The Supreme Court Has Deigned to Allow Trump to Be President On a Case-by-Case Basis

They're actually allowing Trump to sign an EO to cancel Biden's previous EO granting mass amnesty to 530,000 illegal aliens.

Apparently this is controversial -- Democrat EOs have More Constitutional Power than Republican ones, but the Supreme Court will allow a Republican EO to cancel a Democrat one just this once.

In an unsigned order that seven of the justices backed, the court stayed a district court decision that prevented the Trump administration from revoking Temporary Protected Status (TPS) from over a half-million migrants in the US. The court's order allows the Department of Homeland Security to initiate removal processes for these migrants even while a First Circuit appellate panel considers the case on appeal.

Presumably, seven justices on the Supreme Court recognize that policy control comes with democratic elections as an expression of the will of the electorate. Since the apparent 7-2 majority on this order never explain themselves, we can only presume that they feel Trump is likely to prevail on that basis. We do get a big hint in that direction by the language of the stay: the court has ordered a stay to remain in effect regardless of how the First Circuit rules in due course on the appeal. If the appeal sides with the district court, it will have no effect as long as the White House seeks cert with the Supreme Court "in a timely manner." Clearly, the seven justices -- including Elena Kagan, interestingly -- feel that the Trump administration is likely to prevail on the merits if and when they review the case.

Stephen Milller blasted a CNN reporter for resorting to leftwing euphemisms for "illegal aliens with criminal records as long as the Rio Grande."

Rusty Weiss at RedState:

Brown questioned Miller on the case, using the flowery descriptor of Reyes as an "undocumented migrant." She also failed to note the Mexican national's criminal record while portraying him in an isolated manner as a "victim of a crime."

Miller wasn't interested in playing games.

"I want to clarify what you mean so we're talking about the same thing," Miller replied. "Are you saying this immigrant was here illegally?"


Brown falsely claimed she had clarified her comments when, in reality, she only altered the phrasing from "undocumented migrant" to "undocumented immigrant."

He is neither of those. With a criminal record, he is most definitely documented. And he is neither a migrant nor an immigrant; he is a criminal illegal alien, regardless of what another criminal may have done to set him up.

"You said undocumented, and I wasn't clear what that means," Miller continued, noting that such a word could assert that he simply had a fake ID.

Brown was disgusted with the retort.

"I want this to be, and call me naive, a good faith discussion about what's happening right now," she countered.

Miller shot back, "When we use language that's designed to obscure the truth, that's not good faith. An illegal alien is an illegal alien. They're not an 'undocumented migrant.'"

An important element of this is that the stay allows Trump to actively get these people out of the country. They have less than 30 days to do so legally before they're in violation of the parole. The government has names and addresses of everyone involved.

Everyone's going to be out very quickly.

And the underlying case is going to get moot really fast.

People don't like it when I'm snide about these things, so I'll try to play it straight: Team Trump is letting this stuff all play out, and with each and every one of these issues, not once have they suggested the courts have no authority to dictate what they can and cannot do.

It's hard for me to see this as anything other than a shutout for the courts. Even when they rule in Trump's favor, the bottom line is, he still can't do anything unless a court says he can.

35 Things are doing better than I expected, to be honest. I figured we'd see a mini recession because of the tariffs and the doom saying by the press but... its not happening.

Part of it is probably businesses beathing a sigh of relief with Trump in office, but part of it is is definitely inflation disappearing and people having money to spend. But it is surprising to me, a happy surprise.

64 Little by little, Trump is winning the legal challenges and establishing his presidential power. Yes, there were setbacks and will be setbacks. But as far as I know, there hasn't been a definitive decision on the merits blocking anything Trump did. Most of the bullshit TROs have been rolled back.

Unlike some people here, I think Trump should keep doing this. I get the impulse to say "fuck these judges, Trump should just do whatever he wants to do, up to and including feeding judges to Florida alligators." But that could backfire. So long as Trump is mostly winning, he should stay the course. You don't drop the nuke unless you absolutely have to.

Sure, there is a great built-in protection - Congress and its power of the purse. But since Congress has basically disappeared as a player for a few decades, there is no check and balance.

So while most people think a well designed system has built-in protections, they generally don't. The constitution isn't self-enforcing - nor are laws, as we have seen. It takes will and use of existing authority to check abuses. Congress has disappeared (because voters have allowed it to), and the judiciary is just an unelected capricious super-legislature with mediocre and reckless personnel.

I think they were junior staffers in the Cold War era, absorbing the mechanics but not the ideology of fighting Communism. Look how fast border crossings dropped off once Trump started deporting them. They don't control anime, and will likely find it to match its quirkiness. One I watched, Nadia : the secret of blue water mixed a retelling of Verne's Captain Nemo with some steampunk and ended up with a lot of Biblical allusions before it was all done. Oh and a bunch of filler episodes in the middle.
