EPA Administrator Lee Zeldin Moves to End Obama-Era "Finding" That Carbon Dioxide Causes "Endangerment" to Humans, Which Would Be the "Largest Regulatory Action in the History of America"

EPA Administrator Lee Zeldin said Tuesday he's issuing draft plans to overturn the agency's 2009 scientific finding that greenhouse gases threaten human health and welfare -- a move guaranteed to spark litigation.

Weird how Obama impose this rule on bureaucratic authority alone and yet bureaucratic authority isn't enough to un-impose it.


Why it matters: It's President Trump's most direct effort to rip out climate regulations root and branch -- and make it harder for a successor to impose new ones.

The "endangerment finding" provides a key legal underpinning for regulating heat-trapping gases from cars, power plants and more under the Clean Air Act.

Driving the news: "This is been referred to as basically driving a dagger into the heart of the climate change religion," Zeldin said on Ruthless, the popular conservative podcast where he announced the plan.

Catch up quick: EPA issued the finding in response to a landmark 2007 Supreme Court decision, Massachusetts v. EPA, which held that greenhouse gases are pollutants under the Clean Air Act.

The ruling led then-President Obama in 2009 to issue an order allowing EPA to establish emissions standards for sources shown to reasonably affect health and welfare.

Zeldin has said the decision stipulated that EPA was authorized -- but not obligated -- to regulate greenhouse gases.

The big picture: Researchers and environmentalists have warned ahead of the proposal that it conflicts with the scientific consensus on the unfolding harms from climate change.

"It is callous, dangerous and a breach of our government's responsibility to protect the American people from this devastating pollution," the Environmental Defense Fund said ahead of the long-expected plan.
And Dan Becker of the Center for Biological Diversity said in a statement Tuesday: "By revoking this key scientific finding Trump is putting fealty to Big Oil over sound science and people's health."

State of play: Zeldin argued that he's in favor of less pollution, and cast emissions rules as a distraction, saying "this is an economic issue."

"We want clean air, land and water. Conservatives love the environment, want to be good stewards of the environment," he said.
But he alleged there are people who want to "bankrupt the country" in the name of battling climate change.

Friction point: Zeldin said the agency welcomes a battle over what he called faulty conclusions about climate harms. The EPA administrator would make the final determination after a public comment period.

"We're going to go out to public comment. We're not afraid of allowing the public to weigh in," Zeldin said.

What we're watching: Certain legal battles if and when EPA finalizes the draft proposal after the comment period.

Opponents of EPA's greenhouse gas regulations "might be able to fast-track their elimination by bringing lawsuits alleging that -- without an underlying endangerment finding -- the rules are arbitrary and capricious," ClearView Energy Partners said
earlier this year.

Zeldin says the rollback of this "finding" could save Americans $1 trillion in unnecessary "green" redtape.

Zeldin joined the "Ruthless" podcast to break the news that the EPA would nix the declaration that insisted greenhouse gases like carbon monoxide and methane endanger human lives. Zeldin will officially make the announcement that will drive "a dagger into the heart of the climate change religion" later in the day in Indiana.

"A lot of people are out there listening, they might not know what the endangerment finding is. If you ask congressional Democrats to describe what it is, the left would say that it means that carbon dioxide is a pollutant, carbon dioxide is an endangerment to human health. They might say methane is a pollutant, methane is an endangerment to human health," Zeldin said.

"That's an oversimplified, I would say inaccurate way to describe it," Zeldin continued. They don't say... they say that climate change engenders human health, so because of these different mental leaps... then there were all sorts of vehicle regulations that followed."

"Ruthless" co-host Josh Holmes noted that endangerment finding is "the hub to the spoke of the left's environmental agenda, essentially," to which Zeldin agreed.

"This has been referred to as basically driving a dagger into the heart of the climate change religion," Zeldin said.

