In a surprise to nobody with a pulse, it turns out that the government is as recalcitrant as ever when it comes to FOIA requests. The linked article focuses on the delays in some agencies due to their gutting by DOGE, and the closure of some FOIA-focused offices in other agencies. The Trump administration is better in regard to transparency than others have been, but FOIA remains a poor process fraught with willful and coincidental delays. FOIA is a bureaucratic process and one must expect delays with any bureaucratic process, but FOIA has long seemed particularly bad. Agencies despise FOIA and don't exactly bend over backwards to comply with it. FOIA violations are rarely punished and disclosures are always slow-waked whenever possible. This is part and parcel with FOIA and the Act has never worked the way its writers intended. This is at least part, I think, because FOIA was badly founded and hasn't kept pace with the times or technology.The problem with FOIA's basis is an assumption of secrecy. Agencies - all agencies - are allowed to keep secrets and everything is secret by default. If you make a FOIA request, it's right there in the name, at least colloquially: it's a request. A request is subject to denial. This should never have been permitted. It should have been a FOIA demand or a FOIA order. Demands can be rejected or orders disobeyed, but the expectation that it is a mere "request" should never have been the norm. But by this point in the state of common technology, however, even FOIA demands should be superfluous. FOIA should have been repealed and replaced at least twenty years ago, and its assumption of secrecy thrown out with it. This country is, after all, a rePUBLIC. Governance should be performed in public, by default. There should be no default secrecy and no assumption that an agency is allowed to not disclose something. All government activities should be public and available to the public from the start, with no demand for information needed. No government document, E-Mail, contract, memo, etc. should be private in the first place. There should be no need to demand access. Access should be public. Access should be on the web, using the same organizational structure as the agency. If Agency X, Directorate Y, Group Z, Team 2 produced a document or a sent an E-Mail, it should just be immediately published unless it has to do with a contract currently in the bidding process (in which case it should be published - along with all other materials - the day the bid closes). The government has no trade secrets (it does not engage in trade). The government has no expectation of - or right to - privacy (they are public servants). Under normal circumstances, personally-identifiable information ("PII", which is both an industry and government standard) should be stripped and then the material published. Immediately. If information is formally classified, it can remain private. In that case, a stub entry should be created and published. The system should tell you that a document, memo, E-Mail, etc. exists and which part of which agency produced it, even if the document itself is not disclosed. This - inappropriate classification - should be the only place for a FOIA-type demand. "I know you made it, I know it exists, and I think it's BS that it's classified. I want a review." Other than that, or if you can argue public interest in the exposure of PII, the information should just be available from the start and as the norm. So "FOIA is under attack" per those paying attention, and I have no reason to assume that this is hyperbole. This is not, however, new in any way. FOIA has been "under attack" since the moment it was passed. FOIA has been the focus of obstruction and non-compliance as long as it has existed. No bureaucrat has ever wanted to comply with it in the first place, and no one sentenced to a FOIA office has ever gone out of his way to make the process smooth or effective. FOIA doesn't work, has never worked and never will work. Where you can drag information out of a FOIA office, it will be incomplete and redacted unless you bull-dog them for months and even then your odds are poor. So just get rid of it. FOIA is unfit for purpose. Repeal it and replace it with default-transparency laws, with demotions and terminations for non-compliance and jail time penalties for chronic non-compliance or inappropriately classifying materials. This is a public government, and we have the technology to enforce that. So do away with FOIA. Do away with default secrecy. Do away with "requests." This is a problem even in states with fairly strong (on paper) open records laws. Agencies (especially school boards and law enforcement) will fight tooth and nail, kick, scream, claw, bite, and use everything they possibly can to either make it so expensive you can't follow through or utterly demoralize you until you give up. The assumption that government agencies of any kind should by default operate as an impenetrable black box is Stalinist bullshit and has no place in what is supposed to be (again, on paper) a republic of free people.

In a previous life, I spent a lot of time filing the state-level version of FOIA requests in a state with, on paper, very transparency promoting laws. If the clerk on the other end doesn't want to give you the info, you have to sue. They still might not turn over the info. You then need to get an order from a judge saying they have to turn it over. Then the state appeals. Then the state wants an ex parte in camera meeting with the judge to say god only knows what. Eventually after years of time and lots of money wasted, you may get a heavily redacted document. Or they might say they destroyed the records in the course of business. And nothing happens to anyone involved here. The Court says "well, shit. Guess you're out of luck, bud" and no one gets in any kind of trouble for ignoring the law. Having worked in the ever hated government, I can tell you that not everything is considered secret, that there are levels of disclosure and nondisclosure, and those rules are set pretty much in stone. I worked where many items could be considered risky to national security, and even then most things were simply CUI and not secret. Part of the situation was because of federal rules concerning bidding on contracts, wherein many things needed to be held close to the vest to ensure fair bidding procedures. Other things had to do with what was being built and its purpose, often to do with things that could not be disclosed for security purposes. However, most things, if requested, could be discussed or revealed once bids were awarded.
Generally, our lawyers sided with caution when releasing information. Not everything can be told to everyone, and that is just a fact. Outside of the military, however, I don't see a lot of things being held close to the vest once an award is made. Seems like EPA crap, regulatory crap, results of various studies and even most judicial stuff could be made public without too much damage. Now, let's talk about Congress and the critters therein... There should be no default secrecy and no assumption that an agency is allowed to not disclose something. All government activities should be public and available to the public from the start, with no demand for information needed. No government document, E-Mail, contract, memo, etc. should be private in the first place. There should be no need to demand access.

I would like all final, executed Government documents to be immediately made public, but the idea that the process by which that document became finalized should be public is asinine. In my past position, as a supervisory agent, it was not at all unusual for a Report of Investigation to be drafted as 'substantiated' during the investigative process, only to have our Agency learn new and compelling information from a late witness/document and reverse our position - and vice versa. That's because it's hard for a small group of people, no matter how smart, to look at all the unforeseen consequences of any decision. IMO the Epstein files will never be made public in their entirety. Because there are too many government officials still alive that were involved.
During today's cabinet meeting RFK Jr made, to me, a rather stunning but not unbelievable remark. He mentioned that the *biden administration's HHS was involved with the trafficking of children. I think everyone knows that there were likely some people in his administration that are capable of this, but someone in an official position came out and said it, live. There's a lot of nibbling around the edges of this topic and the degree of government involvement. But it will be kept from the public, not because it's a secret but because it'll embarrass a lot of people. That they'll face criminal prosecution over it is almost laughable. I read a story recently where they had records in Japan of a tsunami from hundreds of years ago that should have hit the pacific northwest as well.

I read a story recently where they had records in Japan of a tsunami from hundreds of years ago that should have hit the pacific northwest as well.

FOIA is nothing but a game to most bureaucrats. In my experience, those responsible for responding are usually being punished for some office crime and are not long for the position. When the occupants of those chairs finally move on, the request moves back to Square One.
We have an outstanding FOIA request from 2018 with the Department of Energy. DOE sucks anyway, but their FOIA desk is never occupied by a living being in possession of a brain. When someone new comes along to "fill the position," then the request is moved back to the bottom of the stack, as though it was just received yesterday.
