Dredd Justice Roberts is fighting a battle that he cannot possibly win here. He should never have weighed in on Boasberg, other than shutting him down. In his zeal to preserve what he thinks is the regard that the public has for the judiciary, he's going to destroy it.

Any tough choice that needs to be made, Congress has been more than willing to fob that over to SCOTUS. That's how we got ourselves into this mess in the first place. If I even see one hearing on this, that's an indication to me that Congress is ready to fulfill one of its primary responsibilities. I agree something needs to be done here, but how does this work in practice though? District courts are banned from issuing any injunctions that could be considered nationwide? What if it's a case where someone is suing for conversion, and the judge issues an injunction against a New York bank that the money can't be transferred until the case has been heard on its merits? Or are we just limiting injunctions where the government is a defendant? But even then, by their nature, federal laws cover the entire country. So a judge can only order an injunction against the law for the named plaintiff? Or for people in his district? So a law could theoretically be in effect for everyone in the country except one guy or the citizens of one state? I don't know what the answer is here, and I agree something needs to be done, but the only solution I can think of is SCOTUS needs to step in and limit the judicial branch's review of the other branches. I told him my prediction: Within a month, PDT's administration is going to tell a federal judge to shove it and if they try to enforce their absurd rulings (they're not just stepping outside of their purview but the law itself), the administration will tell them to take it up with SCOTUS.

Since no impeached judge will ever be convicted, the easiest solution, from my perspective, is to zero out the budget for the DC Circuit. Stick that into the reconciliation bill and then it would only take a simple majority vote in the Senate.

Or are we just limiting injunctions where the government is a defendant? But even then, by their nature, federal laws cover the entire country. So a judge can only order an injunction against the law for the named plaintiff? Or for people in his district? First, it's necessary to talk about two separate groups: Those who were "processed" by immigration authorities, and those who just slipped in completely unnoticed.
The latter group should all be deported immediately when found. What the court is saying in 4 is that constitutional due process rights of the individual does not apply to Enemy Aliens who only get what the executive chooses to give them. I read the article on Roberts and only differ from it on one respect. If Roberts is really just a structuralist who wants things preserved as it used to be, he might be angry at Trump's administration but he should also be apoplectically angry at these penny-ante judges screwing up the apple cart for him and move against them. Its one thing to love the norms that aren't there but at some point HE must act to protect that vision of his if he wants it to survive. This doesn't seem to be the case, but it also doesn't seem like he is any kind of mastermind of it.

He won't. Period. Why? These Judges are given these powers by the Rules HE updated just last year. Not by Law... Not by the Constitution... by the Rules the Supreme Court writes. To reign in these Judges, he would have to rewrite the rules to reign in the very Power Roberts has given them and blessed in the first place.
