White House: If Schumer Shuts Down the Government to Force Us to Pay For Medicare for Illegal Aliens, We'll Mass-Fire Bureaucrats Instead of Furoughing Them

DOGE Part 2.

The White House budget office is instructing federal agencies to prepare reduction-in-force plans for mass firings during a possible government shutdown, specifically targeting employees who work for programs that are not legally required to continue.

The Office of Management and Budget move to permanently reduce the government workforce if there is a shutdown, outlined in a memo shared with POLITICO ahead of release to agencies tonight, escalates the stakes of a potential shutdown next week.

In the memo, OMB told agencies to identify programs, projects and activities where discretionary funding will lapse on Oct. 1 and no alternative funding source is available. For those areas, OMB directed agencies to begin drafting RIF [Reduction In Force] plans that would go beyond standard furloughs, permanently eliminating jobs in programs not consistent with President Donald Trump's priorities in the event of a shutdown.

The move marks a significant break from how shutdowns have been handled in recent decades, when most furloughs were temporary and employees were brought back once Congress voted to reopen government and funding was restored. This time, OMB Director Russ Vought is using the threat of permanent job cuts as leverage, upping the ante in the standoff with Democrats in Congress over government spending.

"Programs that did not benefit from an infusion of mandatory appropriations will bear the brunt of a shutdown," OMB wrote in the memo. Agencies were told to submit their proposed RIF plans to OMB and to issue notices to employees even if they would otherwise be excepted or furloughed during a lapse in funding.

Programs that will continue regardless of a shutdown include Social Security, Medicare, veterans benefits, military operations, law enforcement, Immigration and Customs Enforcement, Customs and Border Protection and air traffic control, according to an OMB official granted anonymity to share information not yet public.

Schumer and the Democrats are really going to shut down the government, at least for a while, to try to force Trump to spend Medicare dollars on sex change operations for illegals. (Among other things.)

The language in the memo that the OMB sent out makes note of roles not authorized explicitly by statute, which is a signal that the administration is still using Loper as a driving rationale for all of its deregulatory efforts.

It makes me wonder...is it just easier to eliminate regulations if no one is actively working on it? From an internal perspective.

Like, 10 people are working to, say, study birdflight patterns over rural areas due to climate change, or whatever. But, the 10 people get RIFed. Now that you don't have to deal with any 5th Amendment property claims on the employment of the 10, does it just clear the deck for eliminating the regulation entirely that otherwise wouldn't be allowed? Not that the admin couldn't eliminate the regulation that led to the research group at all, just that the process is streamlined and faster.

To be honest, he'd lose less badly if he had refused to fight at all, even rhetorically.

The media would take it as a signal to not highlight it, the CR passing with little fanfare, and business continuing as usual.

On one level, sure.

But the real power play would be Trump not only doing this BUT ALSO stating that priorities 1, 2, and 3 have to be agreed to and included in ANY resolution that allows government operations to continue (whatever priorities 1, 2, and 3 are for Trump). Don't just trade for the sake of trading--he has the high hand. Make some of our goals be a condition of allowing government operations to continue or open back up.

The federal RIF process gives effect to four main retention factors: Tenure, Veterans Preference, Credible Service, Performance.

Mass layoffs instead of furloughs: Unlike the standard practice of furloughs during a shutdown, the OMB memo instructs agencies to plan for RIFs that would eliminate positions permanently. This would remove the protection of guaranteed back pay for affected union members.

There was a news story, the GAO hired some of the furloughed people back because in some states they had properties that had to be looked after, and nobody left who was in a position to do so. Even at the time Musk said this would happen in a few instances; in a place where you inadvertantly laid off too many people, you could always hire some back when you found that out.

You can't pay anyone except Exempt employees (who are not paid by Congressional appropriation) without a law...Military are not Exempt. Rs have been trying all last week to get a bill that said we could use old unspent appropriations to pay them - Ds wouldn't go for it, although they did last time.

So, military will work, but not be paid til the end. And that will hurt Rs.

Both sides are ramping up the chicken game right now...

It was a stay of a lower order that had ordered Slaughter keeping her position as the suit played out. So, she's out of her job as the merits case continues forward.

Tea leaf reading says, especially since this stay is in outright violation of Humphrey's Executor, that the precedent from the FDR years is going to be overturned once the merits get to SCOTUS (the appeal's court should rule in alignment with the precedent to keep Slaughter in her position because the appeal's court can't overturn precedent).

It worked really well, and actually had a very good sales pitch type vibe that corporate higher ups will like.
