THE MORNING RANT: Case Filed with Supreme Court Addresses if Civil Rights Act of 1964 Applies to Discrimination Against Whites (and this case is personal)

Does Title VI of the Civil Rights Act of 1964 - which prohibits discrimination on the basis of race, color, and national origin in programs and activities receiving federal financial assistance - protect white individuals from racial discrimination, in addition to protecting minorities? The Supreme Court may soon weigh in.

A petition for a writ of certiorari has been filed with the Supreme Court (e.g. a request for the Supreme Court to hear the case) in the matter of Brooks Warden versus the Austin Independent School District (“AISD”. Brooks is being represented by the Center for American Liberty, which was founded by Harmeet Dhillon. This is the same Harmeet Dhillon who was just confirmed a few days ago by the U.S. Senate as the new Assistant Attorney General for Civil Rights. Also on Brooks’ legal team is attorney Ilya Shapiro. They constitute some nice legal firepower

Before I go any further, I’d like to note that as important as this case is for the country, it’s also a bit personal to me, because the minor - just 12 years old at the time - who was the victim of institutional racial oppression at taxpayer funded public schools is also the son of personal friends of mine. I became friends with Monte and Brandi Warden not because of politics, but because of shared musical interests. However, when Monte, Brandi, my wife, and I met for coffee recently, the SCOTUS filing involving their son was obviously a major source of discussion.

This is a case the Supreme Court needs to hear, and I am proud to use my forum here at Ace of Spades HQ to advocate for it being accepted by the Supremes. The greater the awareness and visibility of this case, then perhaps there is a greater likelihood it will be heard at the highest court in the land. It is preposterous that 61 years after the Civil Rights Act was passed, there are still school districts that tolerate racial discrimination against students at the hands of their faculty.

Rather than re-summarize the circumstances, I am going to quote from a few sources and also link to Brooks’ and Monte’s recent appearance on the Dr. Phil show to discuss this case.

First, here is a summary of the situation by Brooks Warden’s father, Monte:

Some of y'all know that Brooks has a case currently being considered before The United States Supreme Court. Brooks and I recently sat down with Dr. Phil in an exclusive one-on-one primetime interview to discuss the details of the case.

Briefly, Brooks has endured this nine years (and counting) long case against AISD that involves abuse, bullying, and discrimination beginning when he was a 12-year old child in 2016 - simply for being a little boy who supported Donald Trump. The 2016 election kicked off a four-year campaign of hostility and abuse, discrimination, and harassment over his race, faith, and viewpoints that spanned three separate principals and two campuses (O. Henry MS and Austin High) culminating with a beating and a death-threat in 2020. The crux of the case is this gross mistreatment was not just from students but was LED BY THE GROWN UPS (teachers, administrators, principals). If you're wondering, these are NOT 'alleged instances' - AISD has NEVER disputed ANYTHING they, or anyone, did to Brooks in his complaint.

I ask you to please remember when you think of Brooks as this thriving 21-year old man now, that these people came after an innocent little boy.

Y'all know I never bring politics to my work or music - still don't and won't - MY politics are irrelevant here (and don't assume you know what they are) - even Brooks' politics are irrelevant - the ONLY people whose politics ARE relevant are those who feel they needed to express and defend their ideology by abusing a child. This is NOT just a political issue either, but also discrimination that involved Brooks' race AND faith at every turn. That's against the law. You see friends, there is NO reverse discrimination - only discrimination - and it's ALWAYS wrong – it’s especially despicable when grown-ups do this to a child.

I gotta tell you, its amazing when you wake up one mornin' and realize your youngest son is the bravest man you've ever known. Brooks has stayed in a fight most would have never had the courage to ever begin or wage. He has literally shed his own blood doing so. Brandi and I proudly stand with him.

How the Hell do we need The United States Supreme Court to step in and tell people, you can't abuse/humiliate/discriminate against/harass a little boy? - EVER. FOR. ANY. REASON.

There is much more, as detailed in this Federalist piece from February, “Texan Allegedly Bullied By School Over His Skin Color, Trump Support Asks Supreme Court To Take His Case” and in the Dr. Phil video embedded further below.

Among the abuses claimed by Brooks were a teacher calling him a racial slur; the Principal mocking Brooks and accusing him of listening to Dixie while wearing a headset; the Student Council President circulating a picture of Brooks as a Klansman; another student promising to kill Brooks and all Trump supporters; and a student beating Brooks up in a classroom while the teacher watched. That student is later alleged to have boasted about assaulting Brooks because of his race. As Brooks’ father documented above, the Austin Independent School District never disputed or refuted any of this, they just chose to ignore the Wardens’ pleas to make it stop.

The school district subsequently chose to ignore legal demands until the case escalated to the 5th Circuit Court, which held an en banc hearing at which the AISD finally acknowledged that they “regret” what happened to Brooks Warden. The court’s ruling was a 9-9 split, favoring neither party, and the case has now been filed at the Supreme Court.

