NY Appeals Court Tosses the $547 Million Penalty Imposed on Trump by Rogue Judge Engoron, Calling the Penalty a Violation of the Cruel and Unusual Punishments Clause

This is not the "34 felony conviction" that Manhattan Soros Bot Alvin Bragg cooked up against Trump, so we can't -- yet -- say that Trump is officially not a felon.

This is the civil action brought by obese beefy lesbian "Tish" James claiming that Trump overestimated the value of his properties for the purpose of calculating collateral for loans, an estimate that his counterparties, the banks, said they did not rely upon -- they do their own estimations -- and which cost them nothing, as all of the loans were repaid.

(I have no evidence for this except for the obvious: she looks like an obese beefy lesbian and has never married.

On the other hand, she has had sex with a man at least one time.

That encounter resulted in a baby, which she aborted -- proudly.

James lives in the Clinton Hill neighborhood of Brooklyn and is a member of Emmanuel Baptist Church. She has never married.
At a May 2022 rally, James stated that she supported abortion rights, and had received an abortion early in her tenure as a member of the New York City Council. James said, "I was just elected and I was faced with the decision of whether to have an abortion or not, and I chose to have an abortion. I walked proudly into Planned Parenthood, and I make no apologies to anyone."

This is also the case in which Engoron started the "trial" by declaring that, in his one-man partisan opinion, Trump was guilty of fraud and that all that remained was to calculate the size of the penalty he'd have to pay.

This judgement does not erase the judgment against Trump. The Appeals Court left that to New York's highest court, confusingly called the New York Court of Appeals. Trump will almost certainly appeal the judgment itself, and also the one part of Engoron's penalty that the Appeals Court left standing, a court-ordered monitor to observe how Trump runs his businesses.

But this is a big deal. It's a big deal when an over half-billion dollar penalty is completely erased. And while Trump did not pay that, he was forced to pay for a bond to cover the penalty, I think in the amount of around $150 million. Every month he had to pay huge upkeep (insurance payments) for that bond.

He doesn't have to pay that any longer.

Ed Morrissey, quoting from the New York Times, which is, of course, emphasizing that Trump is still officially liable for fraud.

For the moment. Morrissey, on the other hand, emphasizes that Trump will appeal to the highest court and that the appellate court took the coward's way out by punting on the real question here.

An appeals court has thrown out the massive civil fraud penalty against President Donald Trump, ruling Thursday in New York state's lawsuit accusing him of exaggerating his wealth. ...
"While the injunctive relief ordered by the court is well crafted to curb defendants' business culture, the court's disgorgement order, which directs that defendants pay nearly half a billion dollars to the State of New York, is an excessive fine that violates the Eighth Amendment of the United States Constitution," Judges Dianne T. Renwick and Peter H. Moulton wrote in one of several opinions shaping the appeals court's ruling.
Engoron also imposed other punishments, such as banning Trump and his two eldest sons from serving in corporate leadership for a few years. Those provisions have been on pause during Trump's appeal, and he was able to hold off collection of the money by posting a $175 million bond.

Elric the Blade says that it's not just that Trump can appeal, but that the appellate court gave him the right to an automatic appeal:

I can't seem to find the actual opinion, but it's apparently over 300 pages (!) so I ain't reading that no matter what.
From what I can tell from the reporting, though, Trump has a guaranteed appeal to the Court of Appeal (NY's highest court) on the fraud convictions because at least two judges dissented on that point.
This is a big deal. Without a guaranteed appeal (called an "appeal as of right"), you have to ask the Court of Appeals to hear the appeal. It's a very big uphill climb on that.

Below, liberal libertarian Andrew Napolitano discusses the possibility of Trump winning a civil-rights lawsuit against the state of New York and the obese beefy lesbian and former All-Star Buffalo Bills center "Tish" James.

I have no evidence that she was a former All-Star Buffalo Bills starting center, apart from the fact that she weighs three bills and looks like she can deliver a heckuva forearm shiver.

He says that the obese beefy lesbian and her Blue Ribbon Winning Heifer election promises to prosecute Trump for an offense to be determined later aren't enough, in themselves, to prove a civil rights violation, as the law requires an abuse of an office that someone has already won. That is, her pre-election promises to violate Trump's civil rights were made as a civilian, not a political official, and aren't proof of her crimes in themselves.

However, he says that those statements will be evidence of intent to violate Trump's civil rights, and if any emails are discovered in which the obese beefy lesbian talks about getting Trump for political reasons while in office -- which he thinks will probably be discovered -- then she can be found liable. (Unfortunately this would be a civil suit, not a criminal one.)

If she or any of her staffers mention pleasing her voting base in an email discussing the Trump frame-up, that's evidence of a conspiracy to deprive Trump of his civil rights.

