Supreme Court Declines to Hear Case Addressing Whether “Reverse Discrimination” is also Prohibited by Civil Rights Act of 1964

On this blessed Independence Day, I have a disappointing update on a legal case I’ve been covering. Had “B.W. [Brooks Warden] vs Austin Independent School District” been accepted by the Supreme Court, there might finally be clarity as to whether Title VI of the Civil Rights Act of 1964 prohibits racial discrimination against whites. For now, entities such as the AISD are free to continue engaging in racial animus based on a student’s skin color, so long as the student is white.

As I’ve written, Brooks’ parents, Brandi and Monte Warden, are personal friends of my wife and mine. When they notified me earlier this week that SCOTUS had denied certiorari, they were obviously disappointed, but their disappointment was also mixed with an equal and offsetting pronouncement of patriotism and faith. They stressed that ultimately all of this is in the hands of a higher power, and they also know that Brooks’ ordeal, and the legal path they pursued, will help chip away at the ugly 21st century version of state-sanctioned racism.

Our sacred Declaration of Independence acknowledges that we’re an imperfect Union, but we strive to to form a more perfect Union. Brooks’ and the Wardens’ legal battle will indeed help make this a more perfect Union. There are plenty of landmark cases for which there were preceding writs that were denied certiorari, but the pressure mounted until SCOTUS couldn't hide from the issue any longer. Brooks' case has paved the path for other cases to follow.

As I documented in my previous pieces in April and in June:

Among the abuses claimed by Brooks were a teacher calling him a racial slur; the Principal mocking Brooks and accusing him of listening to Dixie while wearing a headset; the Student Council President circulating a picture of Brooks as a Klansman; another student promising to kill Brooks and all Trump supporters; and a student beating Brooks up in a classroom while the teacher watched. That student is later alleged to have boasted about assaulting Brooks because of his race. As Brooks’ father documented, the Austin Independent School District never disputed or refuted any of this, they just chose to ignore the Wardens’ pleas to make it stop.

Aside from me, The Federalist has also been giving this case good coverage in conservative media, with articles published in February and in June.

Coverage has now broken out into the legacy media, with this surprisingly unbiased report from USA Today on the Supreme Court declining to take the case: “'Whitey' case: Texan cites racial harassment at school. What did Supreme Court say?

The Austin Independent School District said Warden failed to show the alleged hostility was based on race, rather than his political views.

Isn’t it charming that a public school district is arguing that the persecution of one of its students is allowable so long as it’s because the student has the wrong political views, rather than because he has the wrong skin color. But the AISD seems to also understand that acknowledging the hostility Brooks endured with the school district’s acquiescence would get them into Title VI territory, thus their claim that racial slurs directed at Brooks were “political.”

But because the Supreme Court punted, there is still no clarity as to whether Title VI applies to non-minorities, meaning that the “right kind” of government-sponsored racial oppression is still not currently prohibited. We can therefore expect more awful stories like this one from earlier this week:

“Jewish Teen Hid in Locked Classroom as Anti-Semitic Mob Pounded on Door: Lawsuit” [Washington Free Beacon – 7/01/2025]

The incident was the culmination of anti-Semitic harassment the student, referred to in the complaint as M.K.L., had endured for months, leaving the now-15-year-old with "terrifying nightmares and flashbacks," the June 12 suit her parents filed against Seattle Public Schools alleges. School officials repeatedly failed to address the harassment and refused to turn over surveillance footage, according to the complaint.

By refusing to hear “B.W. vs A.I.S.D.,” the Supreme Court has given its acquiescence for Seattle Public Schools to allow a teenage Jewish girl to be terrorized on school property, and to allow Jewish and white children around the country to be similarly terrorized.

However, I believe that with more of these cases getting media attention, and with more lawsuits working their way through the legal system, the day will come when the Supreme Court finally puts a stop to reverse all racial discrimination, stating in effect, “Not on our watch. Not under our Constitution.” Brooks Warden has brought us closer to that day. God bless you, Brooks.

Despite all this, you cannot talk to the Wardens without them constantly reminding you of their many blessings, and one of them is that Monte Warden has been invited to perform at The Grand Ole Opry on Saturday August 16. To make it even more cool, Brooks is going to join him on stage to sing bass on a song or two.

The key word there is Jewish. It's also illegal to treat people badly because of their religion, and Jewish is an identifiable minority religion in the US. I suspect SCOTUS will act on that basis.

Cert denials come more from internal court politics rather than what Robert's thinks. Rule 10 of Scotus sets out the literal requirements for a cert petition--it takes four justices to agree to hear a case but those four justices may not want to grant cert if they perceive that they may lose their preferred legal rule when the Court decides the case. So, something called strategic denial occurs.

This pattern of explanation applies to 2A Bruen, reining in lawless district courts, etc. On the court, you pick the battles you can win along with those you must fight. But wise justices never become beautiful losers flailing around muttering muh principles. Essentially, we have two very solid conservatives-Alito and Thomas, two wobbly conservatives, Gorsuch and Kavanaugh, and two centrist media appeasers, Roberts and ACB. Then you have 3 leftists that vote in lock step when it counts. So, to build a winning coalition, Alito and Thomas must carefully sound out their allies, figure out what issues to raise with them for support, etc. All very political in a game where all know the stakes.

