I have a guess: Boomer National Review-style fake conservatives always interpose a dreamy ideal of what America should be like to distract from what America actually is. They want it to be the case that jurors in all jurisdictions deliver fair verdicts untainted by bias, and therefore they insist that that is the case, and we'll just have to "work harder" if we want justice. I'm sick to death of these people. They're not idealistic, they're simply cravenly denying reality. Moral maturity means accepting the world as it is, not in insisting the world is different than it is and basing policy on that child-like dream of a false world. The National Review types think they're being virtuous by insisting, along with Candide, that we live in the best of all possible worlds. That's not virtue, that's being obtuse. They claim this makes them "happy warriors." It doesn't. It makes them saps and saboteurs in league with the left. The left is waging war on us and the National Review types just tip their fedoras and say, "Huh-hoh! Good sport, jolly good sport indeed!"

Elric said earlier that DOJ over-charged here, and didn't include back-up/lesser charges more likely to be favorably considered. On the surface, that's certainly plausible (though I have no direct experience in grand jury strategery).
Of course that's sort of an academic consideration if DC is bad as it probably is. That is, just a mob, not citizens in any meaningful or positive sense. They absurdly and joyfully convicted Scooter Libby, despite the evidence. They acquitted that idiot lawyer in the case the preposterous Durham brought, despite the evidence. Of course Clinesmith apparently calculated there was actually some risk in going to trial over FISA fraud, vs. pleading, getting a slap on the wrist, and a vast boost in his social standing and likely professional prospects from the degraded slop that is the Beltway legal profession. Jury system is the best protection against an abusive state. But it's a disaster in the context of a degraded populace and civic culture collapse. But cases do exist where relatively minimal misbehavior can get harshly punished--one of the worst things one can do is act out in court. Civil contempt of court allows a judge to keep you in jail for up to one year in many jurisdictions and your appeal of such will be heard by other black robes--not a jury. Too many people think they have to throw down right then with law enforcement or judges when discretion is the better part of valor. Occasionally though, a stupid action can result in death or serious injuries from the initial assault like a person slipping and falling in a bar fight then falling into a coma or dying. I was a cop in DC for 28 years. Before I started, some do-gooder changed the law in DC for Assaulting a Police Officer (APO) (DC Code § 22–405) from a misdemeanor for simple assaults and a felony for felony assaults, to a felony in all situations, including passive resistance. It was a bold, but stupid move to be "tough on crime" and "back the blue." What it created in reality was a situation where, unless the elements of the actual offense constituted a felony, no charge could be filed against the person who punched, obstructed, or fled from an officer, unless they had actually injured the Officer. It created a free-for-all for Officers being assaulted in DC. And like magic, very few people are charged with APO in DC (see J6), because it is a worthless charge. I had a good career and was never seriously assaulted (not for lack of effort by some fine citizens), but never once wasted my time charging anyone with APO.
