Lowly District Court Judge Championed by Elizabeth Warren Now "Defies the Supreme Court," Decides That His Own Authority Is Greater Than Both the President's and Supreme Court's

Lowly district court functionary Brian Murphy ruled that Trump could not deport illegal aliens with deportation orders -- some convicted of attempted murder -- to a third country. I think Trump wanted to deport them to a third country because they claim their home country is a shithole country and they say they'd be persecuted there or some bullshit.

The Supreme Court overruled him and said that the deportations can continue.

Deciding that he is now more supreme than the Supremes, this dinky little bureaucrat worm now writes an order that effectively blocks the deportation the Supreme Court just said could proceed.

He's saying that the Supreme Court's ruling doesn't apply to the six people this case is specifically about.


President Donald Trump's administration urged the Supreme Court on Tuesday to allow it to immediately deport a group of migrants currently being held on a US military base in Djibouti to South Sudan, saying the judge handling the case defied the high court.

The unusual motion came hours after a divided Supreme Court allowed the administration to resume deporting migrants to countries other than their homeland, including places like South Sudan, with minimal notice. Later Monday, a district court judge in Massachusetts ruled that the order didn't apply to the specific migrants in Djibouti.

Describing the lower court's order as "untenable," the Trump administration accused US District Judge Brian Murphy of being in "defiance" of the Supreme Court's order and suggested in its brief on Tuesday that the justices remove him from the case.

"The district court's ruling of last night is indefensible," the Department of Justice told the Supreme Court.

"The district court's ruling of last night is a lawless act of defiance that, once again, disrupts sensitive diplomatic relations and slams the brakes on the executive's lawful efforts to effectuate third-country removals," the administration said.

As is often the case on the Supreme Court's emergency docket, the order Monday afternoon provided little detail about the implications of the decision. The Trump administration had asked the justices to put on hold an order from Murphy, which found that the government's efforts to deport migrants to third-party countries without additional due process "unquestionably" violated constitutional protections.

The Supreme Court granted that request, allowing the administration to continue those removals to third countries broadly while the litigation continues.

But later Monday, Murphy ruled that the Supreme Court's order didn't affect a group of immigrants being detained by the US at a military base in Djibouti -- a group that has become a focal point in the fight over the removal policy. The migrants, including some from Cuba, Vietnam and Laos, were being held in a converted Conex shipping container.

Murphy said the government must continue to assess claims they make about fear of being tortured before removing them to South Sudan. He had mandated those assessments in a separate order on May 21 that the Trump administration did not appeal.

On Tuesday, the Justice Department also suggested the Supreme Court "may consider ordering that the case be reassigned to a different district judge."

Administration attorneys urged the justices to "clarify" that its order Monday also covers Murphy's separate May 21 order involving the migrants in Djibouti. If the Supreme Court agreed to do so, that would mean those migrants could be removed to South Sudan.

The birthplace citizenship decision, which is actually a decision on the process of national injunctions and not about the merits of the Trump policy of denying citizenship, is still due.

Roberts wrote Skrmetti, one of the big decisions of the term, not Alito or Thomas.

Alito has released very few decisions so far this term.

Term is up in about a week.

Tea leaves say that Alito is writing the national injunctions opinion. If he is, I expect a very harsh slap down and limitation of lower courts.

If that decision had been reached 2 months ago with guiding precedent on all of this, would it make sense to constantly interject SCOTUS into everything leading up to the final opinion?

It's kind of blind hope, but so many noises have come from SCOTUS over the past 3-4 years against nationwide injunctions and general misappropriation of jurisdiction from the lower courts that...it's not blind.

This makes me sad. This is a failure of the adults running the show, but it is also a negative lesson that taught you that nothing happens for you unless someone else makes it happen.

We are on a losing B team with a few uncoachable kids. I tell them straight up, if you want to ignore the coaching, I'll move on to the next kid. We teach sportsmanship and how to be a good team mate. We teach hard work gets the benefits of preferred spots. We teach mental toughness and playing through adversity.

My youngest went out and practiced for hours on the pitcher trainer alone, when he decided he wanted to pitch. I went to youtube to learn how to coach him. Now he's striking out kids two years his senior and having a blast.

