Sefton: sefton at cutjibnewsletter.com | The Morning Rant: Minimalist Edition![]() Phyllis Fong, who served as Inspector General of the United States Department of Agriculture (USDA) since 2002, told colleagues last week she planned to resist President Trump's order firing multiple IGs across different federal agencies. The act of defiance did not end well. Security greeted her when she showed up to work on Monday and promptly removed her from her office. Good. She also stank at her job. Just look at the six-year long mess they made of Boar's Head! The USDA had internal reports of the seemingly total breakdown of that company's food safety systems, yet sat on their ample, well-fed asses until people started dying from Lysteria infections and they couldn't keep eating donuts and doing nothing. Fong's job was to make sure that the USDA was doing what they are supposed to do! She clearly didn't do that well, if the USDA was incapable of upholding basic food safety regulations at one of the iconic brands in the American food industry. And it won't stop on the sidewalk outside of USDA headquarters. It is vital that congress support the president in his efforts to root out the rot within the administration's many departments, and anything less than a united front will be a powerful signal who to primary in 2026! But it will also move into the courts, and hopefully it will go quickly to the Supreme Court, which must decide whether the hundreds of thousands of fifth column moles of the deep state can be dismissed for not supporting the policies of this, or any administration. America cannot be held hostage by unelected bureaucrats whose political beliefs are superior to the will of the American people, as voiced on November 5th, and as implemented by the president and his officers. It is my most fervent hope that President Donald Trump and his cabinet officers pursue this policy with vigor, because this is what he promised, and the American people seem to be tired of being lied to by their politicians! The White House defended the firing of Fong and the other inspectors general, saying “these rogue, partisan bureaucrats … have been relieved of their duties in order to make room for qualified individuals who will uphold the rule of law and protect Democracy.” . .
Fong was among the 17 federal watchdogs fired by Trump in what critics described as a Friday night purge. Speaking to reporters afterward aboard Air Force One, Trump defended the move, saying “it’s a very common thing to do.” He did not say who would be installed in the vacant posts. The dismissals, handed out less than a week after Trump took office for his second term, appeared to violate federal law, the Council of the Inspectors General on Integrity and Efficiency said in a letter to the White House on Friday. Fong served as the first chairperson of CIGIE from 2008 through 2014, according to her biography on USDA’s website. - - - So, they will try to lawfare him out of exerting any of his rightful executive power. Posted by: Thomas Bender ====== Not so sure about that. Depends on definition of major and minor officers of the US. Major officers of the US, unless involved in quasi judicial or quasi legislative regulatory jobs are not protected from removal. IG jobs are primarily investigative and thus not quasi judicial. Investigations are executive functions and precedent has already been set that IGs can be removed for cause among other things. A lot of district court judges are going to get their tallywackers or other appropriate protuberances thwacked by appellate actions due to Scotus precedents. It's not just Boars Head, either. The formula shortage crisis from 2022-2023 was exacerbated by the FDA, there's even an argument that they created it with their unbelievable absence of competence. Literally the most vulnerable ones in society and they just fucked around with their lives. They knew about it, sat on the info for 6 months, then finally said, oh by the way, public, your babies' food isn't safe. And then refused to lift archaic rules that prevent many kinds of formula from different countries-- I know parents who ordered from overseas and their shipments were confiscated at customs. Their baby's food was confiscated, from countries with more stringent regs and inspections than us, for no other reason than that's what the rules say.

Still makes economic sense--it was the Biden administration that killed it via export license requirements, not a judge. There is also the Reagan tactic of simply ignoring the ruling of one judge in application to the situation of others (happened in SSDI cases). Technically, a judge's ruling only binds the parties directly in the case and cannot bind those in other jurisdictions or even other plaintiffs (if not a class action lawsuit). Even Court of Appeals decisions, are technically limited to their particular circuit. That is why the DC Circuit was a must capture for Reid and Co to the extent they nuked the filibuster to do so. Shock and awe is the tool Jarrett employed in Obama's first few months in office, then they never stopped. I detailed it here at the time.
What they did was spin the news cycle so opponents didn't know where to look or what to do. They also accelerated the cycle by a factor of 5 or 10. So where any story used to maybe linger for days and be "the news", they made sure that the life cycle of the *average* story was very very short, meaning with many things to choose from including fake ones, they could further manipulate what became prominent and what would be ignored. Compare how a tranny mass shooting at a Christian school that kills 10 kids is treated to the life of a Trayvon or George Floyd story. This was all intentional. Uniparty prevented this during DJT1 by running the Russia Hoax and keeping Trump under constant investigation and threat. It meant the 24/7 news always had a story to talk about that was under their curation. Posted by: ... at January 30, 2025 11:26 AM (cjAAr) 146

