Again, and I cannot take credit for this revelation, but the federal courts are a creation of the legislative branch of the government, and are not able to rule on any of the three coequal branches of government. It is unconstitutional.
You can tell by how they cannot overrule the Supreme Court: it is one of the three coequal branches of the federal government. It doesn't say anywhere in the constitution that the Supreme Court's rulings are not assailable by lesser courts, its just part of the system. They can rule on individual persons on the three branches, doing things that are illegal, but they cannot overrule a law passed by the legislative branch, or an executive action by the executive branch any more than they can overrule a ruling by the supreme court. That's the key, and that is what Trump's team should be arguing. It doesn't matter what a lesser court says about Executive Orders, even if they are blatantly illegal and unconstitutional: they have no jurisdiction. Oh, plenty do. But when the numbers are too great and the density of population too significant, its much less likely to happen. There is a big difference between, say, the mass of immigration in the early 1900s and now, in that even groups like the Italians and Sicilians who made up their own sections of cities and spoke largely their own language at home wanted to be American and were very patriotic. My grandfather who came from Denmark through Ellis Island in the very early 1900s was immensely patriotic and loved America, he learned English soon as he could. Mind you he had an accent so thick I had a hard time understanding him sometimes but he really did try. I am not convinced most immigrants these days even have that sort of attitude.
