Supreme Court Might (or Might Not) Scrap the Democrat Extremist Doctrine of Court-Mandated Explicitly-Racist Gerrymandering

Back in the 80s, if I remember right, left-wing extremists began demanding that section 2 of the Voting Rights Act be read to require explicitly race-based gerrymandering to create majority-minority districts.

These majority-minority districts just so happened to be Democrat-supermajority districts, and this imposition was placed on the states of the old Confederacy, which just so happen to be Republican states.

Left-wing judges agreed with this idea, naturally, and began demanding that red states gerrymander their congressional districts to always guarantee Democrats of 3-4 bonus seats that they would never, ever have in a normal partisan gerrymander. While the blue states worked relentlessly to eliminate all Republican-leaning districts, or to pack all Republicans into just one or two districts to make sure every other district was Democrat-majority, Republicans have been forced by left-wing judges to always carve out special Democrats-Only districts.

The state of Louisiana just carved out not one but two strangely-shaped districts to make two seats that only Democrats (specifically, black Democrats) could win. Louisiana citizens sued, claiming -- correctly -- that these districts were drawn on racist grounds and therefore were a violation of the Constitution.

The Supreme Court just heard oral arguments in this case yesterday, and the liberal media is worried that the Supreme Court may remove the apparently-permanent demand that Republican states always carve out DEI districts for Democrats.

I'm less excited, myself. I do not believe that Roberts and the disastrous Amy Coney-Barrett will take the "controversial" step of upholding the Constitution's demand of racial blindness and equality.

The Supreme Court's conservative majority appears to be on the verge of weakening the Voting Rights Act, the landmark civil rights era law that protects racial minorities' voting power.

Note the way that put that -- it protects minorities' voting power. Not their votes -- they can vote, could vote, and will continue to vote.

No, this section has been re-interpreted to mean not just that their votes are protected, but that they are guaranteed to win by racially-gerrymandering districts that racial minority Democrats just can't lose under any circumstances.

During oral arguments Wednesday in Louisiana v. Callais, several conservative justices signaled outright hostility toward the longstanding interpretation of Section 2 of the 1965 law -- which broadly prohibits discrimination in voting practices on the basis of race or creed.
Decades of legal precedents have, in practice, directed states and federal courts to ensure that legislative district maps contain some districts where minority voters make up at least half the population. The rationale is to prevent "dilution" of minorities' voting power and ensure that communities of Black, Latino or Asian voters can elect their preferred candidates.
But Justices Clarence Thomas, Samuel Alito and Neil Gorsuch appeared inclined to bar virtually any use of race in redistricting. They suggested that race-conscious district lines might be unconstitutional.
And Justice Brett Kavanaugh, whose vote will likely be pivotal in the case, repeatedly suggested that race-based remedies under the Voting Rights Act should be permitted only "for a limited period of time."
"They should have an end point," Kavanaugh said during the oral arguments, which stretched for about two and a half hours.
Kavanaugh's desire for a time limit resembled the Supreme Court's treatment of affirmative action in higher education. Two years ago, the six-justice conservative majority overturned decades of prior precedents and struck down race-conscious admissions policies, in part because the court found that racial dynamics in society have evolved.
Chief Justice John Roberts and Justice Amy Coney Barrett, the other key votes, asked questions of both sides but were harder to read.

I can read them. They're cowards who crave establishment approval.

Meanwhile, as usual, there is absolutely no question which way the "independent" liberals are voting.

Many observers were closely watching Roberts. The chief justice has often voted to curtail the Voting Rights Act in other contexts, including in a landmark 2013 decision that he authored. But in a 2023 case out of Alabama, Roberts (and Kavanaugh) combined with the liberal justices to maintain Section 2 of the law.

Gorsuch, for his part, sent a strong signal about how he views the use of race in drawing district maps, even when the stated purpose of using race is to remedy prior discrimination. That practice, Gorsuch said repeatedly, amounts to "intentional" racial discrimination.

As I said, I expect Roberts and Coney-Barrett to side, as usual, with the liberals. I also think that Kavanaugh is weak (and frankly, I wish we'd abandoned him when he was falsely accused of rape) and I expect him to join the liberals as well, though with the proviso that Seriously You Guys, At Some Unspecified Date Decades in the Future, You Must Stop Discriminating Against Whites Like the Constitution Requires, But It's Okay for Now Because It's Not Permanent.

