Sefton: sefton at cutjibnewsletter.com | Judge Okays Trump Executive Order Requiring Illegal Aliens to Register Their Names and Locations with the GovernmentThe law already existed -- it just wasn't enforced. The Supreme Court also ordered Trump to seek the return of the MS-13 member he deported.... eventually. This is confusing. The Supreme Court ruled that the district court overstepped its bounds in ordering Trump to perform his foreign policy function the way this AWFL shitlib wanted. Now they're kind of saying the same thing... but also warning the AWFL shitlib who is managing the case that she mustn't overstep her bounds by presuming to tell the president how to conduct foreign policy. (Deportations are considered part of the conduct of foreign policy.) So: Does Trump have to try to get this Solid Citizen back or not? It's unclear. The Supreme Court is confused on the point. Shooting from the hip here, it seems to be saying that while a district court has the right to demand that the government produce the guy (this was a habeus corpus case of action originally, right?), but that the court can't actually force the President to repatriate this guy from a foreign country. In other words, the court can't interfere with foreign policy, but as a general rule, the government can't just fly people out of the country to avoid producing them in front of the court. I think. As I understand it, if the person gets turned away at the border -- no right to due process. Leave. If they make it in to the interior of the US, then rights to due process attach. Thus why border patrol was ordered to bring people in to the country for "processing" while their asylum claims were being adjudicated. Because once they're here, it's hard to get them out. That said, the "due process" here is not like a criminal trial in front of a jury. It should / could be done very quickly in front of ALJ's. "You here legally?" "nope." "afuera!" There’s hundreds of thousands of cases where you can make a case someone was wrongfully convicted . The requirement applies to everyone 14 and older without legal status, including long-term residents and Canadians who remain in the U.S. more than 30 days. Registrants must provide fingerprints and an address, and minors must be registered by a parent or guardian. The Trump admin knows this will be physically impossible. Dred Justice Roberts kicked it back down the the district court to redo their homework re balancing government powers as to delineate what the district court thinks its judicial powers are versus the already established caselaw about the executive's foreign powers. It gets confusing as we have to separate out deportation laws which grant rather pro forma hearing before an administrative lawyer (deportation per se of someone not a citizen is not considered denying them liberty for example). Trump admin has to orchestrate a "race to the courthouse" with a proxy public interest group assembled to satisfy standing and rush a complaint against the latest EO before a pro-Trump judge who will deny the relief requested and give the Trump admin res judicata grounds to disregard contradictory orders from Hawaii.
This whole brouhaha is happening partly to hamper deportation but also to manufacture a claim that Trump is disobeying the courts as grounds for impeachment. Thus why border patrol was ordered to bring people in to the country for "processing" while their asylum claims were being adjudicated. Because once they're here, it's hard to get them out. Pretty satisfied with the administration's operation to change the pool temperature for illegals. They're slowly systematically ratcheting up the disincentives to no self-deport. Using the (outrageous) CBP "app" to inform those that used it to enter they need to leave. Dangling (not sure how firm or how well-based on actual law and authority) the idea that not self-deporting may lead to long-term bans on visas or return. Citing existing law to suggest $1K/day fines may be applied to those not self-deporting.
Now this. Trump signaled a (very very long over-due) offensive against "sanctuary" lawlessness yesterday. Not clear what the levers will be. Tragically much of this lies in a gray area of federal/state power - so guess which way things fall (so far). As a move that has no political downside and potentially some upside, I've long favored the obvious approach: appropriations legislation stating "no funds appropriated by this or any other act shall be disbursed until the jurisdiction receiving funds has been certified by the DOJ and DHS to be fully cooperating in immigration enforcement". Make Congress vote on it. Walk the plank, beyotches. Posted by: rhomboid at April 11, 2025 01:51 PM (1m82a) 224

Dangling (not sure how firm or how well-based on actual law and authority) the idea that not self-deporting may lead to long-term bans on visas or return. Citing existing law to suggest $1K/day fines may be applied to those not self-deporting.
Posted by: rhomboid ======= That dangling is indeed the immigration law. If someone has a deportation order, then defying it becomes a) a criminal charge and b) either the long term ban on even a visitor visa or permanent barring. Posted by: whig at April 11, 2025 01:56 PM (ctrM5) 242
As El Mariachi just said, the guy is "removable" and was made so under normal immigration process. I believe the only asterisk was that he was not removable to his home country, due to (deemed) well-founded fear of retribution/something from a gang there. So he was allowed to stay. However, that fear issue was mooted by .... Bukele cleaning up ES and destroying/imprisoning the gangs. Dunno, maybe another immigration review was needed, and should have concluded fear of gang issue moot, and out you go.