So, with the IG firings, this is one area where I don't understand why Trump did it this way. He admits he has no idea who they are just that someone he listens to wanted them gone.
There was a legal way. He can give Congress 30 days notice and then remove them. That's it. 30 days. And the IGs and CIGIE would have no legal objection. And yes, the legislative branch passed a bill that was signed by the President that limited the Executive branch's ability to remove this one particular category of official. That is a Constitutional check on the power of the Executive branch. So why didn't he follow the rather minor procedural hurdle? This one could easily get blocked by the courts, and by that time, Trump may have lost momentum and the Democrats may have found a way to organize and intimidate the Republican squishes in the Senate. While I appreciate the shock and awe approach, it's most effective when you also use the easy tools available to accomplish the same thing. "America cannot be held hostage by unelected bureaucrats whose political beliefs are superior to the will of the American people, as voiced on November 5th, and as implemented by the president and his officers." - CBD
This is a common theme, maybe the central tenet of the Uniparty government, and its bureaucracy that operates as an extra constitutional government. The same can be said for these foreign wombs that unilaterally create new citizens by simply squirting out a kid without respect to the will of the citizens. The President isn't just the head of the Executive branch, the President is the Executive branch and all other personal and agencies that emanate from this serve at his or her will. This is a fact that the Left immediately ignores and then undermines, with varying degrees of success, using their opaque Mandarin penumbras and emanations to castrate presidents it despises. President Trump is applying the correct tactic to these proven enemy bureaucrats: fire their asses, pull their clearances, cancel their access, and perp walk them off the property. There are/were great IGs, and ones that were horribly run and ineffective. On this one, Trump admits that he doesn't know who the IGs were. ====== BTW, Congress cannot "check" the executive on removal, only appointment to major officials. Myers v. Humphreys drove a stake in the heart of the idea that the Senate could prevent removal of presidential appointees. The two exceptions were allowed later for regulatory appointees that exercised Congressional rulemaking and judicial functions (FTC commissioner--case was Humphrey's Executor), and Weiner v. US (War Claims Commission--quasi judicial). IGs are neither of these. I suggest you read Myers v. Humphreys as it is not a long case but CJ William Howard Taft's opinion is magisterial (and has the lessons learned in hindsight from his stint as President). Basically, a president cannot faithfully execute the laws as Chief manager if he cannot remove insubordinate or incompetent staff. So Congress does not have the power to restrict a president from firing those as such. We can talk about the Pendleton Act a bit later as that gets more complex. In this case, he needed to just go through the process, take 30 days and be done with it. No martyrs, no risk of legal setbacks that can get used in other cases as precedent. Regarding the in-air collision between the plane and the military helicopter, is there any reason why the story seems to be classified as the plane running into the helicopter as opposed to what it appears to be in the videos out there, that the helicopter flew into the plane?
For example: Fourteen members of the figure skating community were passengers on an American Airlines jet that collided with an Army helicopter near Ronald Reagan National Airport and crashed into the Potomac River in Washington, D.C., on Wednesday, according to Skating Club of Boston executive director Doug Zeghibe. From what I have seen in videos, it seems the plane was on its correct landing flight pattern and got hit from the side by the helicopter. That would suggest to me that the helicopter hit the plane. Yet almost everywhere I read about this, they describe it as the plane hitting the helicopter. Posted by: Clyde Shelton at January 30, 2025 11:55 AM (P5BPp) 338

TJM, IMO both Hepburn and Astaire have weak-ish singing voices. Charming and full of emotion, but not the vocal powerhouses that were so prevalent in that era. It's kind of amazing they headlined a musical together. Honestly though, the thing that throws me the most is their age gap!
Astaire starred with Caron in Daddy Long Legs, another May/December movie where his love interest is young enough to be his daughter. Then there is this in the same article:
There was no immediate word on the cause of the collision, but officials said flight conditions were clear as the jet coming from Wichita was making a routine landing when the helicopter flew into its path. Posted by: L Not really. Since the 1978 IG law was passed, multiple presidents have fired a bunch of IGs as a group. That is why Congress attempted to put a 30 day report requirement. But, because most of the IGs at issue are presidential appointees, past caselaw indicates that Congress cannot impose conditions on a president for their removal as major officers of the US. Sort of similar how Congress has put reporting requirements on the War Powers Act that presidents have ignored in the past. Statute never trumps Constitutional powers so the courts usually try to interpret a statute to be congruent with the Constitution rather than assuming Congress passed an unconstitutional law by either eliminating a troublesome provision or by indicating something like the president can remove immediately but has to report the removal to Congress within 30 days. It's pretty shocking how stupid and bad at their job most Congress Critters are. This is pitiful. How in the world do they manage to get elected? I'm beginning to believe most of these a-holes are Harvey Weinsteined into power, given the backing, money, and power to run only after banging or blowing the right member of Their Betters. We find it's always better to fire people on a Friday. Studies have statistically shown that there's less chance of an incident if you do it at the end of the week.

Many vote as if they're judging a popularity contest. Sadly, many women I knew through the years use the phrase, "I like him/her. He/she seems nice". Soooo, the congress critters get elected because of an ignorant electorate. OR, they vote for someone who can bring home the bacon, like The Turtle™. Confirms what I have read and seen elsewhere that, for whatever reason, this is being reported incorrectly in the news. The helicopter flew into the plane, not the other way around.
