The executive order clarifies that the federal government does not automatically recognize birthright citizenship for children born to illegal immigrants in the United States. Earlier, Trump acknowledged in comments that the order could be controversial and that he was expecting an imminent legal challenge. Birthright citizenship has been enshrined in the U.S. Constitution since the 1898 Supreme Court case United States v. Wong Kim Ark. Trump said that automatic citizenship was “just ridiculous” and that he believed he was on “good [legal] ground” to change it.That court case doesn't seem to apply to our current problem: possibly millions of anchor babies born in the United States for the express purpose of subverting our immigration law! United States v. Wong Kim Ark is a narrow finding that simply does not address the status of the parents of anchor babies. That question needs to be answered, and the law needs to be clarified by Congress. The obvious answer is that the fruits of an illegal act are also illegal. Can I rob a bank, use the money to buy a house, and keep the house? Can I kill my wife and collect the life insurance? The answer is a resounding "NO!" But the illegal act of the parents confers citizenship? That's nuts. And it gets worse. Once anchor babies reach 21 years old, they can sponsor their parents for citizenship. That seems completely at odds with a plain understanding of the rule of law. I think Americans will support a law that clarifies that the offspring of legal immigrants are citizens, since the pathway from legal immigrant to citizen is clear, and taken by many hundreds of thousands of legal immigrants each year. But the gaming of our system must stop, and hopefully the current anchor babies will be reclassified as illegals and deported. Yes, those wonderful "Dreamers" need to be tossed out and told to get on line like all of the law-abiding folks who want to come to America. Is that mean? Is that cold-hearted? Is that callous? Pretty much hinges on what "subject to the jurisdiction of" means. It's a very reasonable position to take that it applies to children of citizens (natural born or naturalized) and legal resident aliens, but not to illegal aliens or people on temporary visas.

Many have said that a constitutional amendment is required; but I believe the Indian Citizenship Act of 1924 is precedent for the action required to address citizenship standards under the 14th Amendment. In that bill, the Citizenship status of native Americans was completely rewritten, and no change to the language of the 14th was required.

I'm a big softy. I'd say the anchor babies may return as citizens -- but only when they reach 18 or 21. However automatic chain migration must end. If the parent(s) were here illegally when baby was born then they are probably DQ'd to come here ever since they are criminals. Wong Ark did not deal with illegal immigration as both of his parents arrived in the US legally when he was born as legal residents. Wong Ark went to China on an extended trip and when he came back, he found himself excluded from the US as a non-citizen (immigration laws changed during the interim to reduce immigration from Asia). Wong Ark Kim sued and won as the child of two legal residents in the US being born in the US.
(My opinion here below, ) But, subject to the jurisdiction thereof, has a specialized meaning. It means that a person admits the jurisdiction (the legal right and loyalty) of the nation that they are currently in. You have to go back to Blackstone and Coke regarding arcane phrases but UK dealt with it regarding subjects (not citizens) of the British Crown. Sojourners would include travelers on ships, merchants, diplomats, etc. that held foreign citizenship but were not technically subject to the same laws that subjects were nor were considered part of the community. If we can't pardon somebody until they are sentenced, then we should be able to investigate, indict and try Fauci and Milley, and Schiff and anybody on the J6 committee.

The main problem was that each person a was citizen of a particular state. So I was born in Maryland, I was a citizen of Maryland, not of the “United States”. That’s why I can’t vote in Arizona elections, because I’m not a citizen of Arizona. That’s the entire idea of a federal system of government.
It’s only through my citizenship of a State that I have my interactions with the Federal Government. The Constitution granted the naturalization process to Federal Government so that there is one rule of naturalization for all the States to follow for consistency but in the end that is merely so one can be naturalized as a citizen of a State. The constitutional rule still exists but in practice, like the contract clause of the Constitution, Scotus has largely ignored the plight of defendants suffering from extraordinary delays for trials. Basically, all you have to say is that anyone with legal status in the country, ie, green card holder, work permit or who otherwise has authority or permission to be present in the country falls under the definition under jurisdiction thereof, anyone else falls outside, that would necessarily include illegal aliens, this would not include people in the country illegally or waiting to have their status adjudicated.
