These majority-minority districts just so happened to be Democrat-supermajority districts, and this imposition was placed on the states of the old Confederacy, which just so happen to be Republican states. Left-wing judges agreed with this idea, naturally, and began demanding that red states gerrymander their congressional districts to always guarantee Democrats of 3-4 bonus seats that they would never, ever have in a normal partisan gerrymander. While the blue states worked relentlessly to eliminate all Republican-leaning districts, or to pack all Republicans into just one or two districts to make sure every other district was Democrat-majority, Republicans have been forced by left-wing judges to always carve out special Democrats-Only districts. The state of Louisiana just carved out not one but two strangely-shaped districts to make two seats that only Democrats (specifically, black Democrats) could win. Louisiana citizens sued, claiming -- correctly -- that these districts were drawn on racist grounds and therefore were a violation of the Constitution. The Supreme Court just heard oral arguments in this case yesterday, and the liberal media is worried that the Supreme Court may remove the apparently-permanent demand that Republican states always carve out DEI districts for Democrats. I'm less excited, myself. I do not believe that Roberts and the disastrous Amy Coney-Barrett will take the "controversial" step of upholding the Constitution's demand of racial blindness and equality.Note the way that put that -- it protects minorities' voting power. Not their votes -- they can vote, could vote, and will continue to vote. No, this section has been re-interpreted to mean not just that their votes are protected, but that they are guaranteed to win by racially-gerrymandering districts that racial minority Democrats just can't lose under any circumstances. But in a 2023 case out of Alabama, Roberts (and Kavanaugh) combined with the liberal justices to maintain Section 2 of the law. ... Gorsuch, for his part, sent a strong signal about how he views the use of race in drawing district maps, even when the stated purpose of using race is to remedy prior discrimination. I also think that Kavanaugh is weak (and frankly, I wish we'd abandoned him when he was falsely accused of rape) and I expect him to join the liberals as well, though with the proviso that Seriously You Guys, At Some Unspecified Date Decades in the Future, You Must Stop Discriminating Against Whites Like the Constitution Requires, But It's Okay for Now Because It's Not Permanent. Still, I suppose it's possible they strike down this particular erroneous judge-made rule. The left is freaking out because, all told, this explicitly-racist practice of the courts has granted the Democrats nineteen guaranteed congressional districts in the red states that they will lose if the Supreme Court scraps the practice. Democratic voting rights groups are preparing for a nightmare scenario if the Supreme Court guts a key part of the landmark civil rights-era legislation, the Voting Rights Act -- a very real possibility this term. Ahead of the court's Oct. 15 rehearing of Louisiana v. Callais -- a case that has major implications for the VRA -- two voting rights groups are sounding the alarm, warning that eliminating Section 2, a provision that prohibits racial gerrymandering when it dilutes minority voting power, would let Republicans redraw up to 19 House seats to favor the party and crush minority representation in Congress. That calculation, made in a new report from Fair Fight Action and Black Voters Matter Fund shared exclusively with POLITICO, would all but guarantee Republican control of Congress. While a ruling in time for next year's midterms is unlikely, the organizations behind the report said that it's not out of the question. Taken together, the groups identified 27 total seats that Republicans could redistrict in their favor ahead of the midterms -- 19 of which stem from Section 2 being overturned. From the little that I have read from the questioning part it appears that it will be a 5-4 decision to gut racial gerrymandering.

They probably won't do this but they ought to. Much of the voting rights act, while well-meaning, is grossly unconstitutional. The federal government telling states how they can run elections or district is blatantly unconstitutional, and the federal government telling only some states how they can do so is even more unjust.

SC-6 is the only Democrat district, and it's a Section 2 district at the same time. They can't redistrict him out until Section 2 is struck down. That's why they haven't done anything yet. Here's what I think will happen:
Whether there should be majority-minority districts to remedy past wrongs (racism) or to ensure blacks "have a voice" will be called a political question. Roberts just recently said, in the Kentucky tranny case, that it is not the court's job to decide whether the policy is good or bad, political questions, but whether it is Constitutional. That the Constitution is equally adamant that favoring one race is just as forbidden as disfavoring a race. And a policy that favors one race--regardless of the justification--is not Constitutional. But the particular section 2 of the VRA which by the way passed the GOP Senate and was signed by Ronald Reagan overturned Scotus ruling City of Mobile v. Bolden in 1980. I'm reasonably certain that if this judge made law does get overturned, and the Dems do somehow get power back, a new law will be made that just explicitly says that due to racism in all red states, a panel of federal Democrat judges will assign seats to whomever they want and it will be ruled constitutional. The blue districts in the state of Mississippi mark the MS Delta. Majority black. They vote Dim because they are told lies. They vote Dim because in the past it paid a bit to do so, as they were bussed from churches to polls. Two deal with whether just to declare that the three judge panel goofed up in creating the LA district either by failing to apply strict scrutiny to racial remedies or misapplying Scotus decision in Thornburg as to how to apply that decision to the district. The other two are wider in impact. One is to apply 14th Amendment equal protection strict scrutiny across the board to racial redistricting which means most would fail that test. The second would be that such cases are non justiciable which would punt back to states their power to district. That would mean a retreat back to Colegrove v. Green (redistricting is a political question) std espoused by Justice Frankfurter. Court recently concluded that partisan gerrymandering are such. Re that Alabama case, Allen v. Milligan:
This case was whether the three judge panel in AL properly applied precedent in Thornburg v. Gingles. It was not a constitutional case but rather as applied judicial error of interpreting the statute and Thornburg's test by the lower court. Barrett dissented in this case. Kavanaugh voted with the Chief primarily I guess due to stare decisis. This case though deals with constitutional arguments so he might very well rule differently here. In the earlier Alabama case, Barrett dissented, and Kavanaugh was more likely voting for stare decisis on the case as it was a matter of applying precedent (Thornburg) correctly. Not whether Thornburg was wrong constitutionally with the Equal Protection clause preventing the amended VRA from being applied that way. There was something similar way back in Shelby v. Holder where the emergency clause 4 requiring DoJ preclearance that kept getting extended based on 1960's era covered jurisdictions, was eventually overruled.
