Lower courts will be stripped of many of their powers that were never actually granted but have been accepted. or Marbury v. Madison is going out the window completely because it only exists as caselaw because the executive allows it to be. It has been allowed because the judiciary has traditionally used the caselaw established there rarely. There are exceptions throughout American history, and things did ramp up with the Warren Court, but lower court judges telling the president how to conduct foreign policy is so very blatant and Trump's team so dedicated to a unitary executive, that Trump's team will be willing to pull that trigger. It has been allowed because the judiciary has traditionally used the caselaw established there rarely. The people who wrote the Constitution expected the people writing laws to be well acquainted with the Constitution and write their laws accordingly. I will say the Trump cabinet members need to get their act together and release accurate statements. I'll chalk it up to not havint worked at this level in the past. I saw a report where they released confusing stats stating Trump put a 254% tariff on China... The fact they even admitted to a paperwork error about deporting the Maryland Man was stupid. So Boasberg is going to hold people in contempt based on an order he issued verbally in a matter he had no jurisdiction over and now he’s saying that even though his order was invalid he can still hold people in contempt because all judges rulings must be upheld at all times until they are successfully appealed by a higher court.
This guy is fighting this fight solely to establish that he and the rest of the rogue judges can do what they want, when they want, with presidential powers because they said so, and the administration has to do what they say until another court tells them they don’t have to do what they say or have to do what they say for the sole purpose of tying up Trump for as long as possible by having multiple judges issuing orders every week and then weeks or months for the judiciary to decide if the president can exercise his presidential powers or not.
