Federal Appeals Court Overrules Leftwing Lunatic District Court Judge, Rules Alligator Alcatraz Can Remain Open

A federal appeals court has temporarily blocked a judge's order requiring Florida and the federal government to shut down and dismantle a controversial immigration detention facility built in the Everglades, widely referred to as "Alligator Alcatraz." On Thursday, the Eleventh US Circuit Court of Appeals granted requests from the State of Florida and the US Department of Homeland Security to stay a district court's preliminary injunction that would have forced the site to wind down operations within 60 days. A preliminary injunction is a temporary order put in place until a court can make a final decision in a case. "After careful consideration, we grant the defendants' motions and we stay the preliminary injunction and the underlying case itself pending appeal," ruled the divided three-judge panel in the majority opinion. The makeshift detention facility had been the subject of intense criticism for its treatment of migrants who had been confined there amid sweltering heat, bug infestations and meager meals, prompting members of Congress and state representatives that witnessed the conditions to demand its immediate closure.
You will not be surprised to learn that this Lowly District Court Judge once again completely ignored recent Supreme Court precedent to get the outcome xhe wanted.
The stay comes about a week after Florida Division of Emergency Management Executive Director Kevin Guthrie said "we are probably going to be down to 0 individuals within a few days" in an email exchange shared with CNN. Guthrie sent the message to South Florida Rabbi Mario Rojzman in response to his request to provide chaplaincy services at the facility. Despite the controversy surrounding the facility, Florida Gov. Ron DeSantis is doubling down on immigrant detention centers in his state -- including the announcement of two new immigration detention facilities he dubbed "Deportation Depot" in northeast Florida and "Panhandle Pokey" in the Florida Panhandle.
NEPA, the Supreme Court ruled, imposes no "substantive" restrictions on building, but only requires a process of preparing Environmental Impact Statements (EISs). Those statements do not have to be the basis of a decision to build or not build -- they only need to be prepared, provided to decisionmakers. They create no obligation of political decisionmakers to kill projects due to a negative EIS. But the lowly district court judge completely ignored this and blew it off with a "see also" instead of taking it as absolutely controlling the outcome of this case, which it does.
Before considering these factors, however, we find it necessary to discuss the nature of the Plaintiffs' claim on appeal here. The Plaintiffs sought and obtained injunctive relief based on an al-leged violation of NEPA. In Seven County Infrastructure Coalition v. Eagle County, 605 U.S. ___, 145 S. Ct. 1497 (2025), the Supreme Court recently addressed what NEPA does--and does not--require, as well as the role of the federal judiciary when considering a claim asserting a violation of that statute. Inexplicably, other than a passing citation using a "see also" signal on page 46, the district court's order does not mention the Supreme Court's most recent decision about the statute lying at the heart of this case.
But the lowly left-wing communist judge ignored this and took the EIS as proof that Alligator Alcatraz must be shut down.
As the Supreme Court stated:Simply stated, NEPA is a procedural cross-check not a substantive roadblock. The goal of the law is to inform agency decisionmaking, not to paralyze it. Id. Most lower court judges and even a fair number of higher court ones have mediocre legal minds stultified by use of clerks to do their work for them. So they spend their time kibitzing playing an authority figure on the bench and playing political games with their local legal community posse. And having their ass kissed and stroked by attorneys, etc. under their power. Mini potentates with the temperament of Captain Bligh and the tender mercies of a Communist judge (usually ex-PLA) in China.
A few outstanding jurists and legal minds swallowed in a sea of malicious bureaucratic time keepers and wannabe activists on the bench.
We should go back to the practice of having trial courts being conducted with a panel of three judges. One is always likely to squeal if injustice occurs

The actual, proscribed method of punishment actually goes through the Chief Judges of the circuits.

I think it goes beyond that. Formerly, judges deciding laws were unconstitutional had to meet in three judge panels and those were directly appealed to Scotus (not through circuit courts). They still do that for a narrow group of cases involving election matters. But that means A) Scotus rulings on a direct appeal are binding immediately on the lower court--no wiggle room hoping that the press of cert petitions means that they can slide by, and B) widespread evidence indicates that judges have to pull their prejudices in somewhat when they have to persuade colleagues to go along with patently bad decisions or they risk a dissenting vote which flags the bad decision for higher court review.
District court judges, in the original conception, were more like magistrate judges are today. They dealt with petty cases. Important cases then had usually a circuit judge plus a district judge (Iater two). With the courts of appeals coming into existence, then circuit judges no longer heard trial cases.

The reason that NC is a battleground state is because of this exact phenomenon, which has been occurring for decades. Back when I lived in NC we even had a name for these assholes: Halfbacks. There weren't even 3M people in the country at the time. Plus, it was assumed that 99% of disputes would be resolved in state courts. The idea that we would need almost 1500 federal Art3 judges -- and an army of magistrates, agency judges, etc -- to handle federal cases would have been alien to the Fathers.

Reading Article III, it really feels like Madison et al were imagining a Supreme Court that was primarily concerned with smoothing over relationships between the states themselves, not policing the federal government itself.

The captors are allowed to punish attempted escapees, but only by solitary confinement and bread-and-water diet.

He said he was a teacher, not a soldier. So he drove his tank to the front lines and surrendered to the first American he could find.

Chevron was about the executive making up regulations and courts automatically siding with the executive on all interpretations. Loper, the opinion that overturned Chevron, said that all new regulations are open to judicial review.

Apparently a pair of German POW's with the aid of smuggled map, escaped their camp, and walked many miles to the Gila River in Arizona, where they planned to build a raft, and float downstream to Mexico. They didn't know the Gila River is dry most of the year. They walked back to camp, and asked to be let in.

My father was an MP guarding POWs in Germany. They would be turned out into the fields in the morning, where they would disappear in the cornfields. End of the day, they would all be present and accounted for...except that one time.
One evening the count was off by one. Dad called over the ranking POW and explained the situation. The ranking German hurriedly took his own roll call. As he did so, "Fritz" the missing POW came running in from the fields, beginning to explain his tardiness. He was immediately dogpiled by his fellow POWs who proceeded to beat the crap out of him until the guards finally managed to pull them off...

Nope, the Juris needs to stand the fuck up and forward the names of judges who willfully defy their standards in violation of THE FUCKING LAW, by definition, the FUCKING LAW, and suggest them for impeachment.
Simple fact, These pissant judges are expected, and in fact REQUIRED to understand the related judgments that apply, and to defy it intentionally, and it is intentional, is not a misunderstanding it is malfeasance, which is a crime.
