UPDATE: Jurors are instructed to continue deliberating under an Allen charge, after the defense asked for a mistrial, saying such would be "coercive." At this time, we are unable to come to a unanimous vote on Count 1 -- manslaughter in the second degree," read the note, sent around 11 a.m. If the jury is unable to reach a decision, Manhattan Supreme Court Justice Maxwell Wiley reportedly would be required to hand them what's known as an "Allen charge," i.e. instructions urging jurors to agree on a unanimous verdict. The name is derived from an 1896 Supreme Court decision in Allen v. United States. It's considered controversial, and critics warn that such instructions could push jurors to switch up under peer pressure. "In this case, I think that they can't move on to Count 2 unless they find the defendant not guilty of Count 1," Wiley told both sides despite protests from the prosecution. "I have to at least try to ask the jury to find a verdict on Count 1." The latest development on the fact-finding body being deadlocked heightens speculations that the trial will result in a hung jury, meaning a retrial. ... Legal analyst Jonathan Turley noted that the question now is whether the judge will instruct the jury to consider the second charge of criminal negligence. Wiley did express doubt over whether, in the absence of a unanimous verdict on the manslaughter charge, he could tell them to move on to the criminally negligent charge. I did jury duty in NYC for a drunk driving case. Yeah I disobeyed instructions and looked the goof up. He was a menace and I voted guilty. Never told the other jurors but one or two of a certain background were anti-cop. Eventually we somehow persuaded them to vote with us.

I got called up for jury duty right before Thanksgiving. My "term" doesn't start until January, though.

I did jury duty in NYC for a drunk driving case. Yeah I disobeyed instructions and looked the goof up. He was a menace and I voted guilty. Never told the other jurors but one or two of a certain background were anti-cop. Eventually we somehow persuaded them to vote with us.

There isn't a single self-defense case that happens that is not vociferously argued to be an illegitimate use by one or more commenters here. People want to flyspeck self-defense and defense of third party cases with 20/20 hindsight from the comfort and safety of their armchairs. You'd have to have a very high tolerance for risk to involve yourself in someone else's problems at this point.

That includes Rex Harrison who got 4 Democrats to vote for him.

My worst jury duty was a guy that was a child rapist, he was designated a sexually violent predator that is too dangerous to be let out of the mental hospital because he will reoffend. The state has a trial to keep these guys locked up.
He was his own attorney and it was terribly upsetting. One guy on the jury had a panic attack from the testimony and they called an ambulance.

The only time I was ever called for jury duty it was for a case in which a mentally ill black homeless bum killed a white security guard. The question up for debate was not "Did he do it?" because the whole thing was caught on camera an(d there were multiple eyewitnesses and the guy confessed), but rather, "Is he competent to even stand trial?" We weren't going to see forensic evidence but instead get a procession of psychiatrist charlatans debating whether or not the perpetrator "understood the consequences of his actions" and knew right from wrong.
I was ready to convict him as soon as I heard what the case was even about, but didn't want to participate in the charade for months on end, so I managed to get myself kicked out of the jury pool during the selection phase by answering question with statements like, "If he did it, why are we even having a trial?" and "All criminals could be deemed mentally ill if you stretched the definition," and so on. I was excused, much to my great relief

This has happened in many cases where a deadlocked jury is instructed to go back in and reconsider under the Allen charge. People have been sent to prison because a person/s on a jury have been browbeaten into saying guilty because the rest of the jury is tired and wants to go home. IMO a deadlocked jury is just that - either declare a mistrial and retry the case or don't.

It seems the normative self-defense standard, especially applied to white men in NYC, is you can as long as you don't actually engage in any actual self-defense otherwise this would trial would have been decided in Penny's favor in 15 minutes. Now that the judge is meddling with the fact the jury cannot resolve this normative standard in favor of the prosecution the odds of Mr. Penny justifiably being acquitted grow increasingly uncertain.

I was ready to convict him as soon as I heard what the case was even about, but didn't want to participate in the charade for months on end, so I managed to get myself kicked out of the jury pool during the selection phase by answering question with statements like, "If he did it, why are we even having a trial?" and "All criminals could be deemed mentally ill if you stretched the definition," and so on. I was excused, much to my great relief
I'm not saying its fair to force normal people to put their normal lives on hold for weeks on end but then you end up with a jury of people that believe this whole facade is reasonable and potentially let the guy go.
The right has still generally not learned how to use the jury box.

A while back I pointed out that we could just sit back and make the determination as to which politicians are primarily responsible for the shambles out military has become. Almost immediately, Elizabeth Warren started making noise. Now Ernst. If you listen to some of Hegseth's interviews, he acknowledges the necessity to clean up the military to reflect it's true purpose, but he ALSO points out that the brass aren't the primary problem. It's the politicians that gave them the tools to proceed and the promotions to get it done.
Ernst is particularly interesting (and in this category) because she had the audacity to challenge Hegseth's appointment AND recommend that they choose her instead. She's a primary problem.f

Yes. The verdict must be unanimous. In my experience, (juror in four California trials) there are typically two alternate jurors who don't deliberate. If it's a case of one or two hold-outs, the alternates can be swapped in to see if a unanimous verdict can be arrived at.

I was at my neighbor's house when that verdict was handed down. They're black. The daughter came in all pissed off that they found him not guilty and the parents shushed her real quick and basically told her 'not now' because I was there.
I bet they believe in the whole 'white hispanic' thing too.

Driving home this afternoon, there's some construction on an overpass and the service roads have been altered a bit. It's only two lanes with a right turn lane added. The left lane is left only and the right lane (of the 2 lane road) is straight only, which are both clearly marked with signs as you approach AND there's signs next to the stop lights. The left turn lane always backs up, so every day, there's a douche that thinks they're just that much more important than everyone else and turns from the right lane.

He also said the post of President is a waste because there is basically nothing the "President" can do without a vote by the Parliament.

I'm sorry you had that problem with people being inconsiderate. You are also under tons of stress right now. It's really hard when someone you love in going through cancer treatments and things are out of your control. However, you are part of the world and you're not selfish. Your wife is part of the world and she's not selfish. The people who are praying for her and you are part of the world too. When things seem overwhelming try to break things down into small pieces. The fact that your wife wanted you to put up Christmas decorations is a positive sign, I think. She hasn't given up.
