AG Pam Bondi Informs the Senate That Their Restrictions on Who the President Can Fire Are Unconstitutional and That the Administration Will Ignore Them

Congress has passed bureaucrat-protection measures that limit Trump's right to fire administrative and immigration judges.

Pam Bondi just wrote a letter instructing Congress that this is an unconstitutional Congressional intrusion into the President's powers under Article II, so she and Trump will ignore these insurrectionary restrictions.

She plans to fire a lot of administrative judges, including immigration judges, who are hired and overseen by the Article II executive and not the Article III courts.

#BREAKING: Trump and Pam Bondi's DOJ just determined that the current level of removal restrictions for administrative law judges are unconstitutional.

This means cleaning out the obstructionist administrative judges will be easier.

That INCLUDES immigration judges.

12 This is a no-brainer to me. These aren't "judges" in the sense of Article III judges that are appointed for life. They are Administrative Law Judges or "ALJs." They are basically glorified federal executive employees under the supervision and control of the President. Of course they can be fired if they're not doing the job the President wants.

I think these "judges" are activists first, judges second. If immigration law judges are anything like I've seen in other special-purpose fields, they are hired and promoted based on their activism. I'll bet you any amount of money the lion's share of immigration judges were once immigration lawyers. Who's side do you think they tend to be on?

Article III judges (like USDC-RI Judge McConnell, before whom I have practiced) are not affected.
BUT, they are bound by “upon good behavior “.

One of the ways the government has gone wrong has been this lazy thinking that it's the Supreme Court's function to determine what is or isn't Constitutional. And therefore neither of the other branches can be bothered dealing with the question.

Now if we could just find a Congress that would do its job and pass a budget rather than a debt-fueled spending plan.

It's been acknowledged by everyone since the 1860s that presidents have full authority to fire cabinet officials (Johnson firing his SecWar was the impetus for his impeachment, an action SCOTUS later said was legit).

Cabinet officials get approval from Congress.

If the executive can fire officials the Senate had a say in hiring, why can't POTUS fire executive officials no other branch of government had any say in hiring?

I am sure they were, and in theory, it makes sense. They would be the ones who understand immigration law. It falls apart when they forget they have to apply the law, not advocate for a particular client anymore.

You need an adjudication on some sort of process mismanagement that some fat, layabout federal screw up on your SS, VA, etc. claim? It is first heard by an administrative law type before you can get to the point of a proper Article III court. It is purely or at least primarily an exercise of executive decision-making.

Most small ball claims never get to the point of Article III, except where there are large sums of money involved such as NGOs paying for immigration cases, or more normally where there are valuable commercial interests involved.

I am all for looking back in history to learn from past successes and failures, but a lot of the time this analysis is silly. Ferguson’s tweet was a silly comparison , and felt a lot like he was saying “Bush handled it better.”

I read his 'Pity of War' about WWI and between some essay length interesting essays it diverts into some wish fulfillment nonsense that everything would have been fine if England had not joined the war. It is some very bad alt history, and impossible to imagine the UK doing givein their 400 year goal of not letting one nation dominate Europe. Seemed like wishcasting to the max.