Still, I suppose it's possible they strike down this particular erroneous judge-made rule.

The left is freaking out because, all told, this explicitly-racist practice of the courts has granted the Democrats nineteen guaranteed congressional districts in the red states that they will lose if the Supreme Court scraps the practice.

And I mean "possibly lose in the next year" -- Ron DeSantis, for example, has promised he will immediately began drawing up a new congressional map for Florida the moment the Supreme Court allows him to.

Democratic voting rights groups are preparing for a nightmare scenario if the Supreme Court guts a key part of the landmark civil rights-era legislation, the Voting Rights Act -- a very real possibility this term.
Ahead of the court's Oct. 15 rehearing of Louisiana v. Callais -- a case that has major implications for the VRA -- two voting rights groups are sounding the alarm, warning that eliminating Section 2, a provision that prohibits racial gerrymandering when it dilutes minority voting power, would let Republicans redraw up to 19 House seats to favor the party and crush minority representation in Congress.
That calculation, made in a new report from Fair Fight Action and Black Voters Matter Fund shared exclusively with POLITICO, would all but guarantee Republican control of Congress.
While a ruling in time for next year's midterms is unlikely, the organizations behind the report said that it's not out of the question. Taken together, the groups identified 27 total seats that Republicans could redistrict in their favor ahead of the midterms -- 19 of which stem from Section 2 being overturned.
Doing so would "clear the path for a one-party system where power serves the powerful and silences the people," Black Voters Matter Fund co-founder LaTosha Brown said in a statement.

They can't do it while Section 2 of the VRA is in force. SC-6 is the only Democrat district, and it's a Section 2 district at the same time.

They can't redistrict him out until Section 2 is struck down. That's why they haven't done anything yet.

Will they do it after Section 2 is presumptively struck down? That's another question, but it has nothing to do with lack of action now.

VRA as a whole is constitutional under the 15th Amendment. But the particular section 2 of the VRA which by the way passed the GOP Senate and was signed by Ronald Reagan overturned Scotus ruling City of Mobile v. Bolden in 1980.

"Congress amended Section 2 to create a "results" test, which prohibits any voting law that has a discriminatory effect irrespective of whether the law was intentionally enacted or maintained for a discriminatory purpose." from Wiki.

GOP actually used this to their advantage after 1990 to pack blacks into districts to get rid of white Southern Democrats which they did.

Main two legal questions are whether Equal Protection clause forbids the amended Section 2 under strict scrutiny generally or whether this is non justiciable which would also leave it up to states like partisan gerrymandering.

Scotus also is considering whether the LA district court panel erred in the LA district creation via improper strict scrutiny/preconditions in Thornburg wrongly applied.

Current Scotus precedent (Thornburg v. Gingles) and the VRA as amended in 1982 says yes.

That is what the court is dealing with. A mess made by Scotus with its various destructive decisions (made by a majority GOP Burger Court btw) in Griggs v. Duke Power, Thornburg v. Gingles, and Bakke v. Univ. of California System.

There are four legal questions argued in this case. Two deal with whether just to declare that the three judge panel goofed up in creating the LA district either by failing to apply strict scrutiny to racial remedies or misapplying Scotus decision in Thornburg as to how to apply that decision to the district. The other two are wider in impact. One is to apply 14th Amendment equal protection strict scrutiny across the board to racial redistricting which means most would fail that test. The second would be that such cases are non justiciable which would punt back to states their power to district. That would mean a retreat back to Colegrove v. Green (redistricting is a political question) std espoused by Justice Frankfurter. Court recently concluded that partisan gerrymandering are such. This would extend this to race as far as individual plaintiffs having standing to sue over districts.

The federal government telling states how they can run elections or district is blatantly unconstitutional, and the federal government telling only some states how they can do so is even more unjust.

See 15th Amendment. You always construe later Amendments as altering the original ones so that the 15th specifically limits state powers over elections that are intended to racially discriminate as to who gets to vote. 19th prevents states from denying vote to women. Both are later than the 10th and thus alter the original meaning as they do the Constitution itself.

The black kids chose to stay at their school. It was then called, "freedom of choice." We had one black guy who went on to accomplish more than the others of our 50: he joined the AF, became both a doctor AND a lawyer. I saw him in 2001 and hugged him and am so proud of him.

