Sefton: sefton at cutjibnewsletter.com | Obama Massachusetts Judge Now Rules That Congress Does Not Control Congressional SpendingThis absurd judicial insurrection was launched to protect -- of course! -- Planned Parenthood. Planned Parenthood has a right to taxpayer money, this Cultural Enricher discovered. Note that this isn't an injunction against an executive order. No, this judge is declaring that a law passed by both chambers of Congress and signed by the President is invalid.John Sexton is baffled -- the Supreme Court just ruled that South Carolina can completely ban Medicaid payments to Planned Parenthood, and the Supreme Court just told lowly district court judges they could not issue nationwide injunctions. This judge just blew off the Supreme Court, twice. Matt Margolis: It's almost impossible to overstate the sheer audacity of what's just happened in Massachusetts. In a move that defies both logic and the very foundation of our constitutional order, an Obama-appointed judge has swooped in to protect Planned Parenthood from the will of the American people as expressed through their elected representatives. Judge Indira Talwani, sitting on the United States District Court for the District of Massachusetts, decided that Congress--yes, Congress--doesn't actually get to decide how taxpayer money is spent, at least not when it comes to the Left's sacred cow. Let's be clear: This wasn't a rogue executive order or some bureaucratic sleight of hand. Congress passed a law. The people's representatives, accountable to voters, made a decision to defund Planned Parenthood as part of the One Big, Beautiful Bill. That's how our system is supposed to work. If you don't like it, you organize, you vote, you persuade your fellow citizens and change the law. That's democracy. But apparently, that's not good enough for the activist bench. Instead, Judge Talwani issued a temporary restraining order, telling the executive branch not to enforce the law. Not because the law was found unconstitutional or even legally questionable--no, the judge didn't bother to offer any real legal reasoning at all. The ruling simply halted the will of Congress in its tracks, leaving Americans and even seasoned legal professionals scratching their heads. How does a judge order the executive branch to ignore a duly-enacted statute without first declaring that statute invalid? On what grounds?Per MXMNews, Mike Lee wants to impeach this judge:

====== I'm not. These people are both retarded and dedicated. They cannot see that there will be negative consequences at all. Easy solution. The supreme court declares "U.S. District Judge Indira Talwani has shown herself incapable of understanding the law or adhering to Supreme court rulings. Hence we are invoking a nationwide injunction against Judge Indira Talwani - all future ruling from her will be considered automatically null and void till further notice."
Then what? Whatever she says or does is irrelevant - the Supreme court has ruled she is incapable of rendering any judicially sound decisions. She either resigns in disgrace or is impeached by congress. You only have to do this once to fix the problem. Posted by: El Mariachi - Attorney at Law at July 08, 2025 12:19 PM (gDhA9) 39

What is going on here is that the judge is issuing an order that stops the government from doing something (defunding planned parenthood) before the case has been heard, saying that the case is likely to succeed on its merits. Posted by: Sharon(willow's apprentice) at July 08, 2025 12:21 PM (t/2Uw) Preliminary Injunctions are supposed to be used in rare circumstances that would make sense to all of us. Basically, the judge should find that there is a likelihood of success on the merits of the underlying case, there would be "irreparable harm" without the injunction, that the "balance of hardships" tips in the favor issuing the injunction, and that the public interest is served. So if I'm suing you to stop you from strip mining your property because it'll cause my house to collapse, that's a case were a judge can say "no mining until we hear the case" because if they allow the company to move forward and the house collapses, well, it's a bit too late at that point for the court to do anything. I'm not a lawyer, so forgive the naivete. Is it not the case that this is the crux of Marbury? Note that I'm not defending Marbury, but as things stand, can't judges decide whether or not something is constitutional?
Posted by: Archimedes ------- No, district court judges have traditionally only been granted the power to decide a specific case within their jurisdiction. Thus, any TRO or injunction would only apply to Planned Parenthood facilities in that Mass jurisdiction. Back when the judicial system started, Supreme Court justices used to ride the circuit and important cases involving the constitution were heard in circuit courts where you had several judges hearing the case together. In those instances, often a Scotus justice would sit as a trial court judge (see Aaron Burr's trial) along with another judge or two. Later, this became the three judge panel where any law state or federal was determined to be constitutional and a direct appeal (not a writ of cert) meant that Scotus had to decide the case. That was finally abolished by Congress in 1976-79 period except for voting rights cases. I think the law should be revised back to older 3 judge panels again. I keep saying, these are not injunctions.
By their form, they are writs of mandamus. They are ordering the Executive to "do," not "stop." But they lie and dress up their order in all the language of an injunction. Because they can play grab-ass and all sorts of hanky-panky under an injunction that they can't under a mandamus. When the clear object of the orders is to demand the Executive act; mandate he act. But this one is even more outrageous than all those prior illegal orders: It's ordering the Executive to spend money that hasn't even been allocated--not just ordering Trump to illegally divert lawfully appropriated funds from other programs, a huge illegality, but also that Trump defy Congress to do so. Lived in a small town in New England. There was one black family. But in the years I lived there the East/South Asian population EXPLODED. At one point on the black kids got in trouble for fighting at school. Suddenly there was this enormous "anti-racism" coalition arguing he was innocent and it was all racism. The leaders of the org were bored Indian housewives as were all the people I saw actually holding signs. And they used the opportunity to argue THEY were an aggrieved minority. The end result was a bunch of town dollars for Indian culture enrichment and...the kid still got suspended (as he probably should have been). Posted by: 18-1 at July 08, 2025 12:37 PM (t0Rmr) 169

