When Republican AGs sued Biden over his illegal policy of ignoring the law and dissolving the border, the Supreme Court tossed out their lawsuit, ruling that the President had plenary power to conduct the foreign policy of the country (of which immigration enforcement is a part) and therefore the courts had no power to restrain him. Now that Trump is deporting these Undocumented Americans, the Court reverses itself and says "You bet the courts have power to overrule the President in his conduct of foreign policy." Disgusting -- and destabilizing.

I don't usually think it's good for the president to just say "Enough of this shit" and flat-out ignore all Supreme Court rulings, but this ruling makes that a legitimate option. A caution - Trump isn't strong enough yet to openly defy the Court; he would risk a coup by the Democrats and significant elements of the military; also many still in the bureaucracy. Hegseth and others need at least 6 more months, preferably a year, to clean out and replace all of the anti-Trump elements in their various agencies, and Trump must be quite careful until he gets to that point.

In general the courts are losing substantial credibility with the people. They’re are unevenly wielding power they do not have and ScOTUS isn’t even stepping in hard on clear excesses like the nationwide injunction issue. What ACB did during oral arguments was shocking and seemed to suggest she believes the lower courts have authority over the president. I don’t even know what to say about that. But the fact we’ve watched the courts pass on clear election fraud, J6 persecutions, COVID lockdowns, etc. is fresh in many peoples minds. Now we are watching the judiciary used as a lever to slow down clearly constitutional power exercised by the elected president. These courts don’t deserve an ounce of respect. None.

I must say I have never understood it, the legalities I mean, of deportation. They are here illegally. Why do we even need to jump through things like the Alien Enemies Act? There are already laws on the books. Why do they get even get a hearing? They aren't citizens. Why do they even get a day in court and not immediately deported?

The deportation trials can be handled summarily by Article II judges (glorified clerks). The Supreme Court is compassed by Article III. They essentially have no say in the matter, according to the Constitution, and as such must be ignored.

Everyone put out the fire on your head. I actually read the decision. It does not say what’s being reported. It has nothing to do with the merits or even say that a trial is necessary. It says only that detainees be given some kind of notice they are being deported, rather than just disappearing them middle of the night.

The trick is to play the game. Instead of housing illegals in 5 star hotels and giving them debit cards, house them in barracks style tents in a fenced in enclosure in the middle of the desert. Make it bare bones livable, not somewhere someone would like to be. Follow the court's ruling but make sure the illegals would much rather go back home than stay in the "holding facility".

The application of the AEA to their cases meant that Trump could (under past case law and the statute itself) deport them without a hearing. Scotus said not so fast in April and renewed this injunction until the 5th rules upon how much notice and due process the party should get and whether the plaintiffs met the necessary conditions for a TRO. Then the Scotus court may reconsider the whole thing if the plaintiffs or government asks for a writ of cert. People who do not show up to their deportation hearing get a default deportation order as the due process part of deportation is satisfied. There are some last ditch sort of quasi appeals before shoved over the border like if you showed up late, there was some mistake in mailing the order, lawyer mistakes, etc. Recently Scotus added an additional stupid qualification in deportation cases regarding business days and required these orders be tolled (counted) subtracting weekends and holidays which is pointless and stupid. The majority doing this shit for illegals when they ignored American citizens in Jan 6 being denied speedy trials, confrontation of witnesses, discovery, etc. need to be removed from office along with their DC lower court butt buddies. And there is an easy way out of this mess the courts made. Arrest them and give them notice they are going to be deported. Assign an administrative immigration judge to their case for a hearing and have that judge order them deported. Nothing in any ruling in this case says they are entitled to a full blown trial to prove they are or are not a gang member. All it says is they are entitled to "due process".

Everyone put out the fire on your head. I actually read the decision. It does not say what’s being reported. It has nothing to do with the merits or even say that a trial is necessary. It says only that detainees be given some kind of notice they are being deported, rather than just disappearing them middle of the night.