History simply tells us how the words are meant to be interpreted and the 15th specifically grants to Congress the power to forbid racial discrimination in who gets to vote. Thornburg v. Gingles brought in the disparate impact theory of Griggs v. Duke Power into Scotus overseeing the 15th. And that is because a GOP Senate, Dem House, and President Ronald Reagan put that in the VRA. And the GOP later used this to their advantage to wipe out S. White Democrats by the pack, stack, and crack method.

This case was whether the three judge panel in AL properly applied precedent in Thornburg v. Gingles. It was not a constitutional case but rather as applied judicial error of interpreting the statute and Thornburg's test by the lower court.

Barrett dissented in this case. Kavanaugh voted with the Chief primarily I guess due to stare decisis. This case though deals with constitutional arguments so he might very well rule differently here.

That might constitute a 5-4 to overturn the majority minority districts in the VRA under strict scrutiny.

Over time, less and less. Some justices actually piss off the other justices to their detriment. Douglas was one such, Burger another, and Frankfurter was also one of those justices. I think KJB is pointing that way if she does not course correct. Sotomayor is probably on her way out by the morgue or resigning while she still has a bit of health left but she is someone that likewise never spent much time cultivating other justices.

William Brennan and Kagan, on the other hand are examples of justices spending time schmoozing justices on the right. Even Ginsberg did so to Scalia to win marginal cases on occasion.

I then calmly and politely told her Catholic proud self that he voted in IL to let babies who survived abortion die in utility closets. If CNN did not say it, I was wrong. Possibly. Since I no longer teach, I don't have to keep up with Scotus smoke signals but yes, it does affect voting. Justice Jackson, for example, did everything he could to become Chief Justice but Truman appointed crony Fred Vinson and the earlier decision of FDR 's picking Harlan F. Stone thwarted that.

Been true at other times but I think Rehnquist was surprised to some extent about being appointed to Chief Justice as promotion from associate justice status is being at the right place and time.

True. But as a long-practicing lawyer who has argued many cases, you shouldn't read too much into judges' questions or reactions or whatever. I've had great arguments where based on the judges' questions and demeanor I thought for sure I won. They later wrote decisions that porked my client in the anus.

Justices by and large don't care about large parts of their supposed domain like commercial law, patent law, Indian law, or even administrative law. So often they tend to delegate to the one member of the court that likes that sort of law to write the relatively non controversial decisions.

Gorsuch, for example, for Indian law.

Media likes people that will say what the media wants to build a narrative. I got interviewed by the NYT once over an article and locally by the media over immigration. The NYT reporter was not happy that I did not fit his framed narrative so that interview was not used.

My other anodyne local news opinion was that a local immigration based restriction was going to head to court made it on the TV air.

290 236 Over time, less and less. Some justices actually piss off the other justices to their detriment. Douglas was one such, Burger another, and Frankfurter was also one of those justices. I think KJB is pointing that way if she does not course correct. Sotomayor is probably on her way out by the morgue or resigning while she still has a bit of health left but she is someone that likewise never spent much time cultivating other justices.

I think that is more likely than 5-4. Roberts, like Burger as CJ, likes to jump out in front of 'big' decisions so he can control the impact. In the earlier Alabama case, Barrett dissented, and Kavanaugh was more likely voting for stare decisis on the case as it was a matter of applying precedent (Thornburg) correctly. Not whether Thornburg was wrong constitutionally with the Equal Protection clause preventing the amended VRA from being applied that way.

There was something similar way back in Shelby v. Holder where the emergency clause 4 requiring DoJ preclearance that kept getting extended based on 1960's era covered jurisdictions, was eventually overruled. Roberts wrote that majority opinion in the 5-4 decision as well.

Frankfurter was a long time Harvard law professor who taught several Scotus judges, one of which was sitting on the court when Felix finally got the nod. Felix treated that justice (Murphy) like he was a law student to be educated.

One justice, whose name I forget, claimed Felix read a mythical book "How Not To Win Argurments and Influence People." The popular book excluded the word Not of course.

The majority minority rule was liberal Dems trying to get rid of old Southern Dems. When the policy was put in, it soon led to Republicans starting to win the remaining districts outside the majority minority and the South soon turned red.
