Criminal Judge Merchan "Sentences" Trump to "Unconditional Discharge"

Thank God it's Friday! This has been a long week. I've been low-grade sick all week and am looking forward to just relaxing.

How about you? Any plans?

He made sure he got Trump sentenced so that the left's goal of calling him a "convicted felon" would be achieve.

But he sentenced him to nothing.

President-elect Donald Trump has been sentenced to an "unconditional discharge" over his conviction on 34 counts of falsifying business records. The sentence imposes no fines, probation, or jail time, with Trump, set to regain presidential immunity after his inauguration, calling the case an "embarrassment" for New York's judicial system.

Trump's sentencing took place virtually, with the president-elect appearing from Florida alongside his attorney Todd Blanche, whom he has chosen as deputy attorney general. Manhattan District Attorney Alvin Bragg, who prosecuted the case, was present in the New York courtroom.

"Fusion" Ken Dilanian -- who basically rewrote FusionGPS's press releases and called it reporting for years -- was ecstatic that "NOW you can call Trump a convicted felon."

But did he clear this tweet with the CIA like he clears his "reportage"?

No Fines? WTF? What a piece of garbage. Did Cohen serve like 3 years for the same crime and Trump is the boss, so his punishment should be worse than that?

Hope Hicks testified at his trial. Her testimony was minor but she worked in the White House which will give the Supreme Court an excuse to overturn the conviction.

Sherlock Holmes purists *really* don't like Elementary, but I loved it. The show had an interesting take on all the Holmes characters, even Moriarty. While the Cumberbatch series had some singularly outstanding episodes (A Scandal In Belgravia was probably the best one in the entire series), it really crapped the bed toward the end of its run. Elementary, on the other hand, I found to be fairly consistent in its quality.

I agree, but think it was larger than him. He would never make any ruling that wasn't pre-approved by the powerbrokers. Judges in NYC are elected, which in practice means the party chooses the candidates and those candidates are elected by the overwhelmingly Democrap voters. Merchan's entire fate and future are in the hands of the powerbrokers. He would never cross them.

211 Sherlock Holmes purists *really* don't like Elementary, but I loved it.

Yes, Jonny Lee Miller is excellent!!

If you want to get more Sherlock-ception going, check out The National Theatre's production of Frankenstein, directed by Danny Boyle. Jonny Lee Miller and Benedict Cumberbatch switched off playing the doctor and the monster on different nights. It's an amazing case study in the choices actors make for a role, and it was, weirdly wnough, done using two actors known for their modern Sherlock Holmes roles.

Benedict studied patients in hospitals with severe injuries, to create his monster. Jonny had just had a kid, and he was inspired at how his new baby explored and discovered the world; he took that innocence and twisted it for his monster. Fascinating to see.

National Theatre filmed the play, and used to bring out both versions of the show in movie theaters around Halloween. You might also be able to buy or stream it.

297 >>> This tendency now to paint Holmes as a sociopath or as a high-functioning autistic annoys the hell out of me. Doyle's Holmes was a successful man, a highly placed fellow in Victorian society, and perfectly capable of interacting in a normal fashion with the people he met as part of his work.

The way to keep Holmes fresh is to allow different interpretations, even odd ones. We live in a very "sociopaths are just dreamy and misunderstood antiheroes!" time. The great Holmes movies with Basil Rathbone had the most idiotic, bumbling Watson as a foil for Holmes' greatness. I really like the modern reinvented interpretations of Watson, whether it's Martin Freeman or Lucy Liu, as young, smart, wounded military vets/doctors with PTSD or trauma, and working with Holmes is cathartic for their healing process.

I'm sure both characters will be reimagined for new audiences. As long as the core of the characters is the same, I'm all for it.

I agree. SCOTUS consists of three liberals (Sotomayor, Jackson and Kagan), three conservatives (Thomas, Alito and Gorsuch) and three right-leaning swingers (ACB, Kavanaugh and Roberts). I actually think that is a good mix for SCOTUS. There may be a period (like now) where it's better to have a solid 6-3 to roll back the Warren excesses that Rehnquist was unable to fully complete, but in normal times this 3-3-3 mix is one that is good for the country.

329 >>Actually, on the big stuff, RvW, Chevron, et al, she's been solid, and on 2nd order concerns, she's been spotty.

I’m not convinced either of these are wins for the right. I think abortion is murder and thankfully it’s illegal in my state. However, it’s pretty easy for women seeking an abortion to drive a couple of hours to a state where it is legal.

Meanwhile, it seems everywhere it’s been put to a vote the majority have come out in favor of abortion, even in so-called conservative states. Not good.

As for Chevron, I remain skeptical. It was bad law, but I think we’re likely to see Federal judges overriding executive branch agencies with left-wing nonsense. The majority of judges are left-wing. We’ll get some crap like a Hawaiian judge banning drilling in ANWR because muh climate.

332 If it hasn't been noted, under common law a felony was such a severe offense to the people that the only punishment was death.

Now tell me, what is the offense to the public, that is so great, that 34 felonies results in ... nothing?

Hell, name another crime you can be convicted of 34 times and receive zero punishment.

PS: that the judge took into consideration that Trump will be President in 9 days is itself grounds to overturn the conviction as the judge considered factors and evidence not presented at trial in rendering the sentence.

Posted by: People's Hippo Voice at January 10, 2025 12:57 PM (7+f8Q)

333 I think this decision actually is in Trumps favor, as it closes this chapter and and allows for the appeal, otherwise, these dickbags would have postponed sentencing until Trump left office and then throw the book at him.

I'm no attorney, but it seems inappropriate for SCOTUS to step in on an emergency basis on this ruling, instead of letting things work through the slower, more traditional appeals process. What irreparable harm does Trump face if this sentence is imposed? Nothing, as far as I can see.

If it were going to stop him from taking office, prevent him from seeing classified information, etc, or if the sentence tried to lock him up, I could see the issue, but as is...doesn't seem like an emergency appeal/injunction is needed.

Posted by: Darrell Harris at January 10, 2025 12:53 PM (PrPcQ)
________

I'd rather see a solid 6-3 in our favor, but otherwise I agree. I think overall the court has been better for us than we give it credit for. Yes, we lost some we should have won. But we won some truly monster appeals that, at least in theory, gutted the leftist establishment we've been fighting for decades. We're not undefeated, but we have a winning record.

I was doing my own thing, and I looked up and Cumming was wearing an outfit that made him look like Darkwing Duck, but gayer.

Here's what Darkwing Duck looks like:
http://tiny.cc/5p15001

I remarked in wonder to my wife that I was impressed with how the costumers for the show managed to come up with so many different super gay outfits for the host. I got a scolding for saying that, thinking like that, and how she doesn't think about people or outfits that way. She then warned me against saying things like that in front of our son.
