The Morning Rant: Minimalist Edition
President Donald Trump on Monday, in one of his first official acts as president, signed an executive order ending birthright citizenship. The executive order clarifies that the federal government does not automatically recognize birthright citizenship for children born to illegal immigrants in the United States. Earlier, Trump acknowledged in comments that the order could be controversial and that he was expecting an imminent legal challenge. Birthright citizenship has been enshrined in the U.S. Constitution since the 1898 Supreme Court case United States v. Wong Kim Ark. Trump said that automatic citizenship was “just ridiculous” and that he believed he was on “good [legal] ground” to change it.That court case doesn't seem to apply to our current problem: possibly millions of anchor babies born in the United States for the express purpose of subverting our immigration law! United States v. Wong Kim Ark is a narrow finding that simply does not address the status of the parents of anchor babies. That question needs to be answered, and the law needs to be clarified by Congress. The obvious answer is that the fruits of an illegal act are also illegal. Can I rob a bank, use the money to buy a house, and keep the house? Can I kill my wife and collect the life insurance? The answer is a resounding "NO!" But the illegal act of the parents confers citizenship? That's nuts. And it gets worse. Once anchor babies reach 21 years old, they can sponsor their parents for citizenship. That seems completely at odds with a plain understanding of the rule of law. I think Americans will support a law that clarifies that the offspring of legal immigrants are citizens, since the pathway from legal immigrant to citizen is clear, and taken by many hundreds of thousands of legal immigrants each year. But the gaming of our system must stop, and hopefully the current anchor babies will be reclassified as illegals and deported. Yes, those wonderful "Dreamers" need to be tossed out and told to get on line like all of the law-abiding folks who want to come to America. Is that mean? Is that cold-hearted? Is that callous? As hugely important as this issue is, the relationship between the judiciary and the rest of the government will be even bigger, and this will be the test case. The country is sick to death of preening judges, unmoored to anything intended in the Constitution, making laws for the rest of us. Trump is going to challenge them. It's a fight we must have.

Like most of the 14A, it's drafted like dogshit and using terms that had meaning back then, but don't have the same meaning now.
It's not really about "jurisdiction" in the modern sense. It's more about "allegiance" in the sense that diplomats' children born in the USA are not considered citizens because the parents owe primary allegiance to their home country. And diplo children are in a better position than illegals, as their parents are here legally.
It's insane to me that diplo's children are not citizens, despite that they are legally here, but children of illegal invaders somehow are.

Because there are a number of things that experts point out have not been "tested in court". For example, in this status is the common citation: You can't yell "fire" in a crowded theater (even if there IS a fire?).

It has nothing to do with the "subject to the jurisdiction thereof" clause of the 14th.
Because that wasn't even at issue in the case--his parents were lawful residents in that case.
There was no question on that point.
Accepted as fact by all parties.
Not one of the anchor babies parents now were lawfully within the United States.
And if his parents in that case were not lawfully present as PERMANANT residents of the United States?
Absolutely no question at all without a single doubt they would not only have shipped his ass back to China, they would have loaded his parents on the same boat.
His deportation in that scenario wouldn't have even been appealed.
That is the huge, massive difference now.
Anyone who tells you the SCOTUS already decided birthright citizenship, in favor of the current practice, is lying.
Birthright citizenship is only for children of lawful AND permanent residents.

My plan:
- any illegals caught are tattooed, DNA fingerprinted, and get an RFID implant
- sentenced to one year hard labor on the border
- after that, shoved across the border to Mexico
- they will never be eligible to immigrate legally or even visit the U.S.
- if they are caught in U.S. again, they are put to death
But that’s only if you’re interested in actually stopping immigration.

Prior to that act, almost no American Indians were US citizens - they were citizens of the Sioux Nation or whatever (a few tribes acquired US citizenship by treaty).

Those still in custody pending trials or sentencing are not included. Their cases will be dropped, but that takes a little time to file motions, etc. That is underway and ongoing.

