Deep State Operative Reveals How "Sophisticated Bureaucrats" Can Decieve and Waylay "Unsophsticated Political Appointees" That Trump Puts Into Office

An example he gives of how bureaucrats will "crush" RFKJr.: they'll set up a fake commission to "study" one of his issues, like fluoridation in the water.

But the fake commission will grind on for years, doing nothing, and effectively stopping all action on RFKJr.'s order, because, you know, we have to wait for the results of the "study."

This guy, caught in a James O'Keefe Bumble-Date Sting, also admits: "the Deep State, to some extent, is real." He admits the bureaucracy serves its own interests, by fighting back against cuts to their budgets, for example.

Trump won't be so easily had, took, run amok, led astray, bamboozled this time around. He's set up a tip line asking bureaucrats who support him to report on bureaucrats who subvert his anti-DEI policy by such tactics as just dropping the "DEI" from a DEI hire's title.

trumptiplineDEI.jpg

Seth Dillon
@SethDillon
"We are aware of efforts by some in government to disguise these programs by using coded or imprecise language."

No surprise there. It's how leftists disguise all their shameful behavior. Child mutilation is "gender affirming care." Child murder is "reproductive freedom." Etc.

The ATF just rebelled against the elected president of the United States by evading his order cancelling all DEI efforts. They took an employee with the title "Head of DEI Office" and just dropped "DEI" from her title, making her, nonsensically, the "Head of Office," whatever that means.

Which office? Can't say. Just some office, somewhere, doing something.

Fire the leadership of the ATF.

Trump is dismantling sixty years of racist hiring practices by the US government.

As part of his flurry of initial executive actions, President Trump released an executive order titled "Ending Illegal Discrimination and Restoring Merit-Based Opportunity." It is no mere public relations statement but a long and carefully drafted order that, if upheld and properly executed, will eliminate the blight of racially preferential treatment in the federal government; it also seeks boldly (and likely less successfully) to eliminate it from our culture at large by applying indirect pressure.

he order is truly sweeping in its breadth; its immediate effect is to uproot with one stroke the vast bulk of the federal infrastructure of affirmative action and DEI protocols and hiring practices. This is an edifice that was built up painstakingly over decades by one Democratic executive order after another, dating all the way back to the Johnson administration's infamous 1965 Executive Order 11246, which first established "affirmative action" as a necessary criterion in government hiring and contracting decisions: Any company doing business with the federal government from that day forward has been required to comply with what the Equal Employment Opportunity Commission deems to be racially equitable in terms of hiring, salary, or promotion practices, or else take their case to court.

Now it is no more. E.O. 11246 has been repealed, along with four other Obama- and Clinton-era orders which implemented it. Companies contracting with the federal government will no longer be required by the Department of Labor to address racial or sexual "underrepresentation" with formal affirmative action plans. The federal government will now be commanded to immediately cease promoting "diversity," cease "holding Federal contractors and subcontractors responsible for taking 'affirmative action,'" and cease "allowing or encouraging Federal contractors and subcontractors to engage in workforce balancing based on race, color, sex, sexual preference, religion, or national origin."

...

Trump also makes clear his intent to apply painful public and government pressure on private-sector DEI practices as well, and does not cloak his reasons. As part of a section explicitly titled "Encourage the Private Sector to End Illegal DEI Discrimination and Preferences," the order directs agency heads to compile lists of public companies, universities, and large foundations in order to name and shame "the most egregious and discriminatory DEI practitioners in each sector of concern" and consider civil-compliance investigations and possible civil action over their DEI programs. Furthermore, Section 5 of the E.O. puts higher education on notice that these rules will be applied to any college or university that receives federal grant money or participates in the federal student-loan assistance program -- functionally speaking, every major university in America. (The order specifically states the Trump administration's intent to force colleges to comply with the Supreme Court's ruling in Students for Fair Admissions v. Harvard (2023), the landmark case striking down racial discrimination in public and private college admissions.)

Naturally, several aspects of this momentous executive order will be fiercely litigated. But expect the bulk of it to stand, and stand as a major achievement for Trump's second term. The government's ruinous racial policies over the past half century were created primarily by executive order, not legislation, and what was done with the mere stroke of a presidential pen can be undone by the same means.

