Trump Files Emergency Appeal to Delay Merchan's Political Rush to Brand Him a "Convicted and Sentenced Felon;"
Judge Aileen Canon Blocks Release of Jack Smith's Hitjob "Report"

Jack Smith needs some prosecutorial attention.

If it's good for the goose, it's even better for the rogue prosecutor bending the law to persecute the goose.

A federal judge has temporarily barred the Justice Department from releasing a special counsel report in the classified documents case involving President-elect Donald Trump. The legal dispute now moves to the appeals court.

Key Details:

Judge Aileen Cannon issued a temporary block on the release of special counsel Jack Smith's report while the Eleventh Circuit Court of Appeals reviews an emergency motion filed by Trump's former codefendants.

Prosecutors had indicated the two-volume report could be released as early as Friday, pending approval from Attorney General Merrick Garland.

The appeals court decision comes weeks before Trump's inauguration for a second term, with related cases dismissed and unresolved legal questions about the report's release.

According to most, an accused isn't considered "convicted" until sentencing. Merchan can't sentence Trump to jail, because the Constitution demands that the elected president be permitted to take office without restraint by petty judges.

But Merchan can sentence him to something, like time served, just to brand him a "convicted and sentenced felon," which is of course the entire reason for this pretextual prosecution and sham trial with a handpicked political judge.

Trump has filed an emergency appeal to stop Merchan's literal rush to judgment.

John Sexton, quoting AP "News:"

Yesterday, Trump appealed to Judge Merchan to reconsider and, as expected, the judge said no. Today, Trump's legal team is taking his case to an appellate court.


President-elect Donald Trump tried again Tuesday to delay this week's sentencing in his hush money case, asking a New York appeals court to intervene as he fights to avoid the finality of his conviction before he returns to the White House.

Trump turned to the Appellate Division of the state's trial court a day after the trial judge, Judge Juan M. Merchan, rebuffed his bid to indefinitely postpone sentencing and ordered it to go ahead as scheduled on Friday.

Trump is seeking an immediate stay that would spare him from being sentenced while he appeals Merchan's decision last week to uphold the historic verdict.

The expectation is that a single judge will hear the request and issue a response today. If Trump gets a stay from the appeals court judge, that would probably be enough to push this back past his inauguration.


An emergency request like this one will fall to a single judge, who is expected to hold a brief hearing early Tuesday afternoon. That appellate judge could then issue a ruling before the end of the day.

If the judge grants an interim stay, it might effectively scuttle any chance of sentencing Mr. Trump. A full panel of appellate judges might not have time to take up the matter before Friday, and the window to sentence Mr. Trump is rapidly closing. Once he returns to the White House, Mr. Trump cannot face criminal prosecution.

I'm sure New York will also handpick the judge who first sees this appeal.

Look - I'm sure Trump is doing what Trump always does. Pay his lawyers very well, and meticulously follow their advice.

That's the problem, when dealing with a corrupt legal system. Your best action isn't always to listen to the lawyers - even your own lawyers - who are by definition part of the corrupt system.

Trumps at his "Jesus flipping the tables in the temple" moment. That's his best play. But I just don't think its in his psyche to do such a thing. Its not how he's wired.

When you file your yearly taxes, you must include a document that demonstrates you have paid for insurance or have medicaid/medicare. If you do not have the document (haven't paid or demonstrate such need that you have to have medicaid/medicare), you are fined 783.00 per person in your family.

That was prior to the immunity decision and the major weakness of the NY case is that it defines as a predicate crime what federal law refused to do as in the FEC and federal prosecutors. Those create 'federal questions' that allow Trump collateral avenues to challenge the conviction via federal courts. The nexus of the immunity decision by Scotus and NY case is that the prosecutors presented evidence regarding Trump's actions in office to the jury and the judge allowed it over the objections of Trump's lawyers. Scotus was clear that lower courts had to have meaningful review of what was barred and what was not in their immunity decision.

Merchan,Fani in GA, and the ridiculous electors case in AZ were all impacted by that decision and none of those courts ever effectively addressed the Scotus decision other than a cursory no it doesn't apply rulings from the bench.

I dropped my health insurance (but added $25/month dental) and did not get Obamacare. Never got fined, did my own TruboTaxes.

Obamacare saved me money (but there was risk). For about three years I had no health insurance, saved me about $1000/year. Medicare Advantage now.

Impeachment and removal is mainly to end their pensions and positions so that others can be appointed to the vacant position. Federal judges themselves are not immune from prosecution and conviction for their acts that are criminal and outside their legal duties aka ultra vires. Any potential criminal charges would have to sieve through the judges communications and actions with prosecutors that violated the rights of the defendants so that they could be charged with violating the defendant's civil rights. Not an easy task as official rulings are given absolute immunity by the court doctrine. You would need something like Operation Greylord.

E.g. Walter Nixon v. US was a convicted federal district court judge sitting in prison for bribery and obstruction but he was still getting paid and pension benefits due to his not being removed by the US Senate via impeachment.

Nixon refused to resign after being convicted and thus the House and Senate had to impeach him to remove him from office.

No, and no. For all the people opining about Trump's sanity regarding Greenland, you haven't heard a No from the actual people in Greenland. Methinks they'd rather be affiliated with the US than the EU. Oh, and regarding court, the more the Dems want to keep plucking this chicken that the US electorate soundly rejected, the more I say let them pluck away. There is a growing movement saying that those individuals acting without constitutional authority on behalf of a president who is falsely considered mentally competent, while simultaneously hiding that pertinent medical information are open to criminal investigation and indictment.

The bonus is that in order to prove their innocence, discovery would be required....and that includes learning publicly just how bad things were with Biden behind the scenes. He's a laughing stock now....but he would be portrayed as a bigger buffoon than even I thought possible.

Don't forget medical device expenditures via scripts and OTC drugs if you have the receipts for it. Some stores separate line items for cafeteria aka flex plan items which is useful to document these expenditures for deduction calculations.

It would instead mean he was and people voted for an unjustly tried and convicted political prisoner;
