Of Course: Lawless Partisan DC Jury Refuses to Indict Left-Wing Hysteric Who Threw a Sandwich at ICE Officers

We need to permit defendants, and prosecutors, to remove their cases to neutral jurisdictions if they can show that the jurisdiction they're in is politically biased.

Federal prosecutors on Tuesday were unable to persuade a grand jury to approve a felony indictment against a man who threw a sandwich at a federal agent on the streets of Washington this month, according to two people familiar with the matter.
The grand jury's rejection of the felony charge was a remarkable failure by the U.S. attorney's office in Washington and the second time in recent days that a majority of grand jurors refused to vote to indict a person accused of felony assault on a federal agent. It also amounted to a sharp rebuke by a panel of ordinary citizens against the prosecutors assigned to bring charges against people arrested after President Trump's deployment of National Guard troops and federal agents to fight crime and patrol the city's streets.

It remained unclear if prosecutors planned to try again to obtain an indictment against Mr. Dunn, 37, a former Justice Department paralegal. They could also forgo seeking felony charges and refile his case as a misdemeanor, which does not require an indictment to move forward.

Before he threw the sandwich, the complaint asserts, Mr. Dunn stood within inches of the officer, calling him and his colleagues "fascists" and shouting, "I don't want you in my city!"

Conservatives cannot endure being convicted by rabid leftists over nothing while guilty-as-sin leftists are set free.

I have no idea why people don't take this issue seriously.

I have a guess: Boomer National Review-style fake conservatives always interpose a dreamy ideal of what America should be like to distract from what America actually is. They want it to be the case that jurors in all jurisdictions deliver fair verdicts untainted by bias, and therefore they insist that that is the case, and we'll just have to "work harder" if we want justice.

I'm sick to death of these people. They're not idealistic, they're simply cravenly denying reality.

Moral maturity means accepting the world as it is, not in insisting the world is different than it is and basing policy on that child-like dream of a false world. The National Review types think they're being virtuous by insisting, along with Candide, that we live in the best of all possible worlds.

That's not virtue, that's being obtuse.

They claim this makes them "happy warriors." It doesn't. It makes them saps and saboteurs in league with the left.

The left is waging war on us and the National Review types just tip their fedoras and say, "Huh-hoh! Good sport, jolly good sport indeed!"

Seriously curious how many no bills came down during J6 investigation. My guess is zero.

Of course that's sort of an academic consideration if DC is bad as it probably is. That is, just a mob, not citizens in any meaningful or positive sense. They absurdly and joyfully convicted Scooter Libby, despite the evidence. They acquitted that idiot lawyer in the case the preposterous Durham brought, despite the evidence. Of course Clinesmith apparently calculated there was actually some risk in going to trial over FISA fraud, vs. pleading, getting a slap on the wrist, and a vast boost in his social standing and likely professional prospects from the degraded slop that is the Beltway legal profession.

Jury system is the best protection against an abusive state. But it's a disaster in the context of a degraded populace and civic culture collapse.

Often what happens is collateral consequences-loss of job, loss of income, and so on. But cases do exist where relatively minimal misbehavior can get harshly punished--one of the worst things one can do is act out in court.

Civil contempt of court allows a judge to keep you in jail for up to one year in many jurisdictions and your appeal of such will be heard by other black robes--not a jury.

Too many people think they have to throw down right then with law enforcement or judges when discretion is the better part of valor.

Occasionally though, a stupid action can result in death or serious injuries from the initial assault like a person slipping and falling in a bar fight then falling into a coma or dying. Suddenly a minor charge gets escalated up to and including murder.

DC doesn't play with their officers. It's a slam dunk Assault on an Officer misdemeanor with up to 6 months in jail. That charge is designed with almost no defenses allowed on purpose b/c the DC folks never wanted their security details to have to worry about randos tossing sandwiches.

Now, it has been long held that we need more circuits, that 11 is just not enough, that especially the 9th needs to be split up because it's too big.

With that idea of reform of the circuit court system already in place, it's possible to piggyback on that and maybe get something done about it, all the issues rolled up into one. One big Judicial Reform Act that even includes penalties for district court judges, even.

Passing that through Congress would not be easy, but probably easier that a new effort solely focused on eliminating the DC Circuit and folding it into Maryland, or something.

Throwing something has never been 1st Amendment protected even as symbolic speech but my point is that you argue unlawful arrest in court--not on the street because you will lose every time and likely rack up ancillary charges to boot. Same if you insult cops and call for your friends to action etc. You will find that the punishment is the process and public protests are not shields from arrest for what the police consider illegal.

FWIW, losing one's temper is public is shortsighted and stupid which is not coincidentally related to people being in jail for just that reason. Best to save that particular misbehavior for the home.

Special elections are about the tippy top of motivated voters (that's currently majority Democrats because of demographics and partisan alignment) and local organization, organization that needs to be in place months, if not years ahead of time.

They produce turnout usually around 16% or less.

The next midterm election when these state senate seats are up, turnout will be 60% or more. 99% chance it'll be back in Republican hands then because the turnout just creates different electorates.

Should the Republican machine get better at moving its voters in these elections? Yes. Is it reflective of what could or could not happen next November?

Campaign organization can also make about 5 percent voter differential between a disorganized and organized campaign.

Before I started, some do-gooder changed the law in DC for Assaulting a Police Officer (APO) (DC Code § 22–405) from a misdemeanor for simple assaults and a felony for felony assaults, to a felony in all situations, including passive resistance. It was a bold, but stupid move to be "tough on crime" and "back the blue." What it created in reality was a situation where, unless the elements of the actual offense constituted a felony, no charge could be filed against the person who punched, obstructed, or fled from an officer, unless they had actually injured the Officer. It created a free-for-all for Officers being assaulted in DC. And like magic, very few people are charged with APO in DC (see J6), because it is a worthless charge. I had a good career and was never seriously assaulted (not for lack of effort by some fine citizens), but never once wasted my time charging anyone with APO.
