Left-Wing Supreme Court Rules 7-2 That Trump Cannot Deport Terrorist Illegal Aliens Without a Cumbersome Lengthy Trial

By what right are they here? They have zero legal right to be here, but the soon-to-be-ignored-and-chastened Supreme Court says we have to have trials to deport people who are illegal aliens with no right to even be present.

Roberts and all of Trump's liberal-leaning, Federalist-Society-certified saboteurs voted with the liberal bloc.

When Republican AGs sued Biden over his illegal policy of ignoring the law and dissolving the border, the Supreme Court tossed out their lawsuit, ruling that the President had plenary power to conduct the foreign policy of the country (of which immigration enforcement is a part) and therefore the courts had no power to restrain him.

Now that Trump is deporting these Undocumented Americans, the Court reverses itself and says "You bet the courts have power to overrule the President in his conduct of foreign policy."

Disgusting -- and destabilizing.

The Supreme Court just betrayed Trump on deporting illegal aliens who are gang members under the Alien Enemies Act.

you may be right about "notice," but I don't know. they're affirming the lower court's injunction.

I don't see any ruling on whether these lower courts can issue nationwide injunctions -- which is what the appeal was supposed to be about.

Has nothing to do with ordinary deportations. Tren gang members were being deported under the Alien Enemies Act. (And nothing under this decision prevents the administration from doing just that).

I halfway suspect this is kabuki theater by the Trump administration to get the court to concentrate on the thumb (AEA) and get knocked out by the punch (ordinary deportation measures).

This order makes Scotus look bad to the population as supporters of the right for illegal gang members to stay here. 70-30 to 80-20 against issue.

More fun to light hair on fire for some I guess. Alito's dissent was properly snarky for what the court did here and he pointed out how the court is ignoring its own procedures and rules in order to keep these gang members in the US.

Kavanaugh's concurrence was at least constructive in that he claimed that Scotus should go ahead and give a substantive decision rather than the fan dance with the 5th. Roberts is probably trying to stall past the recess in this rather stupid and uninspiring per curiam opinion.

I'm inclined to agree with you.

However, "minimal due process" in the Midnight Order has become "entitled to the full suite of due process rights the same as a citizen" at the trial courts.

So, it doesn't really matter all that much what the order actually say, only that it has given the radical Judge-Kings enough room to issue more and further illegal orders.

They’re are unevenly wielding power they do not have and ScOTUS isn’t even stepping in hard on clear excesses like the nationwide injunction issue. What ACB did during oral arguments was shocking and seemed to suggest she believes the lower courts have authority over the president. I don’t even know what to say about that. But the fact we’ve watched the courts pass on clear election fraud, J6 persecutions, COVID lockdowns, etc. is fresh in many peoples minds. Now we are watching the judiciary used as a lever to slow down clearly constitutional power exercised by the elected president. These courts don’t deserve an ounce of respect. None.

It says only that detainees be given some kind of notice they are being deported, rather than just disappearing them middle of the night.

I think he lured Scotus into a trap of their own making. And Roberts is too stupid to realize it because he values process over substance. Kavanaugh in his concurrence was warning Roberts about that ironically. He wanted immediate grant of cert and resolving the issue this term rather than waiting on the 5th Circuit and the plaintiffs inevitably seeking a new writ.

And that simply means that the Tren members sit longer in detainment and cannot commit much in the way of new crimes until this is resolved. Already less murders in Aurora and Denver as a result.

Two separate situations. The Tren gang members were swept up off the street by immigration officers and detained before being deported.

The application of the AEA to their cases meant that Trump could (under past case law and the statute itself) deport them without a hearing. Scotus said not so fast in April and renewed this injunction until the 5th rules upon how much notice and due process the party should get and whether the plaintiffs met the necessary conditions for a TRO. Then the Scotus court may reconsider the whole thing if the plaintiffs or government asks for a writ of cert.

That is why Kavanaugh said, why not go ahead and resolve the issue now before recess instead of sending it back to the 5th.

Use the low cost alternative in the desert and make it so uncomfortable (but still humane) that the illegals will line up for their ticket home. And there is an easy way out of this mess the courts made. Arrest them and give them notice they are going to be deported. Assign an administrative immigration judge to their case for a hearing and have that judge order them deported. Nothing in any ruling in this case says they are entitled to a full blown trial to prove they are or are not a gang member. All it says is they are entitled to "due process".

Correct. I said it poorly because people are conflating today's AEA decision with general immigration law. People who do not show up to their deportation hearing get a default deportation order as the due process part of deportation is satisfied. There are some last ditch sort of quasi appeals before shoved over the border like if you showed up late, there was some mistake in mailing the order, lawyer mistakes, etc.

Recently Scotus added an additional stupid qualification in deportation cases regarding business days and required these orders be tolled (counted) subtracting weekends and holidays which is pointless and stupid.

The majority doing this shit for illegals when they ignored American citizens in Jan 6 being denied speedy trials, confrontation of witnesses, discovery, etc. need to be removed from office along with their DC lower court butt buddies. The whole circuit, like Roberts, is a rancid POS mess.

323 Everyone put out the fire on your head. I actually read the decision. It does not say what’s being reported. It has nothing to do with the merits or even say that a trial is necessary. It says only that detainees be given some kind of notice they are being deported, rather than just disappearing them middle of the night.