8 I repeat:

Civil Service laws that protect unelected and unappointed bureaucrats from firing by the chief executive or his appointed officers are deeply unconstitutional and unAmerican.

It's well established that presidents can fire political appointees, even though Congress had a say in their hiring, but the chief executive can't fire anyone below those appointees?

Seriously...what the fuck? And it's been accepted for about 140 years.

15 President Trump has had FOUR LONG YEARS to draft up all this stuff without anyone in the media looking over his shoulder.

No doubt the best legal minds he can assemble have looked over these and made sure every "i" is dotted and every "t" is crossed.

Some will meet with legal challenges, of course, such as the EO on birthright citizenship.

But you can bet the vast majority of these will pass legal muster no problem.

Good luck fighting against it, bureaucrats!

The Biden administration fought to make it easier to fire unwanted bureaucrats.

Few people remember this, but I believe it was when Sean Spicer was given a position at the end of Trump's term and Biden fought to fire him.

Biden won in court, and Spicer was glad. He didn't need the job. He needed the precedent.

RFK Jr is convinced (and frankly, I think he's probably right) that the CIA / Deep State assassinated both his uncle and his father. And has publicly and openly stated it many times, and even given the names of who he thinks the shooters were.

He even went to bat for Sirhan Sirhan to get him out on parole, because he is convinced Sirhan was MKUltra'ed, and that none of the bullets he fired hit RFK Sr.

And we're to think that RFK Jr. is not aware of how DC works? I think he probably has a bit more insight in to that than your average bear.

88 It is no mere public relations statement but a long and carefully drafted order that, if upheld and properly executed, will eliminate the blight of racially preferential treatment in the federal government; it also seeks boldly (and likely less successfully) to eliminate it from our culture at large by applying indirect pressure.

I think this will be more successful than many think. Nobody really likes race preferences other than those who benefit directly from them, and those people don't want to self-identify. I mean, who wants to say "yeah, I'm a token race hire, because I'm not good enough to make it on merit".

The Overton Window has shifted.

Yeah, in a way. We have no idea what the CIA's budget is, it's classified. Same with all / most of the other 15 or whatever intelligence agencies (that we know of).

Shit, Allen Dulles funded his own quasi- CIA after WWII when the OSS was wound down with money he liberated from Europe in the immediate weeks after the end of the war. (Most people think it was money stolen from Germany / the Nazi's, which I guess makes it better somehow?)

And Nelson Rockefeller used to brag about how his NGO's funded off-the-books work by "our boys overseas" which could really only mean CIA (at least in that era).

SMOD posted on the ON last night about the United States v. Hasbajrami case handled up in NY. Essentially, they did surveillance on the guy without a warrant. The dude had terrorist ties and wasn't shy about it, but was a US Citizen. The courts finally ruled that surveillance without a warrant on a US citizen (through FISA) was a direct violation of the 4th Amendment. Obviously, the CIA would have been directly involved due to the target. So, there's likely an example of the CIA violating the US laws by using a relationship with the FBI to dilute the issue. Amusingly, this decision was made in the very beginning of Dec. but wasn't reported on or made public until just yesterday. Which suggests they sat on it to benefit the previous administration and likely the FBI and CIA.

150 CJ Taft said it best in Myers v. US. "Upon an historical examination of the subject, the Court finds that the action of the First Congress, in 1789, touching the Bill to establish a Department of Foreign Affairs, was a clean-cut and deliberate construction of the Constitution as vesting in the President alone the power to remove officers, inferior as well as superior, appointed by him with the consent of the Senate; that this construction was acquiesced in by all branches of the Government for 73 years, and that subsequent attempts of Congress, through the Tenure of Office Act of March 2, 1867, and other acts of that period, to reverse the construction of 1789 by subjecting the President's power to remove executive officers appointed by him and confirmed by the Senate to the control of the Senate or lodge such power elsewhere in the Government were not acquiesced in, but their validity was denied by the Executive whenever any real issue over it arose. While an injunction prevented that from happening (wide-scale, at least), the courts considered the whole topic "moot" when shit-for-brains rescinded the EO and dismissed the anti-mandate lawsuit.

I don't understand why, if they were going to prohibit slavery in every case except as punishment for a crime, they didn't attach penalties for doing it.

Unless they figured that being enslaved as punishment for illegally enslaving others would be the kind of punishment that any half-wit would see as logical extension of the principle.

