Bragg is pulling-out all the stops. If this, from Daily Mail, doesn't make your blood boil you're dead. "Under a barrage of public criticism for bringing charges, the prosecutors in Alvin Bragg's office have been on a mission to remind the jury that Penny may not get any prison time at all, even if he is found guilty. That's down to the fact there is no minimum sentence for two of the charges he is facing. The DA's office has been contacting news outlets, including Daily Mail, requesting for that fact to be pushed to the forefront of coverage. Penny's lawyers say it's the latest desperate attempt to get the jury to convict him, on the notion that they will be more inclined to do so if they know he won't rot in prison for years. (Also tea several times a day, which was quite nice!) You were apprised of the charges before hand so that you could make a decision to go private or wait for NHS availability. Now, the downside is medical care in London: every procedure we had to have done there had to be repeated and fixed in the US, because despite what too many like to bleat, we have extraordinary medical care here. Dollars are finite and people's desire for healthcare spending is high. The only time I was ever called for jury duty it was for a case in which a mentally ill black homeless bum killed a white security guard. The question up for debate was not "Did he do it?" because the whole thing was caught on camera an(d there were multiple eyewitnesses and the guy confessed), but rather, "Is he competent to even stand trial?" We weren't going to see forensic evidence but instead get a procession of psychiatrist charlatans debating whether or not the perpetrator "understood the consequences of his actions" and knew right from wrong.
I was ready to convict him as soon as I heard what the case was even about, but didn't want to participate in the charade for months on end, so I managed to get myself kicked out of the jury pool during the selection phase by answering question with statements like, "If he did it, why are we even having a trial?" and "All criminals could be deemed mentally ill if you stretched the definition," and so on. This has happened in many cases where a deadlocked jury is instructed to go back in and reconsider under the Allen charge. People have been sent to prison because a person/s on a jury have been browbeaten into saying guilty because the rest of the jury is tired and wants to go home. IMO a deadlocked jury is just that - either declare a mistrial and retry the case or don't.

The "reasonable person" question makes sense in the context that the primary witness (who was there before Penny arrived) told Penny that the deceased had threatened to kill them, and he had physically assaulted some passengers.
So, the question related to Penny reacting in a reasonable way based on the information provided by the witness (who later admitted to making that up). The witness told the police the very same thing, but eventually recanted it. So, I can understand why the question was presented to the judge. I think it's a good thing, actually. It suggests that they are looking at the actions of Penny as it relates to what he was told as well as observed. Posted by: Orson at December 06, 2024 02:50 PM (dIske) 306

Driving home this afternoon, there's some construction on an overpass and the service roads have been altered a bit. It's only two lanes with a right turn lane added. The left lane is left only and the right lane (of the 2 lane road) is straight only, which are both clearly marked with signs as you approach AND there's signs next to the stop lights. The left turn lane always backs up, so every day, there's a douche that thinks they're just that much more important than everyone else and turns from the right lane.
As you enter the overpass, the left lane is straight and left turn, so will back up, so me, and lots of others turn into the right lane. The self-important douchebags ALWAYS turn into the right lane and honk. Uh, YOU'RE violating the rules of the road. NOT me. ESAD, asshole. I HATE the selfish ass world I live in now.
