Post Racial Society

Devon Makes Some Good points

Our home, our nation, our great civilizational dream, is something you must, at the very least, embrace, believe in, and join. We chose to base it on thoughts, ideals, and beliefs, instead of genetics, but that was our call. If you can't even go along with that loose restriction, what the hell are you doing here? You don't get to show up and hang out without believing and participating, just because you brought samosas. We are the United States of America. We may have chosen to be liberal about what unites us, but if you are not united to us, if you don't think and act as one of us, then you don't make the cut. If perhaps you think that the requirement of shared identity is still too stringent, and you would like to live in a nation made from small racial enclaves sharing an economic zone, you could make your own country and try that as a separate experiment. Buy some land in southwest Asia. Build your multicultural paradise. You could call it "Ethniklashistan".

Read the whole thing. The post he's responding to is at the bottom, if you want to read that first.

Living Abroad

"American" Ingredients They Can't Find Overseas

I imagine a lot of these can be ordered online. Anything any of y'all noticed was missing when traveling abroad? It's not food related, but personally, I still can't get over seeing the toilets in Amsterdam for the first time.

Birthright Citizenship

The 14th Amendment does not confer automatic citizenship.

This is a good article, that clearly lays out the case. Frankly, it's what I've always said, and on the merit of the facts and a clear reading of the text it's a no-brainer, but I have no confidence SCOTUS will rule that way.

Our argument is straightforward. The text of the 14th Amendment contains two requirements for acquiring automatic citizenship by birth: one must be born in the United States and be subject to its jurisdiction. The proper understanding of the Citizenship Clause therefore turns on what the drafters of the amendment, and those who ratified it, meant by “subject to the jurisdiction thereof.” Was it merely a partial, temporary jurisdiction, such as applies to anyone (except for diplomats) who are subject to our laws while they are within our borders? Or does it instead apply only to those who are subject to a more complete jurisdiction, one which manifests itself as owing allegiance to the United States and not to any foreign power?

Think of it this way. Someone from Great Britain visiting the United States is subject to our laws while here, which is to say subject to our partial or territorial jurisdiction. He must drive on the right-hand side of the road rather than the left, for example. But he does not thereby owe allegiance to the United States; he is not subject to being drafted into our army; and he cannot be prosecuted for treason (as opposed to ordinary violations of law) if he takes up arms against the United States, for he has breached no oath of allegiance.

So which understanding of “subject to the jurisdiction” did the drafters of the 14th Amendment have in mind?

Happily, we don’t need to speculate, as they were asked that very question. They unambiguously stated that it meant “complete” jurisdiction, such as existed under the law at the time, the Civil Rights Act of 1866, which excluded from citizenship those born on U.S. soil who were “subject to a foreign power.”

Mein Führer!

Hitler, Musk, and the Art of the Smear

Musk dismissed the accusations on X: “Frankly, they need better dirty tricks. The ‘everyone is Hitler’ attack is sooo tired.”

But that the attacks are tired is not what matters. The purpose of the slurs is to get enough traction for some mud to stick. “Did you see Musk gave a Nazi salute?” was how a colleague started a morning zoom with us on a different matter.

Those who disagree with Trump’s policies have every right to take him and his administration to task. However, the Nazi analogies feed a dangerous and false narrative. Moreover, their cavalier and inauthentic use denigrates the memory of those who died in the Holocaust from history’s real Nazis.

Stop it already. If not, the Democratic party might find itself alienating more voters who are looking for substantive policy differences and not the basest types of ad hominem attacks.

Frankly, I'll never Seig Heil. First because I'm not a Nazi, and second because I already have a much better slogan.

Executive Orders

These Executive Orders Should Not Be Necessary

You can scour the Founding documents all day and find very little support for government-by-executive-order. It was not supposed to be this way. It should not have to be this way. The President under the Constitution has a very limited role.

That said, most of the many executive orders issued by President Trump are purely restorative, a reaffirmation of core constitutional structures that had been previously ignored or overthrown. Therefore, these are not acts of executive imposition so much as deployments of power in order to give power back to the people.

In other words, most of the actions are not about the “imperial presidency.” They are about returning power to where it belongs and never should have left, namely to the U.S. Constitution and to the voters in a republican system of government.

