It would be funny if it weren't so destructive to the nation and to the efforts of the Trump administration to claw us back from the illegal invasion abyss created by his predecessors Obama and Biden.

This drooling, arrogant, ignorant sub-wit Obama appointee from -- you guessed it -- California, has used nonsensical logic and imaginary words in the United States Constitution that only he has the power to read to find that one administration's actions have the force of law, but the current administration's efforts are mean and nasty, so they can be ignored. Yup... Judge Chen sees in the Constitution a prohibition against "animus."

Court Halts Trump Admin's Move to Revoke Protected Status of Venezuelans

U.S. District Judge Edward Chen issued a nationwide injunction in response to a legal case brought by the National TPS Alliance, putting Homeland Security Secretary Kristi Noem’s plan to roll back protections granted by the former Biden administration on hold while the case continues.

Noem previously said that the Trump administration would revoke TPS protections for Venezuelans on the grounds that they were contrary to U.S. interests and no longer justified by conditions in Venezuela.

In a 78-page order, Chen said the plaintiffs have shown a likelihood of success in demonstrating that Noem’s actions “are unauthorized by law, arbitrary and capricious, and motivated by unconstitutional animus.”


I guess we should give good old Judge Eddie the benefit of the doubt. Perhaps he is allowed in the super-secret dungeon of the National Archives where that special last page of the Constitution is stored? You know...the one that says that the president can't be mean to anyone or act based on his feelings toward a particular group...of rapists and thieves and murderers. They all deserve to be treated like citizens, and not like the gate-crashing criminals they are.

Or he is just pulling this nonsensical holding out of his ass, and it has no foundation in our laws. The Biden administration extended the TPS protections to Venezuelans, and it seems to be axiomatic that the next administration can remove those protections. But ORANGE MAN BAD! And illegals, many of whom are violent criminals, are the darling and favored children of many of our activist judges, who want nothing more than to impose their own brand of totalitarianism from the bench.

This has to come to a head, and that pathetic excuse of a Chief Justice must take up these cases sooner rather than later. But he is a weakling and a coward, and an intellectual lightweight to boot. His passivity and inaction is destroying the gravitas of the Supreme Court, and his legacy will be that of a failure.

So it must be the Trump administration that pushes hard enough to force Roberts' effete, soft hand. Tell this judge that he has no authority over a purely administrative decision, but that if he wants, he can send his divisions to Washington to enforce his edict.

Lose Marbury vs. Madison completely.

People are freaking out because SCOTUS is letting the normal process play out...in the face of unprecedented levels of gamesmanship from lower courts.

The process has killed A LOT of the gamesmanship so far. Stays and PIs being killed here and there. The problem is the TRO process is being abused, and few people, it seems, on SCOTUS want to get involved in that process. They want to process as it stands to play out. Alito's disssent (signed on by Thomas, Kav, and Gorsuch) wanted to short everything right now. Roberts and ACB, it seems, want the process on appellate review to play out.

Frustrating, but I get it at the same time.

Wait until something on the merits comes up to SCOTUS.

It's simple, once a process was established for the illegals that The Biden Junta brought into the country, the process must play out per the courts.

This could obviously be obviated if the courts accepted the administrations interpretation of The Aliens Enemies Act, but they are not accepting their interpretation.

The SCOTUS could nip this all in the bud, but they are content in letting the psychodrama play out further.

This is the kind of legal team who are probably willing to say to SCOTUS, "Marbury v Madison is only held up because the executive agrees to it, and we're not going to agree to it anymore. Now, tell me in Article III where you have the authority to determine if anything is constitutional or not because we deem Marbury dead."

Bottom line, the law is what the say it is, and until an executive draws a line in the sand and say's no further, they are going to continue to encroach into areas they have no business encroaching.

I think Roberts has started to realize he is running out of time. The WH is about ready to declare they will not recognize TRO issued on national security issues from district courts, and argue they are beyond their constitutional authority - it will force Roberts to take the case on that alone. That becomes the vehicle for a potential Marbury nukeage.

The Secretary of Homeland Security has the discretion to designate a country for TPS for periods of 6 to 18 months and can extend these periods if the country continues to meet the conditions for designation. A foreign national from a designated country who is granted TPS receives a registration document and employment authorization for the duration of the TPS designation.

I’ve read most of the filings. You’ll be surprised to learn the plaintiffs and amicus filings mostly focus on the specific authorization technicalities for using the Alien Enemies Act and that TdA does not meet such standards. They’ve largely stayed away from the nationwide TRO issue. So my prediction is since SCOTUS is staffed with subversives and cowards they will focus narrowly on the presidents ability to use the AEA, say he doesn’t have the power, and will avoid all other questions. Thomas will once again dissent and pen a scathing, truthful opinion stating his colleagues are cowards.

State is only needed if a person is here on some type of Visa. Any illegal alien is subject to removal under Title 8, especially criminal aliens. Under AEA they are subject to expedited removal and very little opportunity for a hearing, nor material judicial intervention because it is done using the presidents Article II powers. That’s a separation of powers issue, which is why plaintiffs are trying to attack whether TdA qualifies under AeA, not the presidents general authority

It would cost a lot up front as I am sure these judges live in more upscale areas but the lessons taught would be well worth it to bring a little hard reality to their doorstep.
