Elections have no effect? It's like there's no way to control these people. They act totally independently from the democratic system. That's the problem," Carlson said. ... "That's what I found," Dhillon said. "In response to my memos, it began leaking to the press. They began having unhappy hours, which they would invite supervisors, political supervisors, to make their point that they were unhappy. We got the point. Having read now most of Kendall v. Stokes, from 1838, it's hard to understate just how radical and illegal all these injunctions against Trump are.
The principle there is that, (if I understand it correctly) where the law passed by Congress gives the Executive discretion on how to act, there is no remedy in the courts. Only that, if Congress directs a specific form of action, with no discretion to the Executive (or the subordinate officer) then--and only then--can the court issue mandamus to force the act. As said act purely ministerial. But also, it notes, there is no discretion of absolute refusal of the Executive to act at all should a law broadly direct. (Which remedy they didn't discuss, presumably only impeachment?) So, turning to the Harvard ruling earlier, and now the most recent ruling that Trump can't revoke security clearances: These are the utterly and completely illegal usurpations of Executive power that every Founder and courts for 100+ years since would have demanded the President refuse: These are clear discretionary acts of the Executive which Congress has in no way directed specific performance.