This is why all the chatter about Trump’s use of power (“He’s behaving like a dictator!” misses the mark. Completely.

We must find a way to force power from the executive back to Congress where it belongs, or the next Democrat president will just do the same thing Trump's doing, but going the other way.

Navy Says It Won’t Repeat Cruiser Upgrade Blunder With Destroyer Modernization 2.0 Effort

As the U.S. Navy proceeds with modernizing its Flight IIA Arleigh Burke class destroyers with advanced electronic warfare, radar and combat systems upgrades, the head of the so-called DDG Modernization 2.0 program said the service has learned lessons from its deeply troubled Ticonderoga class cruiser modernization efforts, and several guardrails are in place to avoid similar pitfalls.

TWZ has reported extensively on the congressionally mandated cruiser modernization effort, and how nearly $4 billion was spent modernizing seven of the ships, which have for years served in the air defense commander role for carrier strike groups (CSG), among other missions. But of those seven large surface combatants, none ended up gaining the extra five years of service life originally envisioned.

Instead, nearly half that money was wasted modernizing four cruisers that never returned to sea and were retired by the Navy, according to a Government Accountability Office (GAO) assessment, which warned that efforts like DDG Modernization 2.0 carried the same risks if the Navy didn’t learn from its mistakes.

Spend $2 bil on upgrading ships and then retire them. Sounds like the government all right.

Racism At Sea

Cruise passengers horrified as workers parade around while dressed as ‘KKK members’

Cruise staff seemingly dressed up as white supremacist Ku Klux Klan (KKK) members during a Christmas-themed event, horrifying passengers as they marched by the swimming pool.
P&O Cruises Australia issued an apology after footage surfaced online of a group of eight staff walking through the pool deck of the ship wearing their white cleaning uniforms and pointy hats

“Is this appropriate for 2024?” a passenger captioned the clip after uploading it to Facebook.

The cruise company says the housekeeping crew had no idea what they looked like when they chose to dress up as “upside down snow cones” for the event during a Pacific Explorer voyage from Melbourne to Hobart in December.

When I went on a cruise, my favorite events were the all you can eat lobster night, the adults only bar and hot tub on the fantail and the nightly cross burning.

Good smoked brisket: Growing up in Texas, I took that for granted, and in a lot of the areas we lived, smokers weren't allowed.

Mexican food: ditto above.

Chocolate chips: Chocolate overseas is superior to US chocolate, save for chocolate chips. The regular chocolate bars don't make good chocolate chip cookies because the chocolate has a higher cocoa butter/milk ratio and melts too quickly.

Measuring cups. US cookbooks tend to use cups rather than grams, and if you don't bring your own measuring cups, your baking will not come out right.

Nacho cheese doritos: I'm sure they are available now, but when I first went overseas they weren't. I craved them.

Of course, the transfer case had a crack, but i only disclosed the heater core since the buyer was messican.

The 14th amendment was for the express purpose of settling the the status of freed slaves.

The idea that the framers of the 14th amendment were speaking to the status of illegal aliens is bizarre and anti-textualist.

127 We could do this every day I betcha. “Fatal Flaws in the System”

To wit:

The Gang of Three might have Thom Tillis on their side. He asked if the FBI background check on Hegseth was sufficient. Actually, he asked if the report was as extensive as past FBI background checks. He's hinting that he doesn't think it's thorough enough.

Now think this through. Did you know that to run for federal office, no background or FBI investigation is performed? That’s right boys and girls. The people who win an election (or “win” wink wink) are “deemed to have passed” a background FBI investigation by virtue of the fact they got elected.

That’s how we have all these sad sack fucknuckles in the Senate weighing in on the suitability of nominees. Who could never ever pass the same scrutiny How about them apples?

Let’s go to a system where any nominee by a President is “deemed” to have passed an FBI check by virtue of simply being nominated.

OR, how about this? Can the President release the FBI files and background checks on all the members of Congress? Cause I bet the American people would be mighty interested in that. What a crock of shit.

137 >>> Our argument is straightforward.
===
Pro-Tip on interpreting more complex technical clauses than eighth-grade writing - if your interpretation is that the clause means nothing then you are wrong. Expand your arguement to a hundred pages and reference a hundred dead men then you go from merely wrong to highly motivated stupidly wrong.