@lisamurkowski
Since Mr. Hegseth’s nomination last November, I have met with him and carefully reviewed his writings, various reports, and other pertinent materials. I closely followed his hearing before the Senate Armed Services Committee and gathered substantial feedback from organizations, veterans, and Alaskans. After thorough evaluation, I must conclude that I cannot in good conscience support his nomination for Secretary of Defense. I did not make this decision lightly; I take my constitutional responsibility to provide advice and consent with the utmost seriousness.

I commend Pete Hegseth’s service to our nation, including leading troops in combat and advocating for our veterans. However, these accomplishments do not alleviate my significant concerns regarding his nomination. Managing the Department of Defense requires vast experience and expertise as the department is one of the most complex and powerful organizations in the world, and Mr. Hegseth’s prior roles in his career do not demonstrate to me that he is prepared for such immense responsibility. His leadership of two veteran organizations was marked with accusations of financial....

mismanagement and problems with the workplace culture he fostered.

Although he has recently revised his statements on women in combat since being nominated, I remain concerned about the message that confirming Mr. Hegseth sends to women currently serving and those aspiring to join. Women have served our nation with distinction, overcoming immense obstacles to excel in combat and leadership roles, and they deserve to know that their leader honors and values their commitment to our nation.

While the allegations of sexual assault and excessive drinking do nothing to quiet my concerns, the past behaviors Mr. Hegseth has admitted to, including infidelity on multiple occasions, demonstrate a lack of judgment that is unbecoming of someone who would lead our armed forces. These behaviors starkly contrast the values and discipline expected of servicemembers. Men and women in uniform are held accountable for such actions, and they deserve leaders who uphold these same standards.

Above all, I believe that character is the defining trait required of the Secretary of Defense, and must be prioritized without compromise. The leader of the Department

Something not codified plainly into law can be reinterpreted later and Lincoln wasn't having that. And he needed something for Southern states being returned to normal status to sign that said they yielded on that point.

of Defense must demonstrate and model the standards of behavior and character we expect of all servicemembers, and Mr. Hegseth’s nomination to the role poses significant concerns that I cannot overlook. No, it was a patented late hit on a nominee by a disgruntled Dem associated ex inlaw. The ex-wife (no2 of Hegseth I think) alleged to have suffered domestic abuse said it was false and her lawyer would take legal action against those repeating the smear.

If for no other reason to disincentivize this sort of poo flinging by Dems, any late hit should be ignored. Hegseth's appointment was clear well over a month ago so plenty of time to present evidence instead of after a committee yes vote.

Posted by: garrett

Three states still had legal slavery but did not leave the Union--Missouri, Kentucky, and Maryland. Emancipation was under Commander in Chief role and only covered where the US military was the defacto government. Thus, the 13th Amendment drove a stake in the heart of slavery including in the remaining three slave states in the North. Remember, Dred Scott was actually still ruling precedent and it was so bad it took three amendments to fix.

A conspiracy of infamy so black that, when it is finally exposed, its principals shall be forever deserving of the maledictions of all honest men."

306 Flounder did good with "dude date."
A typing variance can be like found wisdom, sometimes.
So many of these disclosures happen because of dude dates.

Actual due dates are good too, but there's a working alternative in modern practice: put the new policy, or policy retraction, into use at once via EO, with the set term 'research' due on a date certain, the way public comment periods are supposed to work. Those now arguing status quo are then reduced to status quo ante, and have to overcome new and real evidence. Good fun.

Palin, in part was destroyed by the cozy arrangements between oil companies and their service contractors, native reservations, and politicians. Ted Steven's trial highlighted corruption issues like getting cheap renovations to houses, etc.

Ted was railroaded but at the same time was a slimy toad getting whatever he could under the guise of 'friendship'. Murcow's father was no different and I suspect his daughter has loose ethics as well.

Also, a presidential "proclamation" isn't exactly legally binding.

In fact, it was meaningless, since he kept slavery in Union states, and only "abolished" it in states that did not recognize him as President and over whom he had no power, and in fact were actively rebelling against the Union and had their own president, who made no such proclamation.

