Following Its Ruling Prohibiting Reverse Discrimination in the Workplace, SCOTUS Now Has the Opportunity to Eradicate Reverse Discrimination in Schools

In a landmark 9-0 ruling a few days ago, in a case referred to as “Ames,” the Supreme Court ruled that laws protecting minority groups against workplace discrimination also prevent discrimination against whites, straights, and males. This sets the stage for another important case that has been submitted to the Supreme Court, specifically, a case that would similarly prohibit schools from engaging in reverse discrimination against the children they are supposed to be educating.

The schoolhouse reverse discrimination case I am referring to is “B.W. vs Austin Independent School District.” I wrote about the case two months ago, unaware of the landmark Ames ruling that was about to come down that put an end to reverse discrimination by employers.

As I noted at the time I wrote about B.W. vs AISD, as important as this case is for the country, it’s also a bit personal to me, because the minor - just 12 years old at the time - who was the victim of institutional racial oppression at taxpayer funded public schools, is also the son of personal friends of mine. I became friends with Monte and Brandi Warden not because of politics, but because of shared musical interests.

For a brief recap of what Brooks Warden (“B.W.” was put through by adults at the Austin Independent School District, here is what I wrote: “Case Filed with Supreme Court Addresses if Civil Rights Act of 1964 Applies to Discrimination Against Whites - and this case is personal” [Buck Throckmorton – 4/11/2025]

Among the abuses claimed by Brooks were a teacher calling him a racial slur; the Principal mocking Brooks and accusing him of listening to Dixie while wearing a headset; the Student Council President circulating a picture of Brooks as a Klansman; another student promising to kill Brooks and all Trump supporters; and a student beating Brooks up in a classroom while the teacher watched. That student is later alleged to have boasted about assaulting Brooks because of his race. As Brooks’ father documented, the Austin Independent School District never disputed or refuted any of this, they just chose to ignore the Wardens’ pleas to make it stop.

When Sean Davis of The Federalist appeared on Fox News a few days ago to talk about the implications of Ames, he also took the opportunity to talk about the importance of Brooks Warden’s case against AISD. An article in The Federalist last week highlighted the argument Mr. Davis made: “SCOTUS Needs to Extend Reverse Discrimination Ban To Schools, Not Just Workplaces” [The Federalist – 6/05/2025]

[Sean] Davis noted that the B.W. case has “the exact same set of facts, not in an employment context, but in an education context.” He added that SCOTUS’s unanimous decision in the Ames case is “a really good sign” that the justices will say, “‘Look, we’re not going to leave this just in the employment context, where we say discrimination is wrong.'”

“They have an opportunity to expand it to education, to every other major institution that says discrimination is discrimination,” Davis said. “You can’t say that it’s OK to discriminate against someone because they’re white, but not OK because they’re black. We all know it’s wrong. It’s common sense that it’s wrong, and it’s nice to finally see the Supreme Court acknowledge in law that basic common sense.”

Brooks is being represented by the Center for American Liberty, which was founded by Harmeet Dhillon. This is the same Harmeet Dhillon who is now President Trump’s Assistant Attorney General for Civil Rights. In response to B.W.’s petition to the Supreme Court for a writ of certiorari, AISD finally provided a brief in late May, to which the Center for American Liberty provided this powerful reply brief. Here are a few excerpts:

Sadly, AISD’s Response demeans Brooks, recharacterizes the verbal harassment Brooks suffered as him being unable “to listen to other students’ political viewpoints,” and refers to Brooks being called a KKK member as a harmless “joke.” This type of disdain for a former student would ordinarily be beyond the pale. But Brooks is white. These days, it is perfectly acceptable—not only to AISD but to many in our society—to treat white people as “deserving” of differential treatment based on their skin color.

Racism against whites is racism. The difference is the “cultural permission [that exists] to tolerate (if not encourage) racism against whites.” Judicial permission should not follow. This case provides this Court the opportunity to stamp out this disturbing trend. The Court should grant the Petition to decide Title VI’s causation standard and make clear that no form of race-based discrimination will be tolerated in our nation’s schools.

The Supreme Court needs to grant certiorari to B.W. vs Austin ISD, put it on their docket, and finish the work they started with Ames. It’s time to eliminate all government-sanctioned racial discrimination once and for all.

24 There is no such thing as "reverse discrimination" or "reverse racism" or whatever. It doesn't exist, and the term is a linguistic trick - an effective and sinister one.