152 Venting here because my favorite YouTuber, Tom Grossi (Packers & the NFL), threw up a handful of posts on X about Elon-as-Nazi, starting with a link to a story about how a Milwaukee TV weather reporter was fired bc of her anti-Elon posts.
I thought the firing sounded extreme, but when I read the story, turns out she just doesn’t disagree with Musk…she said anyone who liked him should F-off. Actually, she used that word a few times in connection with conservatives. It was genuinely nasty, and now, I get it.
But Tom went on to disparage Elon’s wealth and connection to Trump. And how X was littered with other white supremacists, etc.
There was more but I don’t remember it bc I only read it once and couldn’t bear to read it again.
I have always known he was a liberal. To find out he’s ..that kind of liberal… is disappointing.
I’d grown used to, over the years, artists of every stripe openly despising and willfully misunderstanding me & my kind.

166 SFGoth,
When I was on a cruise, before we docked in Jamaica, there were multiple warnings that if you got caught buying weed, you were on your own. The view was that the Jamaican law enforcement comes down pretty hard on foreign tourists who break their laws, and you don't have the legal protections and rights that you have in the states.
That being said, there were people on the beaches selling.

Posted by: nerdygirl at January 23, 2025 11:01 PM (0Htd1)

Bingo, and in jamaica the dealers have these cute little agreements with the cops. they rat you out, you get popped, and they get their weed back to sell to the next poor slob. I did roughly 15-16 cruises in my time, and at least 11-12 of them stopped at jamaica. The last 2 times I didn't even leave the ship. Screw that shithole.

While listening to "Burnin' Down The House", in celebration of a whole bunch of SoCal-Hollywood-Pacific Palisades leftists and liberals getting, good and wildly hard, just what they voted for, I noticed that Birthright Citizenship had suddenly become a major topic of discussion. I also noticed that United States v. Wong Kim Ark was now included in the discussion.

AIUI, and please correct me if I'm wrong. WKA's parents were immigrants, and not yet citizens when WKA was born on US soil. Some years later, WKA made a trip (to China, IIRC) and upon return was denied entry, as he was held to be a non-citizen. Litigation ensued, the case made it to the SCOTUS, who held that because WKA's parents were legally-admitted immigrants, WKA was to be considered a citizen. Implicitly, otherwise no.

The 14th Amendment seems to be NOT referenced in the case, at least I can't find a reference. As all justices and all lawyers were clearly aware of the 14th Amendment, ratified 30 years previously, and likely still big news in 1989, why no mention? Could it be that all parties understood that it applied only to people born in the US prior to about 1868, and really to freed slaves?

237 We must find a way to force power from the executive back to Congress where it belongs, or the next Democrat president will just do the same thing Trump's doing, but going the other way.

-------

Alternatively, you could break the power of the treacherous Democrat ruling class by forming a shadow government to proscribe them, place bounties on their heads, declare their assets forfeit, and send forth a multitude of pitiless sadists to enforce its edicts. They could even cook some of them in giant frying pans, as an object lesson.

Old ways are best ways.

There is an English-style pub in Phoenix, called the George And Dragon, and they serve Brit food. 284 Arbalest, to understand the 14th, (and the 13th and 15th), you have to go back to Dred Scott case. A legal decision so bad it took three amendments to fix. One of the more horrendous justifications Chief Justice Taney used was that blacks could not be citizens if the US because The Declaration of Independence excluded blacks, free or not, as property and not a member of the political community. Bad history and bad reading of the Declaration, intentionally so, by Taney. Taney was really out to solve the slavery problem by redefining blacks as something outside the Constitution. 14th was designed to fix that part of Taney's twisted reasoning. Wong Ark Kim focuses on English common law definition of jus solis rather than acknowledging the courts responsibility for Dred Scott and the intent of the 14th Amendment. Poorly reasoned decision full of o iter dicta until almost the very last paragraph. Kim was a US citizen because his parents were legally here as resdents so fit the subject of the jurisdiction limitation. Makes a hash of common law ignoring the difference of being a subject to the crown versus a citizen as well. Lazy job.

This.

There was a Middle Eastern guy, late 60s or early 70s, who was fighting deportation to the Middle East. His teenaged and young adult children were very upset. They said without treatment for cancer or renal failure, he would die.

Very sad.

