not trust the legislature. The wife and I discussed, and I rattled off A), b) and iii) reasons why not. She, not satisfied, internet expert advice, which rattled off same A), b) and iii) reasons why not, and she agreed. *eye roll* Turns out that the fund is insolvent: A) Why, then, would we trust your investing prowess? b) It would likely be invested in Green Nood Eel boondoggles. And iii) somebody's friend is going to be getting rich on the investments either through kickbacks, unearned patronage and fees, and/or insider trading knowledge. It doesn't feel like a national referendum in Trump to me. Just local elections where the blue dominated states voted as they usually do.
But if that's the case, it means in 2024, Trump running brought out a national referendum on the dems in states and counties that usually lean blues. This means with him not running in 2028, states that vote blue will vote blue unless the GOP And RNC gets off their cushy butts and actually tries to win races. Am I insane? Is my take totally wrong? This is a huge problem in California.
What the legislature doesn't want to approve or cannot approve they ask the voters to approve. Each election we receive a ballot book with the Attorney General's summary, sponsors' arguments and opponents' rebuttals. The legal redline text. Paid advertisements supporting and opposing with endorsers listed. It is utterly incomprehensible and intended to be so. It is meant to create fear, uncertainty, and doubt the essential pillars of Democratic Party governance. Posted by: San Franpsycho at November 05, 2025 11:12 AM (IC093) 64
If more than 5% or 100 students - whichever is smaller - fails to accurately interpret the effect of the ballot measure, the language is rejected and the sponsors have to try again.

On my ballot yesterday was a question that I had to read several times to understand. It was whether to raise funding for some government agencies. But it wasn’t a simple do you want to increase funding?
No. That would be too easy. The question was 4 paragraphs long with all sorts of double negatives. A yes vote instructs the planning commission to not vote to increase funding but to authorize a bind measure to increase funding which will be paid for by money taken from this fund and allocated to this other fund. It was nothing but legalese that no civilian could possibly understand. I did my homework ahead of time and figured out a yes vote means more taxes a no vote means no new taxes. Chaos is their ladder. And if you think any of the major media will "inform" the low information majority that any of the chaos is the fault of their favored politicians, as opposed to blaming Trump & the GOP, you haven't been paying attention. I fear you place far too much trust in the average American voter. If you think I place too much trust in the average American voter, then you don't know me at all. Dave Rubin had a really good interview with Rudy Giuliani on his show yesterday, getting his take on things for NYC before the election was decided.
Giuliani reminded Rubin, and this I don't know, that New York/NYC did NOT vote for Lincoln! They chose the Democrat. So even way back when, they have been voting against their best interests. Plus the boss tweed corruption stuff that never truly went away. Giuliani pulled completely out of NYC, only lives in Florida now. I'm sure some of that is his money woes. There is some things you do not say. There are some thing you do not joke about. There are things that decent, moral people will NOT say- even in the abstract.
I remember reading an article where a guy was arguing with a commie about words and whether they have meaning and matter. He said 'Ok, if you believe that words have NO meaning, repeat after me: 'I want my children to die horrible, painful deaths right now.' The person rightly refused. So his point was: those words matter to you, don't they. Another example is James Gunn. I really liked GotG, but when it came out that he was joking about banging kids, that was it. He was a piece of shit. These types of things are revealing of nature. And guess what, he is a piece of shit. Posted by: Aetius451AD at November 05, 2025 11:31 AM (bss/y) 162

What happens then? What happens if businesses bug out? The idea that people have to be physically uncomfortable with their situation before they'll reconsider their options isn't necessarily wrong. Posted by: Joe Mannix at 11:00 AM --------------- How about requiring something akin to software & hardware QA (Quality Assurance) "Black Box Testing" -- which evaluates the system's functionality based on external behavior, without any knowledge of the internal code or architecture? Require a series of varying related input conditions (scenarios) followed by: (1) their CURRENT output results (the present status quo, and hence the result of a NO vote); along with (2) their FUTURE output results if passed (and hence the result of a NO vote). To prevent misleading, deceptive, and lying scenarios would require some independent group of lawyers, judges and/or to facilitate in creating and -- honestly in good faith -- representing these various scenarios (which of course it subject to corruption a la Califzuela's "Independent" Redistricting Commission ... aye, there's the rub!). If the commie appointed title board does not like the measure they will write a confusing title for the ballot. Everyone is mailed a 'blue book' with more details of the amendments and sometimes PACs will advertise to say what an amendment does but the title board can really sabotage citizen amendments. My tell-tale in California's Byzantine language describing the various propositions (which read like the rules of Fizzbin) is to check the bottom statement where it states how much money is to be spent/saved. If it costs a dime, I vote No. Used to be if it benefited first responders or schools it was okay, but now it seems like every election they're doing something that's supposedly "for the children" but it goes to the admins and the Dem unions. Ditto anything for the roads, which are literally falling apart around here. And the people of my upscale town apparently haven't met a tax or bond yet that they didn't like.
I'd be depressed by yesterday's outcome to make California even more California, except since the idiots voted in the instant run-off thing, all of our choices are between Democrat No. 1, Democrat No. 2, and sometimes Democrat No. 3. West end Louisville has been a shithole for a long time. South is a shithole now. North is the river. East end has shithole creep because if you want to rob and steal from people you go where there's something to take. With the number of west end murders, you'd think at some point the black population would be declining but they keep making more and more bodies.

Why would anyone who wants to pack up and leave a blue shithole city want to move to another big city? Go rural, for fuck's sake. Find some place that is deep enough rural that urban commuters have not yet found it, and driven land prices into the stratosphere.
— In the case of Coeur D’Alene that’s what it was once upon a time. It was a small town in the middle of nowhere. Then people in California discovered it, moved there and turned it into another blue city shithole. See also Bend Oregon and Bozeman, Montana. I think we might have to reconcile ourselves to the idea that Trump is a political unicorn…. Many people all over the country vote for him but only him… he’s not on the ballot they lose interest.
------- Yes. And IF the GOP were smart, they'd MOVE their positions to align with OUR positions. "We" aren't "GOP" as they currently define themselves--we're Trumpians in that we believe in America First, Second, and Third. But the GOP still thinks its okay that they play footsie with the Dems and that we'll come out and help them. Posted by: Crusader at November 05, 2025 12:27 PM (TN0g+) 409

Erika Kirk on Sinclair Broadcasting regarding Kimmel: "They asked, 'Do you want Jimmy to give you an apology? Do you want to be on his show? How can we make it right?'" Kirk tells Watters. "Through our team, I responded. I said, 'Tell them, thank you. We received their note. This is not our issue. This is not our mess.'" Colorado is touted as a well-educated State, but the education surely - demonstrably! - does not extend to history, civics, nor government. In our elections yesterday apparently few people noticed that they approved setting up slush funds across the Counties, and across the State.
In Larimer County we had a couple issues, as did the whole State, which included the ability for the created advocacy groups to set up their own slush funds, without bother to abide by TABOR. Step-by-step these "educated" Coloradoans are overruling TABOR, and putting more and more funding out of the control of the Legislature. Educated electorate, my ass!
