The three-judge panel reviewing that decision ruled unanimously that Trump has the authority. The panel featured two Trump judges and one Biden judge. Note that both of these rulings have to do with an emergency temporary injunction -- that is, there was no full trial on the merits, just the lawyers making their case to judges on an expedited basis. So this is, technically, an interim opinion which may be revised later. However, in this case, a "full trial" would pretty much just be lawyers making their cases to judges. This is a case that turns on constitutional language and precedents, not specific facts. So we can say that this temporary ruling is almost surely the final ruling, too. There aren't many new facts that would be disclosed after a fuller process, and those facts wouldn't alter the appeal court's ruling -- they're ruling that the president's decision-making with respect to the military is simply not up for judicial review.President Donald Trump will retain command over National Guard troops deployed to Los Angeles, following a ruling late Thursday from a three-judge panel on the 9th U.S. Circuit Court of Appeals. The case stems from Trump's decision to send in federal troops after protests erupted in response to immigration enforcement actions. It marked the first time since 1965 that a president asserted control over a state's National Guard without that state's consent. The ruling overturns a decision by U.S. District Judge Charles Breyer, who ruled that Trump had overstepped his legal authority by deploying troops without California's approval. Breyer, appointed by President Bill Clinton and the brother of former Supreme Court Justice Stephen Breyer, argued the protests failed to meet the legal threshold of a "rebellion" that would justify federal intervention. "The protests in Los Angeles fall far short of 'rebellion,'" Breyer wrote. Last week, the 9th Circuit granted Trump an emergency administrative stay, temporarily pausing Breyer's injunction. But Thursday's decision goes significantly further. It replaces the temporary relief with a full, written opinion from the appellate panel, concluding that "it is likely that the President lawfully exercised his statutory authority." The panel also made clear that even if Gov. Gavin Newsom was not properly notified in advance, the law does not give governors the power to block such orders.Trump is pleased. This is one of the most disturbing rulings in my lifetime. It goes against my understanding of the structure of the United States, national security, and the prohibitions in and reasoning behind the US Constitution’s explicitly excluding a standing army. The executive branch can't have unchecked authority to effectively rewrite the law by redefining terms on-the-fly to mean whatever they need in order to justify their actions after-the-fact. That's beyond dangerous. Remarkable how bad this is. Wouldn't know it listening to the media. I think a Prez has the authority, but not in trumped up situations like this. If this snowballs, rump will then have the blueprint for quelling dissent with brute force. We are going to turn into Tiananmen Square. The People have a right to peacefully assemble. The trial court judges know they are going to be overruled. They know they are wrong on the law, and aren't even trying to apply the law fairly. But they're doing everything in their power to slow down Trump's agenda.
And yet we have no recourse. This seems like an untenable position. Kind of an opposite problem to the one FDR had. He was trying to massive expand the government and Courts (including SCOTUS) kept saying "nah, can't do that." FDR solved his problem by threatening to add additional justices to SCOTUS, and SCOTUS and the lower courts ended up backing down (the switch in time that saved nine). It's like Schrodinger's military. Sometimes it's the military, sometimes its not. Technically the US military can't operate on US soil during peace time, at least not in a policing role. Posse Comitatus Act and all of that. But the National Guard is considered a "state militia" sometimes, which is why governments can call them up to quell riots or whatever. But it's clearly connected to the military. Anyways, if the DU types are feeling hyper technical about the role of the federal government, I'm all ears. Stephen Miller's comment was pretty funny, saying that they were going to follow the law and respect the judge's order, but he wouldn't commit to doing so if the judge decided to move troops from one place to another. I can imagine scenarios involving companies shipping products to all 50 states that violate various federal or state laws, etc. And then there's also the other issue (that still happens, obviously, with Circuit splits) where federal law is enforced / not enforced or means different things in different states or even regions of states if the judge is confined to issuing injunctions for only his district. I'm sure you know all of this, I'm just saying -- it's kind of an unworkable system if we can't trust the judges to be judge-like. The 9th is the only circuit where an eleven judge panel is selected for such cases rather than the whole number of active judges. This is because the 9th has 29 active judges. At least on gun decisions, it appears that the panels have been manipulated to maintain gun laws in places like CA and Hawaii despite the original 3 judge panel ruling them unconstitutional. Sydney Sweeney needs to shut up on issues she knows nothing about. The majority of Utah is federal land. So little of it is buildable or drillable because the government owns most of it. And drilling/fracking is best in southern utah, where the small towns and tribes separated by hundreds of miles of desert and mountains desperately need that revenue, to increase their tax base and to compel the younger generations to have a reason to stay, and not flee their hometowns or reservations for better jobs and lives.

When i went more than two decades ago, there was almost no conservative faculty. That includes the state school I went to in Texas, where one of the two "conservatives" was a former Souter clerk. At the time, law schools were at the beginning of a fad that took over: favoring interdisciplinary studies over actual lawyers for tenure track positions. "Law and" degrees; PhDs in other purely soft humanities disciplines and the like. This simultaneously depleted expertise in the law while bringing in people from fields the left had entirely taken over much earlier.
