That is actually what the due process decisions by the Supreme Court say (see Londoner v. Denver) De minimus is the legal speak for it.

It is Failure Theatre, but I'm not sure that they even want to comment on this one. Republicans are just as guilty as Democrats of ceding their legislative responsibility to the judiciary. Any tough choice that needs to be made, Congress has been more than willing to fob that over to SCOTUS. That's how we got ourselves into this mess in the first place. If I even see one hearing on this, that's an indication to me that Congress is ready to fulfill one of its primary responsibilities. If it's Trump that gives them the courage to do this, so much the better for the country.

I agree something needs to be done here, but how does this work in practice though?

District courts are banned from issuing any injunctions that could be considered nationwide? What if it's a case where someone is suing for conversion, and the judge issues an injunction against a New York bank that the money can't be transferred until the case has been heard on its merits?

Or are we just limiting injunctions where the government is a defendant? But even then, by their nature, federal laws cover the entire country. So a judge can only order an injunction against the law for the named plaintiff? Or for people in his district? So a law could theoretically be in effect for everyone in the country except one guy or the citizens of one state?

I don't know what the answer is here, and I agree something needs to be done, but the only solution I can think of is SCOTUS needs to step in and limit the judicial branch's review of the other branches. Which I highly doubt they will do.

79 Since no impeached judge will ever be convicted, the easiest solution, from my perspective, is to zero out the budget for the DC Circuit. Stick that into the reconciliation bill and then it would only take a simple majority vote in the Senate.

Boasberg will still be a "judge" in title, but will try no cases and not get paid. Neither will Howell or any of those other clowns.

Kurt Schlicter wrote a great article about this yesterday. He outlined what I think is the ultimate end state of this stupid, unnecessary conflict that Roberts inflicted upon the judiciary. Trump will continue to take popular actions, and dare judges to oppose commonsense solutions. By the time he openly goes after SCOTUS, he would have won the battle in the court of public opinion. Frankly, I don't believe that Roberts will have the guts to resist him. He folded like a cheap suit in the Obamacare challenge, due to optics. He'll fold here too, when push comes to shove.

Go back to the Reagan Adminstration handling of SSDI cases. Basically, they refused to honor any decision applying beyond the person named in the case as plaintiff and refused to accept as precedent district court cases that dealt with different plaintiffs in similar situations. Courts ground to a halt over it due to teh deluge of SSDI cases. And those judges got steaming mad but learned the limits of their powers.

Simply put, there is nothing that would indicate the Framers nor the rule of law allows single district court judges to usurp power of the other branches for whatever reason. Abuse of using TROs to prevent appeal is something that the supervising circuits need to curtail and that is simply those judges should be kicked off the case as penalty.

I discussed that yesterday and I believe Schlicter was too nice by half. CJ Roberts is probably one of the worst chief justices since CJ Taney in trying to usurp the powers of the other branches by the judiciary. Cooper v. Aaron (aka the law is what we say it is) applied to states, not to other branches of the federal government.

Roberts has demonstrated despicable traits of Chief Justice over the twenty years I have had the displeasure of observing him and what he does.

If judges tried to treat is as a class then they are acting illegally as nothing Congress has written in legislation gives them such power (similar in SSDI cases). Simply put, those judges are stupid and need to go back and reread Justice Jackson's concurrence in Youngstown Sheet and Tube. When Congress supplies the power to the President to do something (like the Alien Enemies Act) and the president+Congress has the backing of the US Constitutional powers to deal with both enemies and immigration, then the courts must give way. Who is and who is not an Alien Enemy of the US is for Congress and the president to decide. Not justiciable in courts becuz political question.

Smart courts of appeal had best whack these district judges in the pee pee with their gavels as they are going to end up being showed as the Wizard of Oz was.

That's what the Midnight Judge originally asked for when he thought the deportees he wanted were on a tarmac in DC and not on final approach to el Salvador. He's been overreaching since then trying to get back to that with crazy stuff. Clinesmith received a wrist-slap from Boasberg, a 12-month felony sentence, and was released on probation. The DC Bar suspended Clinesmith's law license for a two-month review, and then restored him to full membership "in good standing".

First, it's necessary to talk about two separate groups: Those who were "processed" by immigration authorities, and those who just slipped in completely unnoticed.

The latter group should all be deported immediately when found. The former group, the extent to which they were given some type of status where a hearing was scheduled, I don't know how many ever actually had hearings or showed up to them. Bottom line, if you are here, and you CANNOT show you've followed every letter of the law the whole way, out you go.

I'm not sure if the steps are accurate, but the podunk judges keep demonstrating that they're more equal than the elected POTUS, and they're doing it in very public and vocal ways. Trump is nothing if not a self-promoter, and the public will be on his side to take power back from the illegal extra-equal seizure by the courts right after our founding.

You can't blame them, though. The system was designed for an honest, God-fearing, just population, so the attorney crowd was the obvious bunch to exploit it.

Start arresting C-level staff at Perdue chicken or whoever for illegally hiring and housing illegals in the country. Or some big general contractors for hiring illegals as sub contractors. I think the well of jobs for these illegals would start drying up real quickly.

Make it voluntary. Ludecke got minimal due process before removal but that was due to a Repatriation Board (aka executive dept board under the AG). What the court is saying in 4 is that constitutional due process rights of the individual does not apply to Enemy Aliens who only get what the executive chooses to give them.

The complication comes from the fact that WWII was a declared war but teh court extends that to beyond hostilities to the post war period. The statute itself, in section one goes beyond to include incursions, etc. as such a gang (or pirates for example) could be removed under the act.

The DOJ under RFK, Sr. went after the mafia. I don't think RFK was the lead attorney on any of those cases though, he had professional litigators try the cases.

379 I read the article on Roberts and only differ from it on one respect. If Roberts is really just a structuralist who wants things preserved as it used to be, he might be angry at Trump's administration but he should also be apoplectically angry at these penny-ante judges screwing up the apple cart for him and move against them. Its one thing to love the norms that aren't there but at some point HE must act to protect that vision of his if he wants it to survive. This doesn't seem to be the case, but it also doesn't seem like he is any kind of mastermind of it.

He won't. Period. Why? These Judges are given these powers by the Rules HE updated just last year.

Not by Law... Not by the Constitution... by the Rules the Supreme Court writes. To reign in these Judges, he would have to rewrite the rules to reign in the very Power Roberts has given them and blessed in the first place.

In other words, he would have to admit he AND THE COURT, was wrong. This he will not do unless forced.