"Reverse" implies "opposite" or "backwards" - that is, abnormal. The entire premise behind it is to instill one entirely false premise until it cannot be questioned: that the norm is for whites and men (and especially white men) to arbitrarily harm non-whites and non-men. The normal state of the world in its natural condition is one of hatred and bigotry by whites against non-whites and by men against non-men.

If you accept such a premise, then the opposite is an aberration. It's a notable exception, a reversal.

But that premise is *false.* Discrimination is discrimination, period. If you refuse to hire someone only because he's white, that's plain discrimination - just like if you refuse to hire someone only because he is black.

"Reverse" discrimination/racism/etc. is a monstrously powerful and sinister term that does *exactly* what it is designed to do: reinforce that whites and men are bad by nature and as the norm.

For the well-heeled, top performing public schools, their teachers & administration have no idea of what exists beyond their walls, or they simply don't care what happens to +/- 30% of White children in average or below average public schools.

Ditto for the majority of the private schools including but not limited to Quaker, Muslin, etc.

Yup. It used to be a good word - remember "Those with discriminating tastes know ... " marketing? - but then it was replaced with what is actually "indiscrimination."

"I don't want to hire him because he can't do the job" is discrimination.
"I don't want to hire him because I hate his racial group" is the opposite of discrimination - it is an indiscriminate rejection.

Part of it has to do with perspective and which side of it you're on. I had this same problem with the notion of "passive restraints" in cars (that is, "airbags"). They're called "passive restraints" when they're an entirely active system, requiring sensors and programming to work, then setting off a small bomb when needed. That's the very definition of an "active" system, not a "passive" one.

Then I learned that they are called that from the standpoint of the *driver*, not the *restraint* itself. The restraint it "passive" with respect to the driver (he does nothing to arm or activate it or use it).

63 I think there's a lot of misunderstanding about the issues in these cases. Ames was not about whether a member of a majority group could bring reverse discrimination claims. It was already well-settled that the member could. The issue was about what the member needed to prove to win the case. That's a subtle but important difference.

The issue in BW is also not about whether a school can discriminate against whites. It's well-settled that a school cannot. The issue in the case is whether a white kid can state a claim for reverse discrimination if the school can also point to a plausible non-racial reason for the conduct: in this case, the kid's political beliefs.

When in high school, in New Orleans, i made it painfully clear that if i suspected racial based bullying towards myself, or anyone else...i'd do to the racist what i was doing to the three dickheads that thought they could bully me. It was an almost instant change in how the other eight or so white kids were treated. That entire school knew how badly i beat those three, and knew full well there would no mercy. That 14% majority of hood rats are like Germans. Either at your throat, or cowering in fear that they hope you don't think they messed with you.

College was much better, so many different groups instead of just a few cliques. Kids aren't considered adults till the age of 18. They are controlled by their PARENTS until that age and really don't have Constitutional rights if their parents don't want them to have them.

Yeah, a jab is a good counter to a cross, but it's a defensive counter. My favorite (and best) way to offensively counter an oncoming cross is... say it's a right cross. You see the opponent shifting weight to launch, you roll your left shoulder down which lowers your head, rotate your hips by stepping out and forward with your right leg, and launch your own right cross with all that shifted weight behind it. It'll get there first and he'll never sees it coming. But if you miss high, you can bust your hand on the top of his head. The all-time classic example is Rocky Marciano knocking out Jersey Joe Walcott, 9-23-52. And that's your boxing history lesson for today.

In re public institutions, you have a central admissions office which is assigned to calculate a composite score for each applicant which is a vector equation of which the variables are board scores, achievement test scores, and high school GPAs. The applicant also returns a pre-printed card on which he has rank-ordered his choices among the state's campuses. (The average state has about 14 campuses).

Speaking on Channel 12 News, Yaari recounted that while visiting the US think tank where he works, two FBI agents approached him without warning and seized his laptop.

“Suddenly, two FBI agents came in and said: ‘We need your computer,’” Yaari said. “They took it apart and then told me—on this day, at this time, the Iranians penetrated your device.”

I reject GPA except in perhaps the most general sense; certainly less than standardized tests. GPAs are based on completely subjective, and often biased evaluations.

Died at 99, a couple months short of 100, from complications from an infection received from a cat bite and scratches on her foot.

He produced/acted in a S American disaster movie Aftershock, where he's a tourist in Chile when a big earthquake destroys the city, and even worse, knocks down the walls of the local prison, so all the murderers and rapists escape into the ruins. Roth and most of the insufferable milennial cast die horrible deaths except for the Final Girl, who escapes to the beach... Just in time for a tsunami to wipe out everything.