There is a basic misunderstanding of the 14th amendment. It's primary purpose was NOT regarding immigrants but rather undoing Dred Scott decision. In that, Justice Taney claimed that his reading of the Declaration of Independence meant blacks could NEVER be citizens of the United States. He opined that the entire body of law since the Declaration only applied to whites, not blacks. He did so in part to remove any protections that states, local governments, or even past federal government actions, to recognize blacks as US citizens.
It gets complicated but it has to do with the access to courts, and so on because Taney categorized blacks as property and outside the political community created by the Declaration and subsequent federal governments.
Appalling judicial activist decision designed to resolve the slavery problem by reclassifying blacks, even free blacks as something other than citizens in the polity.
Thus, the 14th Amendment's provisions then meant that Southern states could not deny blacks voting and citizenship relying on the Dred Scott decision.

The way these kinds of resolutions happen where things are repealed is that it kills any use of the tactic going forward but leaves everything done in its name in place.
It's what happened when Chevron was overturned with Loper.
I mean...I wanted SCOTUS to say, "And all regulation written without explicit intent from Congress is hereby null and void." But I knew it wasn't going to happen.
Don't let the idea that "oh, it'll be messy afterwards" affect your judgement of what can come. It's easy to side step a lot of that and SCOTUS has shown that it is willing to do just that.

A Chinese couple worked at a place I did. We collected a lot of scientific data on the Pacific Ocean. They had twins here. The were supposedly doing "research" on the data and copied all of it to a portable drive, flew back to China with their kids.
The mother was welcomed back to the lab about 3 months later.... without bringing the data back.
This sort of espionage goes on all the time with foreigners who have kids here. It's used as a head fake. The feds fall for it every time.

Going to have a tough time with any Defense Contractor as well as they hire retired generals for the access and knowledge of systems and acquisitions. All requiring a clearance.

Andy Canuck had posts in the Morning Report stating that some prisoners could not be released as the pardons did not cover them, since there are some prisoners being held who have not been convicted yet. For those prisoners to be released, I think their lawyers need to file paperwork to get their cases dropped.

That said, also remember that all of Trump's EOs he signed yesterday were drafted well in advance and without knowledge of Biden's last-minute piles of crap. Even with that in mind, I prefer that Trump is getting back to using pardon power properly and is not normalizing Biden's BS.

Defendants still awaiting trial or sentencing -- the vast majority at the jail -- have not been pardoned. Trump ordered their cases dismissed. That's not going to happen at 11 p.m. on a federal holiday.

The Constitution granted the naturalization process to Federal Government so that there is one rule of naturalization for all the States to follow for consistency but in the end that is merely so one can be naturalized as a citizen of a State.

I think Fort Liberty is just plain corny. But I've no problem with Fort Cavazos. I served with him and he was a very fine commander.
Funny story...the last time I saw him was on a flight from Europe to the US. He was seated on the other side of the airplane (commercial flight) and someone recognized him. Before long he had half a dozen people surrounding him as he told war stories and generally entertained folks. Very cool guy.

My understanding is that two that had been convicted were released last night after a WH staffer showed up (still in his tux) and intervened. However, I think those being held but not yet convicted have to go through the paperwork drill of having everything dismissed. That said, you'd think the gulag schmucks would be bright enough to go ahead and release everyone. But they're not.

Has never been considered such in other cases. For example detention of foreign nationals living here during wars with their native country. You cannot try them for treason as they are foreign citizens that owe allegiance to other countries.
There are a lot more legal examples out there where someone living here does not equal subject to the jurisdiction thereof other than diplomats.
It is a term of art (aka legalese) to distinguish those within the political society aka community of the US recognizing US sovereignty and law as binding on their actions.

IANAL but I believe there is a term for a law (EO) which is impossible to implement in a Constitutional manner. If I understand correctly, you don't need to show that a specific person is harmed in that case.
If, for example, Trump had an EO which stated that all persons with blue eyes would be put to death... the courts would not wait for someone to die before they stepped in.

I cannot speak to the individual facts of a bunch of cases but there is a Speedy Trial statute--18 U.S. Code § 3161 - Time limits and exclusions. What you are seeking is section (h) which deals with exclusions from the 60 day (generally) from indictment to trial incarceration. Lots of bad things gubmint can do such as routine defense motions on discovery or suppression that reset that clock over and over again.
The constitutional rule still exists but in practice, like the contract clause of the Constitution, Scotus has largely ignored the plight of defendants suffering from extraordinary delays for trials.
Prosecutors use this on purpose to punish accused so that it a) keeps them off the street, b) makes them plead guilty.
