Fire Them All: The Democrats' Manueverings Have Granted Trump the Power to Fire Anyone He Wants

Back in 2021, Biden terminated the appointment of Sean Spicer to a Navy body.

The Democrats have no standing to claim that Trump can't do the same.


President-elect Donald Trump is arriving at the White House armed with a legal weapon that will let him fire any of President Joe Biden's appointees.

Thanks in part to a court fight former Trump White House spokesman Sean Spicer lost over his firing by Biden from a three-year term to the Board of Visitors to the United States Naval Academy, the incoming president will have the legal backing to dump any of Biden's over 4,000 appointments who try to stick around.

And the best part, Spicer told Secrets, "They'll have no one to blame but Biden himself."

The case dates to Sept. 8, 2021, when Biden began to fire Trump allies from the visitor boards at the academies of the Navy, the Air Force, and the Army.

Spicer and others, including Russ Vought (just picked by Trump to head the Office of Management and Budget) and former Trump counselor Kellyanne Conway, were unceremoniously dumped despite several of them having time left on their three-year terms.

Spicer and Vought sued, saying that unlike White House staff or others appointed by a prior president, they couldn't be fired because of their congressionally mandated terms.

They lost, however, when a judge essentially ruled that the president could fire any presidential appointee, whether they had terms or not. A further effort failed, too.

Spicer said he didn't sue to get the job back -- he sued to get the Democrats to argue that the president could fire whoever he liked. The Democrats did argue that, and won.

And now Trump owns the precedent.

Meanwhile, Schumer schemed to give an extra-long term to a last-minute appointee.


As RedState reported on Tuesday, Senate Majority Leader Chuck Schumer schemed to create a years-long installation of Democrats on the National Labor Relations Board (NLRB) through President-elect Donald Trump's entire second administration. On Monday, Schumer filed cloture on the nomination of current NLRB Chairman Lauren McFerran to extend her term into 2026, and pushed for a Wednesday vote in the hopes that a thin Democrat majority, coupled with the absence of certain Republican senators on the floor, would work in his favor.

Schumer not only had his hopes dashed, but his comeuppance came at the hands of two independent members who caucus with his own party.


[CBS:] A Democrat-led push to secure a majority on the National Labor Relations Board until 2026 fell short on Wednesday, as Senate Republicans and two independents blocked the nomination of Lauren McFerran to continue serving on the labor board.

Senate Majority Leader Chuck Schumer filed cloture Monday on the nominations of McFerran, a Democrat, to remain for another five-year term on the National Labor Relations Board. McFerran is the current chair of the NLRB whose term is set to expire later this month. Her confirmation to another term would have maintained a Democratic majority on the board, in a move that would have marked a key victory for Democrats heading into a second Trump administration and a Republican trifecta in Washington.

In a 50 to 49 vote, Senate Republicans, joined by independent Sens. Kyrsten Sinema and Joe Manchin, blocked the nomination from advancing. Without the confirmation, the board is expected to swing to come under Republican control, with a vacancy for President-elect Donald Trump and the incoming GOP-controlled Senate to fill in the new year.

6 Washington Times is reporting something similar with the FBI. We know they will try and burrow saboteurs deep inside all these agencies. Trump team needs a plan to deal with it.

That's one of the things that really bothers me about Spellcheck.

I was once Christmas shopping for my WWII veteran father-in-law, and found a book I thought he'd like which were the memoirs of a German panzer commander. On the title page it said "Translated form the German by..". At this point I shut the book and put it back on the shelf. I knew my FIL would not countenance that kind of thing in a published work.

But there was no red sqiggle under that "form," so some lazy kid working in the printing house never caught the error.

I don't do without Spellcheck entirely, since it does catch things that the human eye might otherwise miss, but I always make sure to print out the doc and do a proofread of the hard copy as well.

During that time, she did X. The day I won the election, she immediately quit her job, and got hired as a civil service flunky for agency X.

Make it clear to the American people what they are doing and why it is so wrong.

All these people, by the way, will then leave and go to work for NGOs.

Probably. I'd still like to see an EO directing every federal department and agency to cut 50% of civilian staff, and 100% of contractors, within three months, and assess the effects on performance. Continue each quarter until real effects are seen for US Citizens.

If the wrong positions/people are cut, then any restaffing must be met with corresponding cuts in management who made the decisions on who should be cut.

I'm so glad someone finally brought that up. We'd be better off if we had a hybrid Spoils System. Everyone who wants to work in gov't has to take a Civil Service exam - and not an easy one, either. Then, the spoils system will allow for all political or political-adjacent hires to be fired with a new administration. The whole lot stays as long as the party in power does.

Most of the bad effects were overstated. There was the normal grifting types and it became a nuisance for presidents like Lincoln to deal with the swarms of office seekers. But, presidents that cared could administer their own political programs and the opposition was in open via Congress for the most part, not from their own executive department.

Politically, it was the stench from teh Grant administration and Guiteau's assassination of Garfield that led Chet Arthur to create the limited Civil Service. Over time, the limits were overthrown and we get the mandarin class as UK has struggled against for several centuries now.

Unfortunately, this incompetence is built into the system. Congresscritters are hired to pass laws, not eliminate bad ones. Productivity is measured in how much legislation is passed, rather than whether things actually run well. That's why conservative legislators are always on the back-foot - their principles (in theory) run counter to what the people hired them to do. Unless the incentives are changed, the results will not be.

Harder to overcome YD. DC Court of Appeals decision which is pretty much the core of the bureaucracy. Scotus refused cert. Court of Appeals precedent is Severino v. Biden which was a similar case filed for a similar reason in District Court. Came down to statutory reasons, not constitutional .

You'd probably be shocked to learn that one of the first things they look at is whether you are married. They want you locked in financially. Single guys can make a go of it if they get terminated. Married guys usually have families and financial obligations. The FBI will, also, blacklist you to work in law enforcement if you don't tow the line and get terminated. Also, as far back as the 1990's they'd start off the group application process with a 15 minute video that stated outright that women and minorities would get preference (pssst, that's illegal). The psych test they give you at that meeting is multiple choice and a joke. But, unless know someone or fit into their "minority" preference, you aren't even getting an interview.