Nowadays though, writs of mandamus only apply to judges in the federal system (there might be a few archaic throwbacks but I don't remember any off hand), and mostly true in state systems. Injunctions are in fact the favored tool nowadays instead of writs of mandamus (seldom seen today but that might change as Scotus specifically mentioned its use in the Mass judge's case where he tried to thwart a specific Scotus ruling as non applicable.) The Indian men see white girls as whores to have sex with and to lie to, knowing they're going to marry an Indian woman of the right caste. Stringing these girls along, treating them like shit. The Asians and Indians I know both seem to look down on and very much dislike white people. They weaponize our racial issues b/t whites and blacks in the US for their own interests. And I have been told to my face multiple times by multiple people that Americans are fat, lazy, stupid, entitled and materialistic. And they use that mindset to influence their voting (and hiring) decisions. Which... it's one thing if *I* say some of those things, it's a completely different thing coming from an outsider. Even if they hired a lawyer and are now a US citizen. Posted by: Harry Paratestes at July 08, 2025 12:45 PM (uCjyK) 224
district court judges have traditionally only been granted the power to decide a specific case within their jurisdiction. TJM, machine collapsing around them? Don't see that happening. And even if SCOTUS belatedly begins to try to enforce some order in its own system, SCOTUS itself remains a problem. You say some "justices" are annoyed or losing patience or whatever. Well it only reinforces what a disastrous "rule of men, not law" exists. If the local party secretariat is annoyed at your kolkhoz's use of tractors on the roads, you might get slapped.
And I don't think the buffoon O'Connor or the nutcase Kennedy were products of "critical legal theory". The absurd, and disastrous, outsized power of the judiciary is the issue. Which, of course, is an outright lie. There are many other abortion providers that also receive Medicaid for other services. For example, I'd guess that pretty much every Mengele-adjacent ObGyn takes Medicaid for other services, and pretty much every medical practice is a corporation or LLP nowadays, not a sole proprietorship. My favorite part of the current rampage of judicial lawlessness and usurpation is how courts are simply jumping in and issuing orders in areas where they have no jurisdiction. With impunity, AFAIK - meaning I haven't seen a single case of this remedied by an immediate dismissal of their actions due to what has to be the most fundamental rule of any system. Very Third World.

Posted by: WitchDoktor = Not a problem. The whole judicial system of tests is what drives most court decisions (other than lefty types that ignore the law). Rational basis test--state must have a rational reason (not the best or optimal but simply rational option) and plaintiff has the burden of proof to demonstrate the government's action is irrational. Strict scrutiny, state has to have a compelling reason to circumvent Bill of Rights protections, the action/law/policy must be narrowly tailored to address the policy issue without affecting other constitutional rights, and the state has the burden of proof to show the compelling nature of the state's need to act plus that their actions are narrowly tailored to the specific compelling interest. 1st Amendment cases are classic. An edge case never made it to Scotus but dealt with a guy figuring out via open source documents how to build a fusion bomb and tried to have it published in a magazine. Federal government went to court and got prior restraint injunction on the publication. Compelling interest was keeping other nations from being able to blow us up better, and the prior restraint was for a rewrite. Posted by: whig at July 08, 2025 01:00 PM (ctrM5) 342
I think part of the kink these judges get off on is that the administration has to go through the motions in their system to implement policy. Sure, the judge(s) may know there's no hope of a win, but watching the administration stop everything they're doing to clear an injunction or TRO they've dropped gives the judges a high.

There is also the intermediate scrutiny aka heightened scrutiny which originated with gender/sex discrimination cases. Craig v. Boren was an Oklahoma law that permitted females to drink at 18 while males had to wait to 21. The state argued that males rationally behaved worse than females in cases of drunk driving, disorderly fighting, etc. by something like a 10:1 ratio so delaying males from drinking reduced this problem.
Scotus and the left on the court wanted strict scrutiny on sex discrimination cases, the 4 conservatives wanted rational basis. So Justice Brennan of the left persuaded Justice Powell (swing justice at the time also in Bakke), to swallow intermediate scrutiny for this case where the males won. Intermediate scrutiny only requires an important government objective that the stated law/policy is directly related in reaching plus state has burden to prove both elements. Messy ruling that permitted the fedgov to keep women out of combat branches and the draft without making things like same sex marriage legal at the time. Hanging out on reddit developer forums provides sometimes hilarious and pathetic details on this. How some percentage of Indian investors, CEOs, and employees in India's tech sector operate is nothing but a way of keeping a financial pot bubbling and skimming the froth while never ever making or serving a single edible dish of stew. Injunctions are to be used only if 1) irreparable harm would occur if the action was not stopped AND 2) the merits of the case would very likely favor the plaintiff. Hence the plaintiff is expected to make a sound legal argument AND the opposing party should get to respond AND the judge should carefully explain their decision, limiting the scope and scale of the injunction to the maximum extent practicable.
None of that happened here - the judge heard weak arguments from planned parenthood, said "sounds good to me." then invoked the injunction without ever hearing the other side of the story. Surely planned parenthood could run a few weeks without congressional funding; hence no harm would occur by allowing the government to respond.
