The feds have charged DeCarlos Brown with the federal crime of "Terrorism or other violence resulting in death on a mass transit system." The charge has a maximum penalty of life in prison without the possibility of parole -- or death.

He has been charged with committing an act causing death on a mass transportation system.
"This brutal attack on an innocent woman simply trying to get to her destination is an attack on the American way of life. Of course, crimes like this affect the victim the most -- Iryna deserves justice, and we will bring justice to her and her family," Russ Ferguson, a US Attorney, said.
Ferguson was forced to hold back tears as he unveiled the federal charge that Brown has been hit with.

Justice Department officials have labeled the stabbing as a "terroristic act."

Trump isn't quite sure which option he prefers.

Decarlos Brown, the man federally charged with murdering 23-year-old Iryna Zarutska on a Charlotte commuter train Aug. 22, is now speaking about the horrific slaughter, claiming the government implanted "materials" inside his body to make him butcher the Ukraine refugee.
In a phone interview circulating online, Brown blames "The material. Put it like that. The material using my body. It's that. You know, that's not me.
"I'm talking about just for no reason. But since they did that, since they did that, now they got to investigate the material my body exposed to. Since they want to do all that, now they got to investigate."
The interviewer asks Brown: "She's from the Ukraine ... and you know they got a war ... so I'm just trying to understand, out of all people, why her?"
"I don't have nothing," Brown responded. "They just lashed out on them. That's what happened.
"They lashed out on her. Well I was working out ... Whoever was working the material, they lashed out on her."

Jesse Watters reports that the magistrate who let DeCarlos Brown out of jail just this past January for no bail -- just a signed promise to show up for his next court date -- is a DEI hire without a law degree who is also a "DEI Consultant" and "Racial Equity Organizer."

The insanity defense is tough to establish. "Legal insanity" is not normal insanity. For legal insanity, you have to prove that you did not know what you were doing was wrong. Like, you had a hallucination you were killing a demon or something.

Also, just in practical terms, the kind of people who get off on the insanity defense are clearly NOT insane. Like, a husband will claim temporary insanity when he kills his wife -- "I just blacked out." Clearly bullshit.

Juries tend to reject the insanity defense when it's actually an insane person and a monster -- because they know that monster might kill them. Whereas the husband who kills his wife is probably only a threat to his wife.

I don't know what goes through the minds of anyone other than me. I don't know what "leftist" judges are thinking, just that there are clear indications that our criminal justice system is broken.

It's not working.

Whatever the reasons are, I doubt it's a "leftist" issue, and I doubt it's because there are judges who want crazy violent people on the streets. It's a bigger problem than either of those two things.

They are not required to know what the law is. Their appointment was probably done through nepotism o r tribal network. They have no reason to be impartial.This particular Magistrate also owns a mental health facility. OWNS. A relative runs it. Why not just assign them to go and not care whether they show up because the state is paying.This is not even conflict of interest. This is a scam.

I believe he said he thought they were witches or something, but he doesn't remember clearly. His mother saw him in the kitchen chugging a bottle of vegetable oil before going on a walk that lead to the random killings.

281 Think about this - every time this guy was arrested, it took cops, prosecutors, judges, bailiffs, public defenders, etc. a bunch of time to process him before he was let go.

So, when they say "we don't have enough cops and public defenders and judges to work through our backlog" this is WHY. Because they are processing the same loser a dozen times. If they had tossed him in jail the first time, they could be back out on the streets catching the next asshole, instead of running around only to let him go. This guy sucked up a huge amount of law enforcement resources over the course of his life.

I think its a combination of several awful and sinful ideas.

1) empathy which makes them feel bad at the sad stories of backgrounds of the criminals and the "historical racism" they suffer from because 400 years of slavery etc.
2) an understanding of the world that is limited to oppressor/oppressed dynamics: the only reason someone could be in prison is because someone oppressed them, because they are a minority and out of power.
3) combining those first two ideas results in the belief that people do crime because they feel powerless and have been oppressed their whole lives, and if we end that, then the crimes go away.
4) the idea that there are "too many" "BIPOC" people in prison because of racism, so reducing that number will result in equity of treatment and lower oppression

Its well meaning, sort of, but based on such stupid, insane, and irrational concepts that it ends up being evil.

You make some good points. Personally, I think people who care, and are willing to risk themselves to protect and aid others is taught. The people on that subway weren't taught empathy or sympathy, and the act accordingly.

It's why a lot of us on this site are mystified at how someone can waltz around some festival somewhere with a knife and, somehow, injure, kill, or maim a significant number of people without someone grabbing his arm and proceeding to turn him into a sidewalk stain.

Just as a matter of making a better choice, none of those asylums should be lockup facilities. Or, they should reserve the lockup parts of the facilities to house ONLY those most likely to be violent.

Pocket knife laws in the US are completely nuts. The rules can change dramatically from city to city and county to county. Most cops don't know the rules and if you run into a cop that has a personal issue with knives, he's going to confiscate it, even if it's completely legal.

Here in WA, there was a case that went all the way to the state supreme court in which a woman with a paring knife in her back pocket was charged with a felony. It was upheld. Basically any "hidden" fixed blade is a felony in WA. What does hidden mean? Whatever the lawyers say it means.

A favorite tool for burglars, rapists, etc is a long handled plain ole bladed screwdriver--can be used to pry open doors or windows, and once inside to stab if needed. Screwdrivers are cheap enough to be readily discarded if needing to flee from police after use and plausible denials if stopped by police.

Often those will ill intent on B&E of occupied residences then grab a knife out of the kitchen to do more harm. Not wise to keep kitchen knives out in plain sight for that reason.

And to be clear, yes, communities need those facilities too. They usually call them forensic hospitals, and they're often more like a prison than a hospital.

I would rather see the criminally insane in one type of facility (like the Ann Klein place), and the not criminal types, the mostly harmless types, living in a more peaceful, serene setting.

One of the problems that dude will face is that in the federal system, he will get examined (if he claims insanity) by the best of forensic psychiatrists and psychologists. And your mind becomes essentially the evidence of insanity thus waiving the 5th. You cannot refuse access to extensive questioning, tests, etc. if you claim insanity as it is a justification claim that you did the crime but insane so that you lacked the ability to understand what you did was a crime. So the defendant has the burden of proof (same as self defense).

The problem for the Left is that Trump gets to decide what is necessary and what is not for spending in shutdowns And furloughing people.

The threat to the left is that holding up the NDAA for example, (defense bill) is not popular and I doubt Trump will do the stupid closing nat parks, etc. that Dem presidents used.

I've talked here about one of my favorite places in the world: The Wild Animal Sanctuary in Colorado.

They have lions and tigers and bears (oh my), as well as other animals. All of them are inside enclosures, but the enclosures are large enough for the animals to roam and be "free."

Most of them were rescued from idiots who got baby cubs from God knows where, and put them in small cages in their back yards.

It is easily possible to give those we cannot allow to roam free, for safety reasons, a place to roam "free" enough so they can live a reasonably content life.