Well, the Detroit News reported that he was convicted of hiring a hitman to take out a rival and innocent young woman was killed instead - and he was supposed to be deported after doing his time. A radio station reported the same thing, as well as talking to the young lady's neighbor.

Suddenly, the deportee's children didn't want to talk to the media anymore.

302 Read an interesting article about the demise of the buffalo. Contrary to popular belief, the White Man did not shoot all the buffalo. They died off due to common cattle diseases which tore through the vastly overpopulated herds.
In pre-Columbian times, the Indians managed the number of buffalo. When the Indians were wiped out by disease, the buffalo population exploded. This resulted in over grazing, destruction of water holes, and weakened animals.
You can see a simular effect today, when too many deer crowd into winter feeding stations and start passing diseases around.

The British packaged sweets are good, but any European import grocery in the US carries those, if you're lucky enough to have one.

One thing Europeans don't get is the combo of peanut butter and chocolate. I had a friend move to England and that was her biggest despair, no Reese's peanut butter cups and pieces. Mailed her goodie packs with them. This was 15 years ago, hopefully they are easier to get now.

The one that was igniting the birds is a solar-thermal plant in California, where a vast field of curved mirrors concentrates sunlight on a boiler. Birds fly into the focused beams from the mirrrors and get smoked. I doubt vast arrays of silicon solar panels are a particular hazard to birds, nor are they likely to present much of a pollution hazard on site, since the active materials are embedded in glass. The worst knock against solar photovoltaic panel generators is that they simply provide very little energy for the dollar invested, and only during daylight hours on cloudless days.

But silicon itself is pretty non-toxic, and is already present in nearly all soils. Sand is mostly silicon dioxide. Clay, feldspar, and a host of other minerals are also silicates. Now, there may be "dopants" in the silicon crystals to enhance their efficiency, perhaps arsenic, or antimony, and other heavy metals. But in relatively tiny concentration, in what is already quite a thin film of crystalline silicon. I just don't see it as a big issue. Solar panels are plenty useful for off-grid homes, and running portable road signs, and instruments at remote oil well installations. TRying to run the grid off them is a fool's errand.

We live in the most exceptional country on this planet, populated by an extraordinary people who are governed, not ruled by a political system unique in history. Further, throughout our history we have met and prevailed over issues that were even more serious than the present mess, with an unbroken record of success. The latest results are a victory in only the very outset of what promises to be a long, arduous slog.

That's kinda my worry. Even if the solar farms are taken down, what is the condition of the soil? And these things cover acres and acres. The wind farms affect the micro climate around them, and some states don't even require removal of wind farms that are de-commissioned. Not to mention the fact the vanes are simply dragged to landfills, they can't be recycled. As far as I know there are no plans to deal with the batteries from electric cars that only last about 10 years. And so on and so on...

Those metal selenides are insoluble solids.
Hexafluoroethane is a gas and gone in an instant - also non-toxic.
Silicon Tetrachloride, if present at all, will be gone instantaneously with any moisture. It's highly toxic but not at these levels.

By self-deporting, one has the time to pack up whatever they have/value. Those grabbed and deported have no such luxury. I hope it's the same with foreign students being deported for supporting Hamass: 'No, you don't get to go back to your dorm room and pack your stuff up. You'll have to hire someone to do that for you. Just understand, you're outta here!'

436 As someone who has lived in both the UK and France since 2013, you find that you have to make a lot of stuff from scratch. Many of our processed foods have ingredients that aren’t allowed in the EU. You can still find them online but at ridiculous prices. Since I’m not a sugary cereal eater, I’m not that bothered. Homemade ranch dressing , corn tortillas, and bbq sauce are better anyway but you can still get those from amazon. You can get most Mexican dried goods online. Even Waitrose has a decent Mexican ingredient selection now but you have to make your food yourself. The one thing that’s near impossible to get in France is a fresh jalapeno (outside of Paris). The French don’t really like spicy food and the only chiles they stock are from North Africa and a few Asian ones. They are not good substitutes for chiles from Mexico and the South West, unfortunately. You can get most of these things in the UK. There’s a huge chile farm in Devon that even tries to grow hatch chiles, but they spell chile 'chillie', which drives me up the wall. It’s so British to ignore foreign language conventions and do it their way. Don’t get me started on how they butcher the Spanish language.
