"That sharp rise in universal injunctions stops the Executive Branch from performing its constitutional functions before any courts fully examine the merits of those actions, and threatens to swamp this Court's emergency docket." The Trump administration is not yet asking the justices to weigh in directly on the constitutionality of President Donald Trump's executive order banning birthright citizenship. Instead, they ask the justices to limit the common practice of universal injunctions that "compromise the Executive Branch's ability to carry out its functions, as administrations of both parties have explained." "These cases--which involve challenges to the President's January 20, 2025 Executive Order concerning birthright citizenship--raise important constitutional questions with major ramifications for securing the border," wrote. "But at this stage, the government comes to this Court with a 'modest' request: while the parties litigate weighty merits questions, the Court should 'restrict the scope' of multiple preliminary injunctions that 'purpor[t] to cover every person * * * in the country,' limiting those injunctions to parties actually within the courts' power." The Trump administration's requests arise out of orders blocking the ban in Maryland, Washington and Massachusetts. Trump's executive order prevents children born to parents either illegally in the U.S. or on temporary visas from gaining automatic citizenship. Several Supreme Court justices have previously expressed disapproval of lower court's use of nationwide injunctions. When I tried to get TROs and preliminary injunctions againat the Covid "vax" mandates against local and state employees, I was told that said remedies were extreme, difficult to prove and could only be granted for irreparable non-economic harm, and apparently a vaccination which can't be reversed doesn't count. But a few Federal employees lose clearances or are let go from employment, labor law goes out the window and TROs get thrown around like confetti from the same judges. And fed employees wonder why people hate them.

But all of these orders are the Judiciary ordering the Executive to follow the wishes of the Legislative--that there are only two branches of government now. When the DOJ (EPA, DHS, whatever) appears in court, it accepts the jurisdiction of the court over the DOJ. There IS a procedure where the defendant can enter a "special appearance" just to challenge the court's jurisdiction, but it's clear in most cases that the judge does have jurisdiction over the DOJ. Congress could pass a change to the federal rules that would allow a "special appearance" to challenge the court's jurisdiction over the DOJ's actions outside its district. That would be the best answer. But Congress hasn't done that, so we have the rules we have. Thomas has been the leader in challenging the overreach by the judiciary. The other problem is the Temporary Restraining Order versus the Preliminary Injunction. The TRO is supposed to just freeze things in place for a short period of time until the court can have a hearing, then issue a Preliminary Injunction. Because it's only for a period of up to 21 days (in theory, anyway), the TRO is almost unreviewable because the appellate courts can't work that fast. The fight on the merits is supposed to be at the PI stage. The PI is supposed to freeze things until the case is tried, but the standard for granting a PI is higher and it's appealable. SCOTUS is the only court enumerated in the Constitution, just as the President enumerated in the Constitution. These inferior courts, the US District Courts, are just that to both of these co-equal branches. The Hawaiian judges and their TROs and injunctions are unilaterally disrupting this Constitutional arrangement. In a sense, they're behaving much like the administrative state has become a near-independent branch of the government through neglect by Congress and weak presidences. The time is long overdue for both these issues to be brought to an anvil pounded into pieces which would restore the Constitution backed to its proper state.

Federal judges issued 15 nationwide injunctions against the Trump Administration in February alone. In just one month, that's more nationwide injunctions than there were issued for the first three YEARS of the Biden Administration.
District court judges are out of control. SCOTUS must rein them in. TBH this is a problem because "right wing" judges are generally gutless. Why weren't their 15 injunctions against Biden? Well I would argue that there is a big difference between "that was badly decided" and "they are just abusing their power here." It happened (Roe v Wade, for example) but usually their bad decisions are just badly decided. There's a substantive difference between say, US vs Griggs, and a judge deciding that the executive department cannot execute policy.
