I read the decision. On the one hand, it's a great ruling that AEA can be used to deport criminal illegal immigrant TDA members (and presumably any other group identified as terrorist). That's what Trump wants.
But the devil is in the details, and the judge's ruling on what notice is required seems to create an exception that will swallow the rule. She specifically mentions that notice should be enough to allow a habeas petition. That could tie the whole process up forever, which completely undermines the whole purpose of using AEA to get these criminal scum out of the country. That being said, the major problem with any large incarceration facility is that they are full of criminals and end up corrupting guards to continue to be criminals inside the institution. And due to the 8th Amendment, they get all sorts of bennies mandated like medical care, an excellent legal library, etc. or it is cruel and usual. So the inmates run the asylums. She specifically mentions that notice should be enough to allow a habeas petition. Because the historical examination invoking similarities to pirates of the time it was enacted is precisely the grounds needed to get 5+ votes at SCOTUS. The 21 days is made up whole cloth and will be rejected. And, keep in mind, this statute isn't being used to deport all illegals, and will not be--it only is being applied to MS-13 and TdA. So, it's a few thousand to tens, at most. Note also, this same judge denied the ACLU's request to grant this plaintiff standing as a class action. All of these legal gymnastics, twisting and contorting the 'law' into something completely unrecognizable makes me start losing faith in the so-called justice system. As a technical side note, still à propos, did you ever notice that a foreign made FM radio tunes much lower than American models, and could at one time (before digital) be used to listen to TV audio? There used to be FM radio stations in that lower band, in the 1930s, in America. Who listened to those new-fangled FM stations? Not the common man: it was the Great Depression. The rich bought the new FM receivers and the new FM stations catered to their listeners: they were all anti-FDR. So what does FDR do? He gets the FCC to shut them down, and allocate their frequencies to the up-and-coming TV broadcasters. TV started using those frequencies really only after the war and FM radio only came back, with higher frequencies, later than that. Can’t have any dissent on the public airwaves! Fascist indeed!
Uhh, not really. Sarnoff of RCA had the FM band changed well after FDR died. FDR had nothing to do with shutting down the Armstrong FM network. The new fangled invention, TV, was to use FM for audio and the band was allocated to TV and other uses. Original TV standards used AM for audio. This decision sucks. Gives the gangbangers 21 days notice before they can be deported. Which means 21 days to let their lawyers gum up the works, which then will have to be dealt with for months in the judicial system.