We got 10 runned last night, and he had a blast, striking kids out, getting tagout at home on reverse pick, textbook 6-3s, and even a heads up third strike play on a known bad pitch that he made happen to get to first while allowing a run to score from second.

That may play in to it, but I think the simpler explanation is that judges don't want to limit their own power.

Which is a problem, since our congress has spent decades outsourcing policy decisions to SCOTUS and would prefer the courts make the "tough decisions", not them.

So there really isn't anyone to reign them in here.

My oldest chose to start catching last year. He had two games under his belt last year, and now he was varsity (Middle School) catcher, played all the games, all innings, and he is the primary catcher on Summer league.

The government goes out of its way to get get an accurate count.

So I'm guessing it's a breathtakingly large number -- definitely in the tens of millions. The Census say there are 47 million people residing in the country right now who were not born here.

We issue over 2 million visas a year (so legal immigrants), so we could try to do the math to figure out how many are illegal, but it's really tough to know.

Since Trump is acting in accordance with his powers clearly defined and laws passed by the legislature, and over an area under which the states have no jurisdiction (as a recent SCOTUS case reminded us) unless Congress maintains he is violating a duly passed law - no one else has standing.

FDR threatened to pack the Court in retaliation for SCOTUS (and the lower courts) striking down various New Deal schemes he tried to put in place.

SCOTUS famously got much more quiet after that and went along with FDR's schemes ("the switch in time that saved 9"), and it's usually seen as the end of the Lochner era. I'm blanking on the name of the case, but I'm sure whig could cite it with appropriate blue book cites off the top of his head.

I disagree. The Fuller Court (that largely decided Lochner other than Holmes as a justice) was a bunch of corporate lawyers responsible for some of the worst Supreme Court decisions since Dred Scott such Plessy v. Ferguson where the court created out of thin air the separate but equal justification for de jure segregation. Not a big fan of E.C. Knight's evisceration of the Sherman Anti Trust Act, Pollock, which overturned the income tax was an investor suing his own bank (collusive and thus non justiciable), and Lochner created the dubious liberty to contract doctrine effectively amending the Constitution and eviscerating the 10th Amendment to do so.

Fuller court created the conditions necessary for the FDR administration to run wild and for Woody Wilson to resegregate the federal government.

Not a fan of that era.

IIRC Iran's capacity for building various missiles is huge. Many of the facilities are also underground. The IDF went after the launchers big time in the first couple nights because there are fewer of them than the missiles themselves.

Iran also manufactures the so-called suicide drones in huge numbers as well. Meaning there are still likely thousands of missiles and one-way drones that Iran can unleash. Presuming there are facilities to launch them with. Drones in particular need nothing more than a ramp on a truck or a fairly level area to take off from.

I doubt any of that infrastructure has been totally destroyed.

Impeachment is a poor substitute for high crimes or misdemeanors and almost impossible to do absent actual crimes. So the judiciary became insulated to the extent that the only cure is adding more judges. I would also consider going back to the old ways ended in 1976 that allegations of unconstitutional actions require three judge panels with an automatic direct appeal to Scotus.

Research has shown that judges suddenly become more circumspect when they have to deal with colleagues on the bench and the fact that a favorable appellate court can no longer shield them because Scotus has to deal with them and create a binding precedent means that outliers become overridden horrible examples to others.

According to my reading of the contemporary writings of the time ... and man, were those old boys gas bags - they wrote EVERYTHING down ... the entire idea of "Judiciary" was the great big compromise.

Because look, the idea of "One Tyrant over there or Thousands here" was a real thing. I would have NEVER, in their day, ratified the Constitution. And certainly not with the Bill of Rights. The Anti-Federalists expressly warned that the BoR would be aimed directly at the States.

The Founders were not Perfect Geniuses. They pretty much whiffed on the idea of the Judiciary.

Not sure what happened at Natanz. Think Israel believes they did a "soft kill" on the centrifuge cascade by cutting the power (likely), but they didn't strike the underground halls. Still can't figure out whether we did (though with 2 MOPs assigned to Natanz, I'd say we probably did).
