Federal Judge Upholds Trump's Power to Use the Alien Enemies Act to Deport Tren de Aragua Gang Members
A federal judge on Tuesday said the Trump administration can invoke the Alien Enemies Act (AEA) to deport criminal illegal immigrant members of the Venezuelan Tren De Aragua gang, but that it has not given adequate prior notice to those subject to removal, before those deportations can take place, which would allow possible due process and habeas legal challenges. The 43-page ruling by U.S. District Judge Stephanie Haines, a Trump appointee, conflicts with other rulings challenging the administration's deportation efforts. "Having done its job, the Court now leaves it to the Political Branches of the government, and ultimately to the people who elect those individuals, to decide whether the laws and those executing them continue to reflect their will," Haines wrote.The decision is here.

I read the decision. On the one hand, it's a great ruling that AEA can be used to deport criminal illegal immigrant TDA members (and presumably any other group identified as terrorist). That's what Trump wants.
But the devil is in the details, and the judge's ruling on what notice is required seems to create an exception that will swallow the rule. She specifically mentions that notice should be enough to allow a habeas petition. That could tie the whole process up forever, which completely undermines the whole purpose of using AEA to get these criminal scum out of the country.

Rikers is NYC, I think. Or mebbe NY state. Not federal prison. This sort of thing has been done before going all the way back to the 70's.
That being said, the major problem with any large incarceration facility is that they are full of criminals and end up corrupting guards to continue to be criminals inside the institution.
And due to the 8th Amendment, they get all sorts of bennies mandated like medical care, an excellent legal library, etc. or it is cruel and usual.
So the inmates run the asylums. Guards are there mainly to keep them from getting out.

But the devil is in the details, and the judge's ruling on what notice is required seems to create an exception that will swallow the rule. She specifically mentions that notice should be enough to allow a habeas petition. That could tie the whole process up forever, which completely undermines the whole purpose of using AEA to get these criminal scum out of the country.

Prison litigation in California is responsible in part for Gavin simply opening the doors to release prisoners wholesale. Claiming that the judge made him do it.
The truth is the penitentiaries by and large have failed. They do not rehabilitate much, simply store the criminals for a bit, and then return them to society often to be even more effective criminals in the future. Actually, reverting to standard immigration law gives them less opportunity to challenge deportation than the AEA does. Unless Congress suspends habeas corpus which removes the judiciary entirely including Roberts. If he challenges that, the whole judiciary is going to get a bloody nose.

You would think that the entire arrest and detention process would have been tuned to be essentially petition-proof by now. "You are being detained for this, specifically. It is legal because of these statutes, specifically. Now shut up and get deloused." Especially if these detentions are by and large for the exact same handful of things over and over again.
How can you have a justice system where a criminal can just say "nuh uh" and avoid arrest and detention entirely? That's what the trial is for, right?
And if they did arrest and detain you illegally, you can sue their balls off because no jury on earth will find against you.

As a technical side note, still à propos, did you ever notice that a foreign made FM radio tunes much lower than American models, and could at one time (before digital) be used to listen to TV audio? There used to be FM radio stations in that lower band, in the 1930s, in America. Who listened to those new-fangled FM stations? Not the common man: it was the Great Depression. The rich bought the new FM receivers and the new FM stations catered to their listeners: they were all anti-FDR. So what does FDR do? He gets the FCC to shut them down, and allocate their frequencies to the up-and-coming TV broadcasters. TV started using those frequencies really only after the war and FM radio only came back, with higher frequencies, later than that. Can’t have any dissent on the public airwaves! Fascist indeed!

This decision sucks. Gives the gangbangers 21 days notice before they can be deported. Which means 21 days to let their lawyers gum up the works, which then will have to be dealt with for months in the judicial system.