whig thanks, as always you've got the goods. In this case however I was referring to the administration's savvy dangling of the threat to those who have not undergone any "process", and thus have not been officially made removable. It's more of a general threat designed (like all the most steps) to ramp up pressure to self-deport.
Yes the options for prosecuting people "in the system" are well-founded in law. But most of the illegals in the country are not in the system. At a minimum, all those here since '86 who've never in any way engaged with the system. And AFAIK the status of the zillion fake asylum petitioners (the bulk of the flow under Biden). As I understand it, this threat was presented as a policy matter - and the weak point there is ..... return to calamitous idiotic Dem misrule in the WH, where the policy would be nixed in 24 hours. I might have some details wrong but overall again I am impressed with the systematic moves to maximize self-deportation incentives. Even without a judiciary off the rails and sabotaging the USG's legitimate actions, the complications and resources to actively deporting over 10M are daunting. I think even the fittest amongst us should avoid crowing about how amazing they are and how dumpy anyone not perfectly sculpted is- instead, try meeting people where they are. Supporting appropriate, sensible and sustainable changes in behavior toward food and exercise is far more effective. Embracing even the smallest effort toward health, where that conversation is appropriate and solicited, ends the can’t cycle and begins the can do. 292 Doing okay. Keeping my shit colostomy bag for three extra months; doc says improves the changes of a successful reconnection. Human plumbing is much harder to fix that house plumbing...
Posted by: jim (in Kalifornia) at April 11, 2025 02:08 PM (ynpvh) I'm leaning on the side of doing whatever it takes to make that a successful situation. My dad wanted his reconnected, but because he had no colon whatsoever, they couldn't do it. Posted by: Sponge - F*ck Cancer at April 11, 2025 02:10 PM (Zz0t1) so less than a semi-colon... Fatasses with sedentary-women level of activity?
Yeah, 1500 until they get to a good healthy 160 or so is probably about right. - That’s not what they require, though. 1500 calories is a bare minimum for losing weight, and it’s unsustainable in the long run. 160 pounds? Lol, you’re a manlet. Explains a lot. Posted by: Disinterested FDA Director - Ah, good. The ad hominems have appeared. Everyday is another existential nail biter election for our nation with these judicial activists. There was nothing like this during the Biden Regime, despite all the daily insanity, criminal and unconstitutional acts.

"facilitate" is such a John Roberts weaseling.
Like, just what the f do you mean? Say or say not, you have used a meaningless "action" word. Posted by: People's Hippo Voice at April 11, 2025 02:17 PM (JpbSW) 305
Those 4 year olds are very active, right? Did you mean to make my point again? Posted by: Boron Cobbie - Women only need 1200 calories Ha! Okay, friend. I don’t think even you believe this, because surely someone who is as well versed as you on nutrition and caloric requirements understands the height and weight part of the equation, amongst the rest of the considerations versus just throwing out a number. Does an alien (illegal or otherwise) have a 2nd amendment right to a firearm?
“The right to keep and bear arms shall not be infringed” Are they people? Yup. You might not like the idea, but it’s amusing to watch our betters in robes try to get around this. They have to keep a thin veneer of legitimacy whilst they shred all intent of the Constitution. Aliens, of course, can be ejected forthwith. The End. They’ll never admit this, thus the pretzel logic and muddying the waters to try and make it look deep. Posted by: Common Tater at April 11, 2025 02:28 PM (kmhyd) 309
Anybody else remember the PSAs which used to run in December notifying ALL aliens (legal and illegal) that they must register at the nearest Post Office by the end of January?

Trump is ordered to try and get him back, 'facliitate'.
The district court has to clarify what is meant by 'effectuate' his return. The Supreme Court said treat him as if you hadn't made the mistake of deporting him to El Salvador. The judge has mistaken this for 'return him to the US'. Trump can send him to another country. Posted by: MikeN at April 11, 2025 03:50 PM (HVZOH) 311
