The Director of the Federal Housing Finance Agency Refers Corrupt NY AG Letitia James to the DOJ for Committing Blantant Mortgage Fraud

Oh frabjous day!

In applying for a mortgage, she claimed a Virginia property was her primary residence, while serving as a NY official.

She did this because mortgages for first (primary) residences are cheaper.

She also apparently claimed that her father was her husband because married couples get breaks on mortgages.

She signed all this. This is fraud, on its face.

New York Attorney General Letitia James was hit with a federal criminal referral for instances of alleged mortgage fraud on Tuesday, according to a letter obtained by The Post.

Federal Housing Finance Agency (FHFA) Director William Pulte sent the missive to Attorney General Pam Bondi and Deputy AG Todd Blanche, alleging that James had "falsified records" to get home loans for a property in Virginia that she claimed was her "principal residence" in 2023 -- while still serving as a New York state prosecutor.

That occurred in late August 2023, weeks before James began her civil fraud trial against the Trump Organization for over-inflating the values of many of its properties, which ended in a $454 million judgment.

In February 2001, James also purchased a five-family dwelling in Brooklyn -- but has "consistently misrepresented the same property as only having four units in both building permit applications and numerous mortgage documents and applications," the letter noted.

That fraud was also committed to get better mortgage terms for a four-residence unit.

Pulte attached several documents also showing that James purchased another property with her father as a co-signer -- but falsely listed the pair as "husband and wife" in 1983 and 2000.

"While this was a long time ago, it raises serious concerns about the validity of Ms. James representations on mortgage applications," he wrote.

..

The letter referenced earlier media reports about purportedly falsifying her residence status to get a lower mortgage rate in Virginia and misrepresenting her five-unit residence in Brooklyn, that were first reported by the outlet White Collar Fraud.

James granted power of attorney to Shamice Thompson-Hairston, a relative, to sign an Aug. 17, 2023, document authorizing the purchase of the first property, according to legal filings reported by the outlet.

She secured a $218,780 mortgage to do so.

So she assigned a relative the power of attorney to sign documents on her behalf, so it's her relative signing her name to the fraudulent loan documents.

I call this "intent." And also, intent to compound the fraud through further deception.

Loans secured for the latter property could have reduced her mortgage interest rate by as much as 1% and had lower monthly payments under the federal Home Assistance Modification Program (HAMP) since it was listed as containing just four units, according to Pulte.

"Ms. James, for both properties listed above, appears to have falsified records in order to meet certain lending requirements and receive favorable loan terms," he told Bondi and Blanche.

That could amount to criminal charges, including wire fraud, mail fraud, bank fraud and false statements to a financial institution, among others, Pulte added.

Meanwhile, this nasty Longtime Bachelorette is conjuring new charges against Trump:

The criminal referral dropped the same day James' office confirmed it was preliminarily scrutinizing whether insider trading was in play regarding the 90-day pause President Trump put on "reciprocal" tariffs last week.

Jonathan Turley discussed this case with Laura Ingraham.

I have a dream: A dream where this softball all-star and beefy linebacker gets locked in a cell with Fani Willis and her itchy cooter.

Continuing patterns of behavior are often allowed in as evidence in a current case even though statutes of limitations may bar prosecution of those offenses. Common in mob trials.

My guess is Tish has a pattern of illegal activity going way back of all sorts of things. Basically if you are willing to commit one crime, then the second, third, fourth, flow from that. Basically, because it appears the entire state of New York and local governments are criminal organizations with criminal officeholders, most will not stand up to scrutiny that the feds can do if they want to.

Speaker Silver, for example, or Majority Leader Bruno. Illinois is a similar criminal state.

"I didn't like your answers and and your refusal to answer and, since I can't force you to answer under the clear ruling by the Supreme Court and the Constitution, I'm just going to assume you committed contempt."

Pretty fucking flimsy stuff to lob against the President and the Executive.

Relevance arguments are easily overcome which is 403. Relevance is only useful when literally no one cares or should care about the evidence.

It would be more 404 Character Evidence and perhaps 406 habit (if you can establish that Tish routinely lies on document submissions for example).

I'd imagine that Tish probably lied on other financial documents such as statements to banks over car loans, credit cards, etc. Those are just less obvious but habit and character exceptions often allow such things to be allowed as evidence.

Good morning. I was keeping a list of them for a while and it was up to something like SIX Black female corrupt officials. I was wondering wtf until I reflected on some Thomas Sowell wisdom that didn't make sense to me at the time but does now -- and you'll need it as the charges of racism and misogyny keep coming as more of these ladies are caught.

Sowell advised Black Americans NOT to seek high political status as a path to power, but to seek high economic status -- that's where power lies, and politicians will do what you want if you've got money.

Instead, Black people are jumping in on high political office without having worked their way up or experienced a generation or two of high economic status. Unprepared, they're dazzled and corrupted by the power and money sloshing around. They should just be hard-working middle class stiffs but white liberals keep assuring them they're fit to be bosses and leaders.

209 FWIW, Rule 403 Relevance (if using the Federal Rules of Evidence) is often what you see in scripts, etc.

In real life, 403 is not used as much because a) it is a low bar to argue relevance in many cases. IN this case, I would argue Tish's past record of lying on mortgage and lending documents are entirely relevant to the current charges of mortgage fraud.

Goes to Tish's motivation to get better terms by lying to financial institutions and indirectly to the federal government as well as explaining her ability to do so. Her legal training, as a lawyer of the NY bar, creates a high likelihood that she understood what she was doing was a crime by deceiving by statements to the financial institution to get better terms.

Or something like that. Make a relevance objection in front of a jury and it allows you to preach why the fact is relevant and this often opens the door to statements detrimental to the objector's side. You can't unring a bell and even if the judge rules against you, the jury heard the objection and statements made to overcome that objection.