Finally, as Judge Ho discussed in his en banc dissent below, societal acceptance of racism against white individuals is a national issue of growing concern. The acquiescence to—and, in some cases, celebration of—overt racist acts toward white people is a troubling feature of our culture that has become all too common. Congress enacted the Civil Rights Act to eliminate race-based discrimination within its ambit in its entirety. In so doing, Congress did not intend to limit its protections only to non-whites. As Judge Ho explained below, dismissing Brooks’s complaint as implausible is yet another example of this growing—and disturbing—trend. The en banc Fifth Circuit’s failure to reach even a bare majority as to the correct standard for racial harassment claims under Title VI reflects the need for this Court’s intervention. If allowed to stand, the decisions below will sow further confusion among the lower federal courts, and Brooks will be denied the opportunity to hold AISD accountable for its discrimination against him.

Let’s all hope that the Supreme Court takes this case and finally ends the nasty institutional racism that continues to fester in this country. As Monte Warden stated, ”there is no reverse discrimination - only discrimination - and it's always wrong.”

She grew up in a very well to do area. Went to the nicest schools in St. Louis. Mary Institute, St. Louis Country Day School & Rosati-Kain, an all girls Catholic high school. Crockett is Baptist.

2003 graduated Rhodes College with a BA in Business Administration. 2006 completed law school and became a public defender for Bowie County.

Her district covers most of Souf Dallas County, Central Dallas, Love Field Airport.

Later formed an ambulance chasing lawsuit firm and pro bono cases for Black Lives Matter activists.

What a wonderful expression of support for his son.
Brooks is exceptional, and clearly his parents are, too.

This is why it's so depressing when parents such as the Metcalfs immediately forgive and excuse the boy who's just killed their son. Why is there no support for their son in death? Why not a full-throated defense of his life and actions the way Brooks' parents are doing here?

It does. This is well established case law. In fact, many of the plaintiffs in famous CRA of 1964 cases were white men.

That said, it is absolutely applied differently at the trial court level. I have dealt with it personally (as an attorney).

I had a black woman judge question me relentlessly at oral arguments for a motion to dismiss about what I was alleging with a client (she eventually said "oooh so like a kind of reverse sexism claim?"). Case was dismissed.

Basically a black male was being horribly sexually harassed by a fat white woman boss, he complained and was terminated for complaining.

If the genders were reversed, slam dunk case. Definitely a case that should have, in any sane universe, survived motion to dismiss.

That said, even if SCOTUS says "yes, of course it applies to everyone", trial court judges will continue to enforce the law as they see fit.

That seems to be the case. All of the people eloquently arguing that discrimination was fundamentally terrible and unfair and hurt our country and economy etc etc etc are now the loudest ones in favor of discrimination.

You know what I'd like to see? Some kind of federal law against nepotism. (I know it would be damned near impossible to enforce).

Because the white people pushing this shit the hardest are from well connected families, and their kids will never have a problem getting a job because the dads play golf with the CEO of Pepsi or whatever the fuck, and all of the parents went to prep school and college together.

So now unless you're a nepo baby or a "person of color" (including Indians and Chinese), you are competing for jobs on a very unfair playing field.

48 I read the petition. Lots of misinformation about this case. The question on appeal is not what's being reported. This case has very little to do with racial discrimination against whites. In theory, it's already established that you can't discriminate against whites. The issue on appeal is clearly stated in the petition itself:

"Whether a plaintiff can state a claim for racial
harassment under Title VI even if the 'primary impetus'
for the harassment was the plaintiff's political views."

This is a political views case. What happened is that a white kid wore a MAGA hat in a predominantly Hispanic school district. He was bullied and ostracized as a result. He sued, but eventually lost on the grounds that it was impossible to know whether it was his political views that were being discriminated against, or his race.

So he's asking the SC to consider whether he can still claim racial discrimination if a main reason for the discrimination was political.

I don't know the procedural posturing of this case, but I have to imagine the real question here is does this rise to the level of racial discrimination required?

There are different considerations at play when a school discriminates against someone for their political views (Tinker vs. Des Moines and the progeny there).

What music you listen to is not a protected category, although there are cases where racial bias has been found due to music (work places banning rap music, but allowing country music for example could be seen as being driven by racial animus)

And the principal calling him a racial slur -- one isolated incident may not be enough under the CRA.

That said, there does seem to be a much lower burden when it comes to discrimination against black people than white people. For example, I've seen cases where a manager merely complimented a black womans hair, the black woman was later fired, and the action moved far enough to get a good settlement for the plaintiff for racial discrimination.

It's the state Capital plus home to multiple universities. Plus, now it's the tech hub of Texas with lots of Cali imports. It was a blue before but it's gotten way worse over the years.

It's a well-written petition and, I think, an important issue. As noted above, it's already established that the kid would have a case (in theory) if he was discriminated against because he was white. So the school said "nah, it wasn't his race we were shitting on, it was his MAGA views!"

Almost any racial discrimination case can be turned into a political views case, to try to avoid liability. And, in fairness, political discrim is a real thing; even minorities can be discriminated against because of their political views (eg, that kid on the subway). So the issue is important. Sadly, I think the SC will punt on it for now.