"Most Americans, we care about the environment, we want clean air, land and water. Conservatives love the environment, want to be good stewards of the environment. There are people who then, in the name of climate change, are willing to bankrupt the country," he continued. "In the name of environmental justice, they will get tens of billions of dollars appropriated to their friends rather than actually remediating environmental issues."

One regulation that will be affected is the mandatory "idle stop" of a car's engine at red lights.

Did not remove them but set the penalty for car companies violating them to $0 dollars. Same as they did for Suppressors and SBRs. Reconciliation bills have to deal with taxes (fees are taxes and so are penalties) and mandatory spending to stay germane. Heard but have not checked that BBB also set the Obamacare penalty for not having health insurance to zero.

And money to enforce companies not just dumping waste into waterways.

We don't have to take an anti-environment position. We need to take a "Make America Clean Again" approach. Turn the issue on its head, and it becomes much, much cheaper and a winner for Republicans.

Nah, I'm sure there is a law out there passed by a Democratic Congress that covers it.

A classic Democratic Congressional bill goes something like this:

IRRC, Nixon set up the EPA via executive order to administer the original Clean Air Act and later the Clean Water Act. I was diesel mechanicing when they were phasing in the off road engines.
The return on investment between "tier 2" and "tier 4f" was rediculous. At tier 2 they had cleaned up the exhaust by 95%.
Still present was CO2 and NOx. Then add a $50,000 muffler set up to turn those gasses into water and oxygen to get the final 5% of nothing. The system sucks. Has to use fuel in the exhaust as there isn't enough fuel left after combustion to make the process work. So about an 1/8 of fuel is consumed not moving the vehicle but "cleaning" the exhaust. Has to run hot or it plugs up and shuts down. 40,000 psi fuel systems, enough pressure to cut off a hand in a spray release.
How about a refund on the R&D needed to comply with these stupid mandates?

My older vehicles, I just fill them with R-12A, which is the propane/isobutane blend available cheaply here at ag and auto stores. Cools just fine. Yeah, it can burn. So can the 40 gallons of gas in the tank.

The 2008 'Burb, I top off with R-134 every season, and it keeps chilling away. If I ever have to do a major repair to the A/C, it will go R-12A, too.

I wish. When the city was replacing all the phone poles on my street, I told them that they could just leave them on my property rather than having to haul them off.

Which they did, but at the bottom of my lot down by the creek. They part I am having the dirt moved is at the top of the lot and I have to drag the ples out of the woods, into my pickup, drive that to the top and dump them out. Each section is just barely light enough for levering into the truck bed, less than 300lbs anyway.

Most people don't know this, but the problem of dirty emissions is mostly a problem of the first few minutes of starting the car from cold. That's when the emissions filters and cat converters are cold and basically nonfunctional. There are ways around this, but they are very expensive. That's how insanely powerful near-race motors in super- and hypercars can somehow pass emissions.

Their mom was constantly bitching about the cost, while simultaneously expressing frustration that the daycare teachers weren't required to have Masters degrees in education, et al.

No matter how often I pointed out that requiring credentials would only skyrocket the already high price, she never connected cause and effect.

A fermented snake wine is popular in SE Asian countries, especially Vietnam. It's a taste that's .. acquired. I found it too harsh and musky, but overall worth a drink for something very unusual. My mom tool the tiniest of sips and yaked it right out. Comes in a very cool jar though, with a real cobra inside. I bought a few to take home. Still have one sitting on my mantle.

And when I was old enough to go to kindergarten I became a key latch kid. Yes I walked to and from kindergarten by myself and the neighbor couple friends kept an eye on me until my mom got home. Which, in the event you did not know, if you decide to lose the tusk hole you are out of luck in thinking it will close naturally.

To close the ear hole someday you will need plastic surgery. I know this because I observed a loser at a horrid dinner with a niece. Her BIL, a loser to begin with that I won't get into in this diatribe, removed his tusks and pierced a large cheap zirconia above each hole. I guess to "disguise" it. The earlobes then curled up like flabby clams. My eyes were drawn to this.
