Some not. And over the past two weeks I haven't paid much attention to current events. But something caught my attention as would walking into a wall. I'm not an attorney, never played one on TV but I have worked with and worked for attorneys. Oh they are an interesting lot. I'm not sure I would go as far as William Shakespeare and call for their demise. Most of the attorneys I've met I wouldn't walk across the street to piss on them if they were on fire. And I'm betting my next Social Security check (which is still coming during the government shutdown) I wouldn't and neither would you if you saw Bill Clinton appointed San Francisco district judge Susan Yvonne Illston on flames. (Standing vs. Judge shopping is a Rant for another time) I wouldn't bet against someone crossing the street and adding fuel to the fire. After 2020 I became as my father would say, "Sick and tired" of the judicial decisions made based upon"Standing". Well, unless I suck at geography San Francisco is on the other side of the country from Washington D.C. yet a Californian judge who know one ever heard of has stopped President Trump. (Again, temporarily) The Federal Employees who are so vital to this nation's survival need to retain their positions. Without them we would all suffer horribly per this maven of jurisprudence. You see, us stupid knuckle dragging, mouth breathing Wal-Mart shopping people understand that law is based upon rules and precedents. It is quite apparent we (and the duly elected POTUS) lack the clear moral superiority when it comes to math, money and employees. Federal judge Susan Illston on Wednesday blocked the Trump administration from firing workers during the government shutdown - ruling that she believes the evidence would ultimately show that the firings were illegal and in excess of authority. Federal agencies began issuing layoff notices on Friday aimed at reducing the size of the federal government and pressure Democratic lawmakers while the government shutdown continues. According to Illston, the administration has been acting without thinking things through. "It's very much ready, fire, aim on most of these programs, and it has a human cost," she said, adding "It’s a human cost that cannot be tolerated."There is a human cost to every facet of life. And Judge Resting Bitch Face a majority of people and the electoral college voted that those human costs are not only tolerable but encouraged. But then again she is a west coast elite who rules on emotion rather than fact. And that is why she will be overruled shortly, because she can't understand normal thinking. I don't like or hate lawyers on the face of it. Lotta scumbags in that profession - but not as bad as, say, actors or schoolteachers.

Posted by: Archimedes ------- Actually not permissible for judges in administrative law cases to submit their judgment for the executive branch. Separation of powers and all that. Judges have to rule only on what the law says or does not say and the Anti Deficiency Act clearly gives the executive the power to fire or layoff government workers when a shutdown occurs. So she ruled instead by TRO and muh feelz despite Scotus scolding and reversing a bunch of these. Plus, made her ruling out of jurisdiction as well as the nexus of where the decision was made should have been DC where the OMB is located rather than San Francisco. But the funny thing is that the 9th is much less liberal than it used to be thanks to Trump while some other circuits are more liberal like the 1st and mebbe the 4th. BTW, Sefton was right yesterday about the bridge: it's the Lower Hack Lift in Jersey City. Originally built in 1928 for the Lackawanna, now carries the NJ Transit Morris & Essex trains over the Hackensack River. The two bridges in the background are the Erie Lackawanna Main Line bridge (since replaced) and the PRR (now Amtrak Northeast Corridor).

Good lawyers are like good judges: Rare, but when you stumble across one it's a real blessing. And good judges are even more rare that good lawyers. Judges are usually lawyers who grew tired of doing their jobs, and all the work and risk that comes with that (including competing in the real world) so they packed up their delusions, sucked up to the powers that be, and headed for a life of unaccountable authority.

Blue model of government is dying across the West because we simply no longer generate enough tax revenues to sustain a large government and welfare state. IL, NY, and CA are showing severe strain in finances from the blue model of vast welfare benefits, large rakeoffs for their cronies, and massive government unionized employees that are sucking those states dry on pension and salary benefits. There are some red states with issues like Kentucky and Mississippi but the lack of entrenched blue legal protections for bennies means easier to cut those back if needed. To be clear, all of these illegal injunctions against Trump, based on the APA, all of them follow this pattern:
-Trump is a big meanie and said mean things. Those mean things aren't nice and prove he has bad motivations. -Because he has bad motivations, even though the thing he is doing is legal, we think it is now illegal. -And also, he didn't file form 8e2-47 in triplicate with notice posted in every federal courthouse for 7 months, so that's a violation of the APA. The SCOTUS, in the Utah land case, already ruled that violation of mere procedures, or even requirements, by the Executive (the EPA), does not grant standing. And further, that failure cannot be grounds for an injunction. And yet, these clown judges persist in the falsehood that the APA does exactly that. The one good aspect of this fight with the Judges is that it exposes a huge weak spot in our system that should have been noted and fixed long ago. Namely that there is no clear statutory limit on Federal Judges power; we’ve always just counted on them to have sense and not try to be too dictatorial.

I am concerned that there are few conservative lawyers under age 40. It's been 25 years since I graduated law school. We had a mix of conservative but mostly liberal professors who made no effort to indoctrinate us.
Most of my class were liberal but we had a critical mass of smart conservatives, usually people like me who didn't go in straight from college but matured a little by paying our dues in other fields first.