It wasn't for want of trying on maybe 2.5/3 counts.
Missouri fought a bitter civil war ("war between the states" doesn't apply there). Kentucky brokered a deal to stay out of the fighting so wasn't much help for moving Union forces, until the CSA invaded it first. And Maryland pretty-much lost its pro-CSA government because the Union needed to keep DC and to protect Pennsylvania from what was going to become Gettysburg.
The one pro-Union slave state would be Delaware.

I believe our strategic use of Taiwan, mostly around its manufacturing capabilities, makes it far more important to American interests than Ukraine which has never been more than a corrupt sinkhole for American bureaucrats and elected officials.

Saying that Ukraine and Russia can piss off with their war is not the same as saying that all potential foreign entanglements are outside of legitimate American government interest.

Also...we should be working domestically to make Taiwan incidental to our strategic interests through our own high tech manufacturing. In the imperfect world we live in, Taiwan is a strategic interest. In a more perfect world, Taiwan is a redundant manufacturing hub we can afford to lose.

372 Three states still had legal slavery but did not leave the Union--Missouri, Kentucky, and Maryland. Emancipation was under Commander in Chief role and only covered where the US military was the defacto government
-----------------
Add Delaware to the list. Maryland was the captive state. Lincoln sent the Army to seize the State's Legislature and had the guns at Ft. McHenry turned onto the city of Baltimore with the promise to level the place if they secede.

*****

Maryland and Missouri ended slavery “voluntarily” while under Federal control.

The Thirteenth Amendment abolished slavery in Kentucky, Delaware, and New Jersey.

Pretty much.

But the world building and smaller, less important to the plot moments get more screentime.

There's an early moment, still during the Revolution, when a group of nuns are led to the Guillotine. They start chanting, the chant growing weaker as each one is led to the Razor until only the last one, the youngest is left, her voice eventually getting silenced, leaving the whole scene quiet.

It's a great moment that has nothing to do with Napoleon himself but everything to do with France at the time.

And even if it did, how can our form of government work with a country that is trying to maintain a world wide empire? It doesn't.

And many of our problems today arise from the post - WWII era that was the beginning of some really shitty horrible people getting very rich off this kind of global adventurism.

383 No, this is proceeding according to plan. The Judge did the right thing. The President can't change a SCOTUS interpretation of a constitutional amendment with an executive order.

Next step is the appeals process.

I also imagine Trump will find some realllly unsympathetic Defendant who claims US citizenship to deport.

There are multiple methods to get there, but basically this needs to get in front of SCOTUS. Lower courts hands are largely tied here.

I started to say something like, "and because it's an election year, we should consider whether it's appropriate to have have a prepared statement for either a Trump or Harris victory, or if that's not our lane."

Soon as I said "election year," there was a perfectly-executed performative groan followed by a "God help us" from an AWFL. It's a mental illness. They HAVE to let you know how they feel whether you care or not.

393 I believe our strategic use of Taiwan, mostly around its manufacturing capabilities, makes it far more important to American interests than Ukraine which has never been more than a corrupt sinkhole for American bureaucrats and elected officials.

It's a very common strategy. It's how pretty much every major landmark SCOTUS case you've ever heard of happened.

Government or outside organizations set up a scenario to try to get a case in front of SCOTUS to change the interpretation of the law.

It's not easy to do. And ending birthright citizen is a long shot (unfortunately), even with this court. And even if it does end, it will be years from now.

406 325 The judge that blocked Trump's EO was a Reagan appointee.

Why does this never happen to Democrat appointed judges?
Posted by: Leupold
=====
Lot of the older judges were appointed via a blue slip procedure in the Judiciary Committee where home state senators (even Dems) could torpedo any district court judge that they did not approve of. The threat was also that any judge outside the norm could be filibustered so required 60 votes.

The logjam was broken by Harry Reid eliminating the filibuster for executive and judicial appointments and the Judiciary Committee blue slip process was so abused that gradually it was reduced in influence in blocking nominees.

Now you get full on District Court Commies from the Dems when they hold the Presidency and more conservative GOP judges appointed by Trump. E.g. of the old regime, Sotomayor was first appointed as District Court judge by GHWB in a deal brokered with the Dems in NY.

The entire reasoning behind this fight is to get a SC ruling on the meaning of the 14th Amendment. Open borders types have declared for decades that it means that if you set on US soil and give birth the child is automatically a US citizen.

That is not what the Amendment says but nobody has ever challenged it before. Now the fight is on and the only way it gets decided is at the SC.