In a particular case, usually. It gets weird when the cases involved interlocutory appeals or you have a facial challenge (broad based usually on specific constitutional or statutory language issues) followed by an as applied ( a neutral statute like the Civil Rights Act can be misapplied in a specific instance by a government).

Despite stupid media reporting, writs of cert have NO value as precedent. Including internal court politics, sometimes the fact pattern in a case is bizarre, sometimes, there are incomplete basis of lower court decisions to make a 'good' ruling, and then public opinion plays a part as well. Public opinion is very important to Roberts apparently and he is a justice more interested in politics than good law.

It will happen and that is why some of the conservative justices may be looking for a better case to issue cert or they may not have a winning coalition yet. What people may or may not know is that Scotus only interprets a statute ONCE because they rely on Congress and the Presidency to change that statute if problematic.

There are exceptions to the rule but generally those occur if some untold constitutional problem crops up, or Congress/president ignore an ongoing constitutional problem despite the court warning them to change the statute (Voting Rights Act and preclearance by DoJ was such an instance).

There was; this is a slight distinction from that one, but I can see SCOTUS using that to punt on the case.

Not many realize that the SCOTUS receives at least 10,000 requests for cert every year, and only chooses to hear about 100 of them. So requests for cert have at best a 1% chance of being accepted.

I think it is more what the big legal firms favor mattering to him. Plus, Roberts makes bank via his wife who is a headhunter in DC for legal talent for the big law firms. Piss those off and she gets fewer calls to headhunt. Patent conflict of interest very common in urban court settings and particularly in DC.

Basically, Roberts is at heart a corporate smoozing type rather than someone actually interested in the law like Scalia, Thomas, or Alito. So, in the absence of sound principles, Roberts goes with the flow.

One of the worst things that Rehnquist did as Chief was to greatly reduce the court's workload by hearing and deciding about 1/4 of the number of cases that the Warren court did. Burger court averaged about twice as many. Now, Rehnquist had a very narrow working majority at times on the court but the court punted some very important issues for decades as chief. But Roberts does not have that excuse nor does the majority. Shorter opinions, less concurrences that muddy the water, and a disincentive to peacocking dissents would all be accomplished by accepting a higher caseload.

Scotus is always a trailing indicator--not a leading one. At the end of the day, the political institutions and solid majority coalitions wag the court tail, not vice versa.

The political branches give cover to the Court to do what is right after the fact. So eliminating the tax on suppressors and SBRs, etc. can give ammo to 2A advocates on Scotus to trim back the NFA using Bruen. And almost never will the courts grant you everything that your policy position wants. Winning via the Presidency and Congress are better bets.

Justices and federal judges in general are about as independent as you can get--literally they are like ship captains at sea. So no, you can't tell them anything and remember that Jackson was originally a district court judge with just a very brief stint on an appellate court. Shipwreckedcrew had a recent column about that.

District court judges run the gamut from being imperious assholes to workhorses that are kind and wise. You can guess which end of the spectrum Action Jackson falls into and the fact that she is a credentialed DEI justice from Harvard Law School makes it worse as far as Dunning Kruger syndrome.

George Washington let it be known that if the rebellion was successful, he would fight for full Catholic emancipation, and this brought a great many Catholics and other non-conformist Christians into the ranks of the Patriot cause.

This aspect of Washington's greatness is often overlooked, as is the foresight and wisdom of the Founding Fathers in creating a non-confessional state, without an official religion or established church.

1993 begat the Robin Hood plan as a result of Edgewood ISD v Kirby back around 1989-1991

Texans can only escape having their property tax dollars confiscated by the authorities to underwrite other school districts by dying or moving out of Texas.

Apparently it was unconstitutional for citizens living in an ISD to continually vote down school tax increases because it would cause under-taxed communities to have disproportionate spending than high tax ISDs who were flush in cash from a compliant tax base.

So now "poorer" districts can still vote themselves no tax increases and expect the foolish tax-crazy districts to underwrite their deficits.

173 The dissents in Dred Scott are excellent reading, by the way. Totally dismantled Taney's argument, and in fact one of the Justices quit in outrage because the whole case was a setup to foreclose further discussion of slavery.

Funny how that keeps happening - hot public issue seems to be going against the elites and *presto* a case goes to SCOTUS which finds some obscure twisted reading that takes it off the table, all in defiance of the popular will.

The state of Nevada, for a long time, did not have an intermediate appellate court so it was districts courts and the NV Supreme Court. Because appellate review is a constitutional right, NV Sup. Ct. had to address every appeal.

So as a result, NV Supreme Court had to issue a truly massive number of opinions every year.

Oklahoma and Texas have separate courts of last resort (aka highest courts of those states) for civil and criminal. Not surprisingly, the criminal dockets are always full for the criminal justice courts of last resort. And Texas is so big, Florida is another, that you have multiple lower appellate courts in districts.

Hate to tell you but it is. Likewise the Articles of Confederation. In law, texts are not self defining. Textualists/Intentionalists look toward how that language and the intent of those that wrote it influenced the spare language of those provisions. Likewise actions such as G. Washington claiming the powers of firing federal officials and declaring this country neutral. Neither are in the language of the Constitution.

So we have an 'unwritten' codicil to the Constitution whether people like that or not. See the same problem with people that read a statute or even a Bible verse out of context. Interpretation requires deep understanding otherwise you are just winging it and interpreting language to your own fancy. Just like leftists do.
