This is the civil action brought by obese beefy lesbian "Tish" James claiming that Trump overestimated the value of his properties for the purpose of calculating collateral for loans, an estimate that his counterparties, the banks, said they did not rely upon -- they do their own estimations -- and which cost them nothing, as all of the loans were repaid.(I have no evidence for this except for the obvious: she looks like an obese beefy lesbian and has never married. On the other hand, she has had sex with a man at least one time. That encounter resulted in a baby, which she aborted -- proudly. James lives in the Clinton Hill neighborhood of Brooklyn and is a member of Emmanuel Baptist Church. She has never married. At a May 2022 rally, James stated that she supported abortion rights, and had received an abortion early in her tenure as a member of the New York City Council. James said, "I was just elected and I was faced with the decision of whether to have an abortion or not, and I chose to have an abortion. I walked proudly into Planned Parenthood, and I make no apologies to anyone.") This is also the case in which Engoron started the "trial" by declaring that, in his one-man partisan opinion, Trump was guilty of fraud and that all that remained was to calculate the size of the penalty he'd have to pay. This judgement does not erase the judgment against Trump. The Appeals Court left that to New York's highest court, confusingly called the New York Court of Appeals. Trump will almost certainly appeal the judgment itself, and also the one part of Engoron's penalty that the Appeals Court left standing, a court-ordered monitor to observe how Trump runs his businesses. But this is a big deal. It's a big deal when an over half-billion dollar penalty is completely erased. And while Trump did not pay that, he was forced to pay for a bond to cover the penalty, I think in the amount of around $150 million. Every month he had to pay huge upkeep (insurance payments) for that bond. He doesn't have to pay that any longer. Ed Morrissey, quoting from the New York Times, which is, of course, emphasizing that Trump is still officially liable for fraud. For the moment. Morrissey, on the other hand, emphasizes that Trump will appeal to the highest court and that the appellate court took the coward's way out by punting on the real question here. An appeals court has thrown out the massive civil fraud penalty against President Donald Trump, ruling Thursday in New York state's lawsuit accusing him of exaggerating his wealth. ... "While the injunctive relief ordered by the court is well crafted to curb defendants' business culture, the court's disgorgement order, which directs that defendants pay nearly half a billion dollars to the State of New York, is an excessive fine that violates the Eighth Amendment of the United States Constitution," Judges Dianne T. Renwick and Peter H. Moulton wrote in one of several opinions shaping the appeals court's ruling. Engoron also imposed other punishments, such as banning Trump and his two eldest sons from serving in corporate leadership for a few years. Those provisions have been on pause during Trump's appeal, and he was able to hold off collection of the money by posting a $175 million bond.Elric the Blade says that it's not just that Trump can appeal, but that the appellate court gave him the right to an automatic appeal: I can't seem to find the actual opinion, but it's apparently over 300 pages (!) so I ain't reading that no matter what. From what I can tell from the reporting, though, Trump has a guaranteed appeal to the Court of Appeal (NY's highest court) on the fraud convictions because at least two judges dissented on that point. This is a big deal. Without a guaranteed appeal (called an "appeal as of right"), you have to ask the Court of Appeals to hear the appeal. It's a very big uphill climb on that. There's a greek restaurant by me that has a neat sculpture-y wall hanging art thing of Medusa, but it's "hot Medusa", a really really attractive, and kind of sad, looking face but with snake hair. Much closer to the actual myth. Medusa was supposed to be stunningly beautiful, and was cursed with snake hair, and making every guy who looked at her hard in the bad way, because Aphrodite was jealous of her or something like that. I don't know, I found it striking and interesting, at least.

In my area the local governments have loved the constantly increasing housing costs. It lets them tax you more without having to ram through a formal tax increase. From what I've read, the "operative" holding of the opinion (as there were multiple, over-lapping opinions) was that the verdict was an excessive fine under the 8th.

Not sure if people serious or snarking in comments. Sorry if snark. How these bonds work is similar to insurance - with one huge difference. Insurance typically doesn't go back to the policy holder and demand payment of full claim, whereas the bonding company would. Trump, in this case goes through underwriting with a bonding company - usual stuff.. ability to repay being the most important. They agree to cover the total amount if the final award goes against Trump. Trump pays a fee for this "insurance," thereby not having to put up as much money. However, if Trump was found to owe it all, the bonding company would have paid it - AND Trump would be responsible to pay the bonding company.

I think people are underestimating what the court said.
The five judges - 5/5 said the penalty was absurd. 2/5 said the trial was prejudicial (botched by the judge and prosecutor) and to get any verdict would require a retrial, and 1/5 said the trial was illegal and charges should be dismissed. So, there was no decision on the verdict, but when 3/5 judges say there was a miscarriage of justice, chance is good this gets tossed at the Supreme court level. Normally, in such a case, the prosecutors would decline to appeal any further - it's pointless - you are going to lose. Drop the charges and run. But, being Democrats, they'll no doubt keep going and receive further humiliation. I expect the next appeal will mercifully end the whole facade. I was supposed to have an endoscopy and my second colonoscopy yesterday, the endoscopy for the frequent vomiting bouts I've had lately. Started drinking the colonoscopy prep stuff at 5:00, and, lo and behold, ended throwing it all up. So I stopped drinking it, and just had the endoscopy instead the next day. After all, there's no reason worrying about the colon if stuff can't even make it past the stomach. Turns out if got an enflamed esophagus and some kind of polyp in my stomach. So those are the two issues I'm addressing right now. In the meantime, I eat and drink in small portions, and chew my food very well, and there doesn't seem to be a problem. Track your calories and weight for three weeks to figure out your BMR. Then maintain a 500-1000 calorie deficit with reasonably clean, good food that keeps you satiated. Fats are good for satiety. 433 For too many years I have suffered sleep deprivation. Finally told myself that a timed routine is not so valuable and went on a Navy watch schedule. I sleep three or four hours in the afternoon, and then hit the sack for another three or four about midnight. I feel ok doing it this way and it keeps bodily stuff on schedule(dump in the morning, etc.).
