Ninth Circuit Overrules Lower-Court Hawaiian Judge's Order, Allowing Trump to Continue Using the National Guard to Control the Democrat-Media Party's Violent Insurrectionary Forces
The lower district court judge of course ruled that Trump wasn't permitted to use the normal powers of the presidency, as liberal district judges routinely do.
The three-judge panel reviewing that decision ruled unanimously that Trump has the authority. The panel featured two Trump judges and one Biden judge. Note that both of these rulings have to do with an emergency temporary injunction -- that is, there was no full trial on the merits, just the lawyers making their case to judges on an expedited basis. So this is, technically, an interim opinion which may be revised later. However, in this case, a "full trial" would pretty much just be lawyers making their cases to judges. This is a case that turns on constitutional language and precedents, not specific facts. So we can say that this temporary ruling is almost surely the final ruling, too. There aren't many new facts that would be disclosed after a fuller process, and those facts wouldn't alter the appeal court's ruling -- they're ruling that the president's decision-making with respect to the military is simply not up for judicial review.President Donald Trump will retain command over National Guard troops deployed to Los Angeles, following a ruling late Thursday from a three-judge panel on the 9th U.S. Circuit Court of Appeals. The case stems from Trump's decision to send in federal troops after protests erupted in response to immigration enforcement actions. It marked the first time since 1965 that a president asserted control over a state's National Guard without that state's consent. The ruling overturns a decision by U.S. District Judge Charles Breyer, who ruled that Trump had overstepped his legal authority by deploying troops without California's approval. Breyer, appointed by President Bill Clinton and the brother of former Supreme Court Justice Stephen Breyer, argued the protests failed to meet the legal threshold of a "rebellion" that would justify federal intervention. "The protests in Los Angeles fall far short of 'rebellion,'" Breyer wrote. Last week, the 9th Circuit granted Trump an emergency administrative stay, temporarily pausing Breyer's injunction. But Thursday's decision goes significantly further. It replaces the temporary relief with a full, written opinion from the appellate panel, concluding that "it is likely that the President lawfully exercised his statutory authority." The panel also made clear that even if Gov. Gavin Newsom was not properly notified in advance, the law does not give governors the power to block such orders.Trump is pleased.

"The Judges obviously realized that Gavin Newscum is incompetent and ill prepared, but this is much bigger than Gavin." The post emphasized that the ruling isn't just about California. "All over the United States, if our Cities, and our people, need protection, we are the ones to give it to them should State and Local Police be unable, for whatever reason, to get the job done," Trump wrote. He added that the ruling "is a Great Decision for our Country, and we will continue to protect and defend Law abiding Americans."

This is one of the most disturbing rulings in my lifetime. It goes against my understanding of the structure of the United States, national security, and the prohibitions in and reasoning behind the US Constitution’s explicitly excluding a standing army.
The executive branch can't have unchecked authority to effectively rewrite the law by redefining terms on-the-fly to mean whatever they need in order to justify their actions after-the-fact. That's beyond dangerous.
Remarkable how bad this is. Wouldn't know it listening to the media. I think a Prez has the authority, but not in trumped up situations like this.
If this snowballs, rump will then have the blueprint for quelling dissent with brute force. We are going to turn into Tiananmen Square. The People have a right to peacefully assemble. Sure, there were cars burning, some property damage, I guess (who did that?), but by no means did we need Federalized troops and active-duty Marines out there pushing the protesters back.

The trial court judges know they are going to be overruled. They know they are wrong on the law, and aren't even trying to apply the law fairly. But they're doing everything in their power to slow down Trump's agenda.
And yet we have no recourse.

Kind of an opposite problem to the one FDR had. He was trying to massive expand the government and Courts (including SCOTUS) kept saying "nah, can't do that."
FDR solved his problem by threatening to add additional justices to SCOTUS, and SCOTUS and the lower courts ended up backing down (the switch in time that saved nine).
I'm not sure that strategy would work today.
So what's the solution?

I'm sorry, what? We definitely have a standing army and have had one for quite some time. The Constitution says the funding for an army has to be voted on every 2 years, and I guess we can call that a prohibition on a standing army, but that has nothing to do with Trump and the National Guard.
I do like that the DU people are becoming staunch originalists though.

The national guard is a weird one. It's like Schrodinger's military. Sometimes it's the military, sometimes its not.
Technically the US military can't operate on US soil during peace time, at least not in a policing role. Posse Comitatus Act and all of that.
But the National Guard is considered a "state militia" sometimes, which is why governments can call them up to quell riots or whatever. But it's clearly connected to the military.
Anyways, if the DU types are feeling hyper technical about the role of the federal government, I'm all ears. I have a lot of thoughts on things the federal government shouldn't be able to do under the constitution, but routinely does.

The national guard is a weird one. It's like Schrodinger's military. Sometimes it's the military, sometimes its not.
Technically the US military can't operate on US soil during peace time, at least not in a policing role. Posse Comitatus Act and all of that.
But the National Guard is considered a "state militia" sometimes, which is why governments can call them up to quell riots or whatever. But it's clearly connected to the military.