I went to middle school in NJ a number of years after the 1964 civil rights case. As often happens, the pendulum swung way too far and resulted in idiotic policies and beliefs. In the case of my school it resulted in 2 principals, a white one for the white kids and a black one for the black kids. I am not joking. If a fight between a black kid and a white kid happened the black kid went to the black principal and the white kid to the white. Unsurprisingly, the punishments were not equal and you don't have to think hard how it turned out.

Colorblind is for everyone. Black racism is just as prevalent, maybe more, than white and just as wrong.

Political views are not protected, typically, at the federal law. In NY, they somewhat are (union activism and working for a political campaign are, but just general "this guy voted for Trump, so I'm firing him" typically isn't).

So then the case comes down to was the discrimination against his political views pretextual for discrimination based on race.

Those "marginal" cases tend to break one way for white people and another way for others.

But idk what SCOTUS can do here.

Frankly, that's not going to happen. Every person on the planet is born with in-group preferences. That doesn't necessarily mean racial discrimination, but most people will be willing to give their neighbor a job over some guy they don't know.

Black people have been told for 50 years that the reason their lives suck is because white people have purposely held them down and used them as literal slave labor then as a one-step removed slave labor and kept them removed from the "good jobs". (and, like I said, there is an element of truth to that, although I don't think white people are largely hiring based on race, I think the problem is more acutely defined as nepotism. white people in WV aren't getting those good jobs either.)

Most black people truly believe that.

So if you believe that -- well, it is "anti-racism" to hire only blacks. Because that's what white people do, you're just trying to bring some parity to the system.

It's a very ... unpleasant situation, frankly.

I think Obama benefited from lack of exposure. He was little known before he hopped onto the national stage, and was carefully managed the whole way.

He was clean and articulate. Jazzy is taking the opposite tack. When she first entered politics, she showed off her polished diction, more or less reasonable rationale for getting into politics, and now that she's being thrust onto the national stage, she's adopting the ghetto style.

Something she's never known, her whole life.

Will it work? I doubt it. People will have had enough of her long before they can try to prop her up into higher office.

That said, I'm not the trusting type when it comes to current GOP leadership. I'm only cautiously optimistic when it comes to Johnson. I was up in east harlem the other day, waiting to pick a friend up. The neighborhood is heavily hispanic, with some black people mixed in. Very few white people.

A firetruck pulled up saying they had a report of an unconscious person and asked if I called it in. I said I didn't and didn't see anything. The firemen got out of the truck and started walking around.

All 7 firemen were white men, all looked to be of Irish descent. Half were young, probably in their 20's.

I don't know why, but it made me chuckle a little bit.

So my point is -- there are still some municipal jobs you can get as a white guy. You just need to be in a corrupt and racial politics driven city.

I don't. As I explain above, the issue in the case isn't what's being reported. It's a narrow issue that -- to my knowledge -- hasn't come up before. So the SC usually waits until the issue has been more developed in the lower courts before it weighs in. On the other hand, this was an evenly split en banc decision, so that along means there's a lot of disagreement over the issue. We'll see. I think it's 75/25 against.

FDNY, but yes. 100%. My buddies a paramedic. He got the job because his uncle was in the FDNY.

NYPD seems to be much more diverse.

Historically - Sanitation was the Italians, FDNY and NYPD were the Irish, Education was the Jews, the WASPS ran Parks and a lot of the other smaller departments.

Lots of political horse tradings and deals were made to protect those jobs for those groups.

Education, Parks and NYPD are much much more "diverse" now, but Sanitation and FDNY seem to still be holding on to the old ways somehow.

It is more true in England, like Germany, the old party system is falling apart. Both Labour and Conservative parties hit modern day lows as a percentage of the vote share. The same is happening in Germany--the old uniparty axis is collapsing and assuming the CSU/CPD and the Social Democrats along with Greens form teh next government are likely to do a swan dive just like Labour.

Bandaids can no longer fix what ails Europe and an increasing percentage of the electorate realizes this. Pure game theory for the last 2 weeks. Trades aren't being made based on any conceivable metrics like growth, economic health, P/E, or value. Trades are being made totally on the basis of "do I think the market will be up or down in the next 30 minutes?" Kamala is retarded. Like seriously, I'd say her IQ is at best in the 80s. Jasmine Ratchet is maybe average, which makes her look Aristotelian by comparison, but I guarantee she's DEI all the way. And yes her ghetto queen act is as real as Hillary Clinton's "no ways tahrrred" and her claimed affinity for hot sauce. I don't think she's some kind of genius hiding behind 12-inch-long fake eyelashes and Cardi B affectations.

I would argue that the fact there was viewpoint discrimination does NOT negate the fact there was ALSO undisputed racial discrimination. That is where the court needs to provide guidance. Otherwise, it makes it all too easy for parties to attempt to shield their racial discrimination behind the claim of viewpoint discrimination.