It is best used when the evidence is truly irrelevant or immaterial to the case. Aka timewaster of the court.

Married people don't get breaks on mortgage rates--the left would have a conniption fit if that were the case. Instead, James probably needed her father has a co-signer (for either credit or debt ratio concerns). She probably assumed that if father pretended to be husband that the co-signer would cause the application to be further scrutinized about whether the purchase was truly to be "owner occupied" (rather than "investment", which would have carried a higher interest rate).

Its still loan fraud. And she signed a warning at closing that states the FBI prosecutes loan fraud.

The new narrative I see getting pushed boils down to Austin Metcalf, who was probably close to legal majority age, not being subservient enough. Even though it was a team tent, he should have gotten a coach to eject Karmelo Anthony. He should have let the black kid sit wherever he wanted because black people "ain't gonna sit in the back of the bus no more." Austin should have backed off when Karmelo threatened him, because clearly Karmelo had a deadly weapon (it wasn't clear, since Karmelo had his hand stuck in his backpack [like a coward, IMO]).

Austin was the captain of a Texas high school football team. "Subservient" probably wasn't in his nature other than his faith.

Taxes did not enter the case, had nothing to do with it. Tax agencies do not allow you to assess your own properties anyway.

Every legal commenter on the planet said people exaggerate or give the top numbers on their assets when they apply for loans, and banks routinely, if not formulaically, adjust for this. The bank Trump borrowed from had NO complaint AT ALL about the loan and considered him such a good business partner that they did business with him again, or said in filings that they'd be happy to, can't remember which.

It's probably up there somewhere, but can someone enlighten about the judicial process? The FHFA refers her to Pam Bondi, who does or doesn't press charges, and James is tried in... NYC? Virginia? Either way, no reasonable prosecutor would waste money on that case.
Posted by: Blonde Morticia

Disputation of jurisdiction is common but the offense occurs where the crime was committed. E.g. I would think Virginia is probably the most reasonable in this case absent any other information. The property was there, the document was proxy signed by her representative there, and so forth.

In crimes like this, you don't actually have to be in the jurisdiction when the crime occurred. Aka a mob boss ordering a hit in SC when he is in NY. The conspiracy was executed literally in SC when the hit occurs so the mob boss has to stand trial in SC.

That is what Tish claims but her problem on appeal is that Fake Judge Engoron took over valuation personally of which he is unfit to do. Such as grossly undervaluing Mar a Lago property.

For the most part, you use a certified appraiser which Trump did that put a favorable valuation on his property sufficient for good terms, etc. The lender is expected to do similar due diligence as to determine whether the collateral is there in case of default. They had no problem with the collateral stated. Then Tish and Engoron, her henchman, decide that both Trump and the bank are wrong and that the real evaluation is what they say it is.

That creates a problem for the prosecution on appeal as well as jurisdictional questions about the whole deal of Engoron grossly exceeding the limits on his office without a jury and fines that well exceed the proportionality of the offense aka 8th Amendment.

NY way undervalued Trumps FL Mar A Lago property.

Eric Trump railed against a judge’s valuation of his father’s Mar-a-Lago resort in a New York fraud case, claiming the Florida property could be worth over a billion dollars.

“In an attempt to destroy my father and kick him out of New York, a judge just ruled that Mar-a-Lago, in Palm Beach Florida, is only worth approximate ’18 Million dollars’…Mar-a-Lago is speculated to be worth we’ll over a billion dollars making it arguably the most valuable residential property in the country. There was one guy who fancied himself as a knockoff meteorologist, always giving weather reports.

He was annoying as hell.

312 But, these judges rulings are no different than a member of the House writing a letter and declaring it the "law of the land."

They are not rulings of the Judiciary, as a whole

They are also not part of the coequal branches of the federal government; they are constitutionally a creation of congress. The Supreme Court is the coequal judiciary branch. These guys are agencies like the FBI and the congressional committees.

They have no jurisdiction over the executive department as a body.

317 Apparently the hatch on the Girl Power space flight, opened from the inside, after they landed.

The problem is, Bezos came along moments later with a tool, to open it from the outside and let them out.

So did they just screw up by opening the door?
Or was it all faked?

I don't know, but it's an interesting question:

My theory (just as good as anyone elses) is the filler, botox and fake boobs kept them afloat and was filmed at Universal Studios.

It was all so retarded and I did not watch nor care. I did see a photo of him doing a face plant opening the "cargo" door from the dome tent, after one of the dingbats opened it.

Some people saw demonic symbols in their little patch for their space uniforms, figure hugging for the fake butts of course. Perry is supposed to be Satanic.

This concludes my report of news of this lame event with Oprah's girlfriend.

And the judge excluded any evidence of valuation.

That is, the judge and the judge alone, decided what the property should have been valued at--rendering an expert opinion with none of basis facts or the methods used entered into the record.

That right there is enough to void the finding--let alone the lack of qualifications of the judge as an expert in real estate valuations.

390 349 If I recall correctly, they changed how you open the capsules NASA built after Buzz Aldrin popped it open at the wrong time and sank one. But that might just be one of those myths going around.

Posted by: Christopher R Taylor
=======
FWIW, It was Gus Grissom in his Mercury Liberty capsule. The claim was that the explosive bolts detonated without being touched. They finally recovered the capsule from miles deep in the ocean in the last decade or so. Dunno about any post hoc evaluation but NASA changed the action after that requiring more action from the astronauts to get out.

That doomed the Apollo 1 crew from an on the pad TRAINING exercise from getting out as the complexity of the procedure could not be carried out before the astronauts were overcome by poisonous fumes and heat.

Gref or Pawn perhaps would know a lot more about it.