FDR solved his problem by threatening to add additional justices to SCOTUS, and SCOTUS and the lower courts ended up backing down (the switch in time that saved nine).
I'm not sure that strategy would work today.

Congress can get rid of all inferior courts if they wanted to and limit the jurisdiction of SCOTUS to the things spelled out specifically in the constitution -- disputes around federal laws, the constitution, between citizens of different states, admiralty law, etc.
They could re-write court rules to get rid of TRO's if they wanted. They could overrule Marbury v Madison with legislation.
There's all kinds of things they COULD do, but they won't.

The case involving birthright citizenship EO is primarily focused on whether a district judge can issue a national injunction.
Primary legal question is the injunction, not the EO unless the court does a de novo turn where the primary legal question at its hearing becomes something else entirely like Mapp v. Ohio was argued as an obscenity case until de novo, it became a 4th Amendment case. .

And then there's also the other issue (that still happens, obviously, with Circuit splits) where federal law is enforced / not enforced or means different things in different states or even regions of states if the judge is confined to issuing injunctions for only his district.
I'm sure you know all of this, I'm just saying -- it's kind of an unworkable system if we can't trust the judges to be judge-like. If they're going to act like partisan hacks, I don't know how you fix that.

They are out there. Trump appointed a lot of them in T1. The SC is a tougher bitch, though. The SC candidates are all from a more narrow and elite demographic, which tends to skew more left. Plus, the historical process of having the candidates screened by Federalist Society left a lot to be desired.

Unless you're a highly unqualified minority (especially an immigrant minority), then maybe you have a shot.
So if our choices for SCOTUS justices are all Yale or Harvard-educated people from wealthy and/or influential families, well... that's a pretty small group to pick from. And a group that tends to be very "elitist", and as such, would not be a fan of a populist president like Trump.

One case dealt with a statutory interpretation of sentencing laws due to misbehavior of the defendant and another one dealt with rejecting an ADA claim regarding health insurance coverage of a person disabled before she could qualify for retiree health care benefits.
The FDA v. RJ Reynolds was perhaps a highlight of future decisions in Trump v. CASA as Scotus denied RJ Reynolds' lawsuit regarding FDA vaping regulations because RJ Reynolds should have filed in its hq circuit (the 4th) or where the FDA was located (the DC Circuit). This decision affects judgeshopping apparently.

Closer to balanced now than the DC Circuit or the 1st and 2nd. One issue though has been manipulation of that court for en banc decisions. The 9th is the only circuit where an eleven judge panel is selected for such cases rather than the whole number of active judges. This is because the 9th has 29 active judges. At least on gun decisions, it appears that the panels have been manipulated to maintain gun laws in places like CA and Hawaii despite the original 3 judge panel ruling them unconstitutional.

I think Trump is done with that and the Senate being headed by someone other than Mitch is going to affect who gets appointed to circuit and Scotus nominations. The Federalist Society has shot themselves in the head as far as influence. My guess is a lot more state judges get elevated and a lot fewer 'elite' types for vacant positions.

Better to consider doing such via Congress than reliance on the courts.
In the long run, dismantling and defunding the government works best via political processes rather than the courts.

It's fully of smarmy old money Rockefeller Republican types who care much more about business and commercial law (that, some would say, indirectly benefits almost all of them and their families personally) than they do anything else.
Which is why they're so big on the stupidest phrase ever to be uttered in regards to federal judges: "judicial restraint." Because businesses like predictability and stability. So if the current law says XYZ, that's what it will remain. Unless it's too harmful to business, then they will overturn it.
But for social or political issues? Ehhh...

Sydney Sweeney needs to shut up on issues she knows nothing about. The majority of Utah is federal land. So little of it is buildable or drillable because the government owns most of it. And drilling/fracking is best in southern utah, where the small towns and tribes separated by hundreds of miles of desert and mountains desperately need that revenue, to increase their tax base and to compel the younger generations to have a reason to stay, and not flee their hometowns or reservations for better jobs and lives.
Also, often the local tribes get a cut of the oil/fracking money, or indirectly benefit from it. Why does she hate indigenous people???

Basically, the Dems wanted to enshrine judicial activism from the 40's to the 60's and the GOP due to lack of enough senators was forced to appoint justices and judges that did not threaten the status quo. Plus, as you mention, the GOPe was largely concerned with judicial effects on commercial interests and not that of the hoi polloi.

I think a lot of it comes from conservatives attending law school are more likely to go into fields that they can get good jobs. So they tend to go into fields that emphasize commerce, not constitutional or criminal law.

At the time, law schools were at the beginning of a fad that took over: favoring interdisciplinary studies over actual lawyers for tenure track positions. "Law and" degrees; PhDs in other purely soft humanities disciplines and the like. This simultaneously depleted expertise in the law while bringing in people from fields the left had entirely taken over much earlier. It pushed law schools much further to the left and made things other than law paramount.

The moral panic over Mike Lee's comments about the government owning too much land is out of hand. 67% of the land in Utah is government owned. 90% of Nevada is government owned. People are acting like Mike Lee wants to see off Yosemite National Park. There's many thousands of acres that can be reasonably developed without doing any development on national park land.
