Mediator in Trump's Lawsuit Against CBS For Deceptively Editing Kamala's Word-Salad Answers Suggests $20 Million Settlement

A mediator has proposed that Paramount Global (PARA.O), opens new tab and U.S. President Donald Trump settle his lawsuit against CBS News over an interview with former Vice President Kamala Harris for $20 million, the Wall Street Journal reported on Wednesday.

The proposal would include a $17 million donation to Trump's presidential foundation or museum, as well as millions more in legal fees and public service announcements on Paramount-owned networks to fight antisemitism, the report said, citing people familiar with the matter.

Trump filed a $10 billion lawsuit against CBS in October, alleging the network deceptively edited a "60 Minutes" interview with then-vice president and presidential candidate Harris to "tip the scales in favor of the Democratic Party" in the election.

In an amended complaint filed in February, Trump bumped his claim for damages to $20 billion.

The sticking point isn't the money, the Wall Street Journal reports. Trump wants an apology from the network and an admission of fault, but Paramount (CBS' corporate parent) refuses.

Instead they're offering to run... public services messages about antisemitism? What?
What has that got to do with any of this?

Ed Morrissey comments:

They don't want to admit error, the WSJ later notes, because they don't want to expose their news operations to further legal liability for cooked reporting and corrupt election meddling. They want the lawsuit out of the way for their merger with Skydance, likely because of the potential liability of a $20 billion claim on the balance sheet as the value of Paramount gets calculated. Other media outlets also claim that Paramount and Redstone are worried that the FTC would intervene in the merger in retaliation, but that has never made a lot of sense. (The WSJ lays out that case near the end of that report, for those who want to read it.) There isn't really much of a reason for an FTC intervention in this merger, as it's not even among the more impactful consolidations in the entertainment industry of late. A federal court would make short shrift of such a move, especially these days, and maybe especially in the DC circuit.

CBS "News" and 60 Minutes are shrieking about the possibility of any admission, even an implicit one, that they ever did anything wrong or biased, ever.

Even as lawyers for Paramount Global and President Trump are in discussions about a potential settlement in his lawsuit over the editing of a "60 Minutes" interview with Kamala Harris, Paramount and CBS filed a response reaffirming their position that the interview is protected by the First Amendment -- and that Trump's legal team has failed to provide any evidence to the contrary.

"This is a meritless lawsuit that, as Plaintiffs' opposition admits, takes 'aim[] at a news organization' ... for editorial decisions Plaintiffs dislike," Paramount and CBS said in a filing Monday in reply to Trump's motion to deny CBS's request to dismiss the lawsuit.

"President Trump and Representative Jackson attempt to evade bedrock First Amendment principles establishing that public officials like themselves cannot hold news organizations like CBS liable for the exercise of editorial judgment," CBS said in its June 23 reply.

As you know, 60 Minutes ultraliberal partisan Scott Pelley whined like a bitch over the alleged Death of Democracy should Paramount settle with Trump.


Joe Rogan asked Bernie Sanders about this. Sanders kept asserting that politicians shouldn't sue leftwing legacy media companies, ever, no matter how much they defame or spread disinformation. Rogan proposed, correctly, that if they never pay a price, they'll continue doing it forever, and Sanders just continued his Angry Old Man ranting.

By the way, Sanders didn't know the answers to barely any of Rogan's questions. And he claims that he's very "well prepared" to answer Rogan's questions.

It's a confidential, non-binding process. I've done it dozens of times myself, both as an attorney representing a party, and a mediator myself.

This would be my solution as well. Side by side, same screen with chyrons on both sides indicating which was shot and which aired. Then when the aired portion ends, that half of the screen cuts to black with a time code showing the roughly 30 minutes difference between the two versions.

I listened to the whole Bernie / Rogan podcast. I've watched Bernie on Rogan in the past, back when Rogan was a Bernie Bro. Even back then, Rogan asked somewhat pointed questions.

Bernie, as usual, comes off as a likeable guy who is very out of his element and has no idea on the specifics of anything. Rogan didn't even push him that hard on some pretty fucking big questions that you'd think Bernie would have thought about before, but Bernie had nothing.

Rogan recognized that, felt bad, then backed off. Then at one point, during the questioning, Bernie just goes "yeah, you know -- I have a plane to catch." and the interview winds up a few minutes after that. Granted, Bernie is in his 80's, so maybe he was just tired. But it sounded like Bernie was just way over his head.

But Bernie demurred on pretty much any big question Rogan asked, and mostly tried to talk about pretty non-objectionable things, mostly in platitudes ("I just want everyone to be able to live a solid life with a good job").

It started off cordial enough. Bernie just doesn't like follow up questions. He's not really a "details" guy. And Joe (very non confrontationally) made the mistake of asking follow up questions, which Bernie seemed to take as a hostile move, which led to him saying something about having a plane to catch and winding up the interview.

Bernie did not come off looking like he had any real answers on literally any topic. And he and Joe talked about a lot of topics. At one point (paraphrasing), Bernie said to Joe "What would you do about [whatever issue]?" and I guess Joe gave him a look or something and then Bernie said "well, yeah, I guess I am the Senator." and laughed then moved on to another topic.

Yeah, the guy is obviously smart. He plays a character. He was sitcom actor / comedian whose entire thing was "I'm just a weight lifting meat head I don't know anything" and that spilled over in to his podcast.

But he knows the right questions to ask, knows how to make a guest feel comfortable, and the format of his show allows him to flesh out deeper thoughts (if any exist) from people than a normal 3 minute clip of an interview on CBS or whatever.

This is how interviews should be done. And to a large extent, used to be done. And are still kind of done for print or books.

Sit down and talk to the person for several hours in a back and forth conversation where the goal isn't to get to a "gotcha" moment or create a good soundbite, but to learn what the person actually thinks.

And if the person is full of shit, that will become readily apparent in a long interview. It's not the interviewers job to constantly play FACT CHECKER and scream at the person, let the audience sort that out.

You have to have systems in place that track your NYC sales and expenses, as if that was all the business you ever did. Then you have to do the same for all your non-NYC operations. Use that ratio on all the overhead and NYC taxes the portion of your enterprise's taxable income derived from NYC operations. It was a nightmare back in the 14-column green ledger paper days.

When he had James Hetfield on, talking about Metallica, they briefly talked about Hetfield's move out of CA and then he mentioned bees on his ranch. I don't think there's any world in which Sliwa becomes NYC mayor.

Adams is almost certainly the best bet here. If he can get the Cuomo machine behind him, that means he has the black machine, italian machine, irish machine, wall street machine, and at least a fair amount of the jewish machine behind him. That should also bring him the public sector unions as well.

Which is what it will take to take on the Chinese, Arabs, Puerto Ricans and other Hispanic machines that are backing Mamdani.

If it's even possible. The demographics of NYC have shifted massively in the last 10-20 years, and the old tenuous ethnic based tammany hall machines are crumbling.
