Its actually insane that a bunch of district court judges think they can just declare who the US Attorney is.
AT BEST, that would require every one of those judges to recuse themselves from any case involving their selection. But who are we kidding. They'd never do that. But honestly, did they think Trump was just going to meekly let them do it? Posted by: DudeAbiding at July 24, 2025 03:14 PM (setIA) Posted by: EFG at July 24, 2025 03:16 PM (Wp7J3) 3

"When a U.S. Attorney position becomes vacant, the Attorney General can appoint an interim replacement for up to 120 days. If no permanent appointment is made within that period, the district court may designate a U.S. Attorney to serve until the President fills the position through the standard nomination and confirmation process. While rarely exercised, this judicial appointment power prevents prolonged vacancies."
Apparently, Habb was sworn in March 28 - the 120 day would be July 26, per my Google. Apparently, NJ judges can't do Math or ask Google and f'ed everything up, so they couldn't pull their move even if they wanted to, and now they outed themselves as uber-partisan. "Under federal law, district court judges may appoint a U.S. attorney to serve until the Senate confirms a nominee. In Mr. Trump’s first term, judges in both the Southern and Eastern Districts of New York appointed his picks for interim U.S. attorneys as permanent officeholders. Though it is rare for courts to appoint U.S. attorneys, it is even rarer for them to decline to appoint an official who is already serving on an interim basis, said Carl W. Tobias, a professor at the University of Richmond School of Law." Posted by: Nova Local at July 24, 2025 03:36 PM (tOcjL) 78
He needs to go through his contacts and give every lawyer he knows a job as an interim U.S. Attorney.
Just keep rotating through them every 120 days until the Senate gets its act together. ---- Or... do that with the understanding that he will not be seeking *any* nominations. The Attorneys will just rotate through different districts and keep the ball moving on their predecessors' massive fucking piles of politically motivated cases against prominent Democrat politicians, officials, donors and journalists. The senate could avoid these problems by confirming Trump's nominees more quickly. So ai don't see how this isn't the GOP majority's fault ultimately.

As I noted earlier, the best part is the attorney the judges chose to represent the government has said she will defy Bondi--her boss--and take the position.
But, all this is going to do, and I don't think the left has thought this through, all these refusals by the Senate to take up the pending nominations, all it's going to do is result in a SCOTUS ruling that the 120 day limit on interim appointments is unconstitutional. And it is--there's nothing in the Constitution that allows the Legislative to set the term for any Executive officer. It's "advise and consent" but not "forcibly hold vacant." SCOTUS is going to say, "until the Senate acts--confirm or reject--the Executive is entitled to appoint an interim office holder." For Example - my wife, back in the day, was hit by a Canadian that then crossed the median and killed two other Canadians (Pacific Northwest). So guess who served the Civil Court papers ? Two Indiana State Troopers. Because Canadians, at least then, were all under one insurance company - and they were not going to sue themselves. And who dutifully served the papers, and followed up at every point along the way ? Including making sure the Missus understood she had to attend all depositions and summons ? American Law Enforcement. Because of some treaty or such ? No. Just because all it takes is Johnny Law in Country A calling Johnny Law in Country B. Its what they do. But sure, they're gonna be like, "however, unreasonable restrictions by the Legislative--either via statute or inaction--on who the Executive can appoint are totally Constitutional." The only restrictions on who the Executive can appoint are 1) approval of officers by the Senate. and 2) that's it. 120 days interim isn't in there. Entirely off topic but the movie Waterloo from 1970 is available on YouTube. Some people call it the best war movie ever--I have no opinion at all. I may watch it.
Posted by: Still lurking up north, read some, don't comment much at July 24, 2025 04:14 PM (kTd/k) It has to top the Highlander special show, where the guy was at Waterloo and it was snowing. In June, in Belgium. Posted by: Oldcat at July 24, 2025 04:18 PM (8avO+) 239
NY Post is reporting that Ron Klain was very cooperative with the House investigation into the level of Biden's drool. Interesting

It does not help that Owens refused a dialog with Macron's representatives, to set the record straight. That means she intentionally tried to defame them.
Posted by: runner at July 24, 2025 04:17 PM (g47mK) Uh, no it doesn't. It means she doesn't want a chat with some French Thugs. Posted by: Oldcat at July 24, 2025 04:20 PM (8avO+) 243
Now, did Blondi actually FIRE her, meaning she is now collecting unemployment insurance and looking for a new job?
-- Hopefully fired fired. Deactivated her PIV card, deactivated her email and updated her SF-50 "end date." The fact that she even agreed to take the job--without checking with any one above her 1st--is absolute proof she is a disloyal snake. Pretty sure it's been mentioned...(I was away and haven't read the comments yet) but can't the Senate recess and allow a bunch of the appointees to be placed on an interim basis? Why hasn't that been done?
---- McConnell would use some rule to claim that the Senate was "technically" not in recess so that Trump couldn't make any recess appointments, IIRC. Thune seems to be doing the same thing. Posted by: Bunter Hiden at July 24, 2025 04:22 PM (yQoVG) 245
They've done stuff before. I recall them forcing an airliner to land and grab somebody overflying the country that they wanted.

Later, he landed his jet in ultra-gay Pair-ee for whatever reason. Our State Department ordered their viceroy Macron to apprehend him at the airport and jail him. I think they eventually released him tho. Posted by: Yudhishthira's Dice at July 24, 2025 04:23 PM (c3YMA) 246

Posted by: Bunter Hiden at July 24, 2025 04:22 PM (yQoVG) ____ They're called pro forma sessions and they use them pretty much every year to do just that. They all leave but designate one or two Senators that are local, like MD or VA or whatever, to come every three days, sit on the dais, gavel in, wait about 20 seconds, then gavel back out. Technically the Senate "convened" that day so no recess appointments can be made. Posted by: ballistic at July 24, 2025 04:28 PM (3BwY8) 254