He points out that Nifong in the Duke Fake Rape Case was sued successfully for a deliberate violation of a defendant's civil rights for political reasons.

In my area the local governments have loved the constantly increasing housing costs. It lets them tax you more without having to ram through a formal tax increase.

The five judges - 5/5 said the penalty was absurd. 2/5 said the trial was prejudicial (botched by the judge and prosecutor) and to get any verdict would require a retrial, and 1/5 said the trial was illegal and charges should be dismissed. So, there was no decision on the verdict, but when 3/5 judges say there was a miscarriage of justice, chance is good this gets tossed at the Supreme court level.

Normally, in such a case, the prosecutors would decline to appeal any further - it's pointless - you are going to lose. Drop the charges and run. But, being Democrats, they'll no doubt keep going and receive further humiliation.

I expect the next appeal will mercifully end the whole facade. I'd also warn democrats - what you do to Trump, can and will be done to you. We won't live with two tiers of justice.

I had the appraiser actually YELLING at me because I asked him point blank what he used to generate the new appraisal on my house. He said the comparables in the neighborhood, to which I responded with an actual real-estate agent report on those and THEN pointed out that the houses that sold in the last 2 years in my neighborhood that were *directly* (I do mean that, same basic homes) comparable to mine sold for FAR, FAR less than he was claiming.

Was entertaining to have this guy telling me he doesn't use zillow's numbers when all the appraisals literally matched zillow to the penny.

All of these cases, DA's, and Judges were so bad and the charges ludicrous, but, in a lot of ways, the E. Jean Carroll case bothered me the most.

This woman is a loon who clearly copied this story from a TV show, constantly changed timelines, and the NY DA's office had to actually do some fancy footwork to massage the statue of limitations to get this to trial. After the trial, her preening before the cameras and how she was going to spend the money and go on shopping sprees to Europe even embarrassed her own lawyer which is a pretty low bar. She is an embarrassment to all women and an affront to all people who have actually been sexually abused. She needs to be rendered penniless and selling loosies in Harlem.

I was supposed to have an endoscopy and my second colonoscopy yesterday, the endoscopy for the frequent vomiting bouts I've had lately. Started drinking the colonoscopy prep stuff at 5:00, and, lo and behold, ended throwing it all up. So I stopped drinking it, and just had the endoscopy instead the next day. After all, there's no reason worrying about the colon if stuff can't even make it past the stomach.

Turns out if got an enflamed esophagus and some kind of polyp in my stomach. So those are the two issues I'm addressing right now. In the meantime, I eat and drink in small portions, and chew my food very well, and there doesn't seem to be a problem.

Assuming the doc is also having you start a food journal to pinpoint if foods could be causing the inflammation and issues. If not, I'd probably do it b/c it can help you rule in or out that food and beverages could be an issue.

I have a lot of vintage cookbooks - including my grandmother's. commercial cookbook from 1926 - and the menus for all three meals were actually. pretty intricate. Breakfast was juice, a hot grain cereal, eggs, a small portion of meat, and fruit with milk or coffee (juice was still a luxury until the late sixties, I think). Lunch was a soup, salad, rolls and fruit. Dinner was a soup or salad starters, a meat, starch and two vegetables, and dessert. The portions were smaller, but you ate more variety at each meal and were satiated. Plus, it was all cooked at home from fresh ingredients, not convenience items. When women went to work outside the home, convenience items came to the forefront, and with them preservatives, less flavor, and higher calories.

I got the pills for mine two years ago. It's a bit of a chore, as you have to take 12 horse pills twice with a bunch of water. I was told it was a much better option than the vile liquid. It was a bit uncomfortable after the 8th pill, but no throwing up at least.

459 433 For too many years I have suffered sleep deprivation. Finally told myself that a timed routine is not so valuable and went on a Navy watch schedule. I sleep three or four hours in the afternoon, and then hit the sack for another three or four about midnight. I feel ok doing it this way and it keeps bodily stuff on schedule(dump in the morning, etc.).

460 Reuters clarifies today’s outcome,

The appeals court was splintered.

Two judges found Trump was properly held liable, and James “vindicated a public interest” by pursuing her fraud case, but the penalty was an excessive fine that violated the U.S. Constitution.

Two other judges also found James had authority to sue, but a new trial was necessary because the trial judge should not have held Trump liable for fraud at the outset. The fifth judge said the case against Trump should have been dismissed.

How can anyone know that guy's politics. What he is, is a rabid Trump-hating dog. Also an idiot when it comes to legal issues; don't listen to a word he says, especially if it relates - at all - to President Trump.

Like a broken watch, he is correct that an appeal to NY's highest court is guaranteed by the Court's divided opinion (divided on just about every issue, except they agree 5-0 that the size of the money judgment is obscene - pretty much in proportion to James's size).

Napolitano's only excuse is that he may actually be as drunk as he looks all the time.
