Will The Penny Manslaughter Trial Be The Last Gasp Of The Left's Stoking Racial Hatred?

The media and the prosecutors are busily trying to portray the death of a psychotic, violent bum accosting passengers in the NYC subway as just one more example of America's original sin of slavery coupled with the insane power dynamics of post-modernism, Critical Race Theory, and good old White Racism^TM.

The reality is far from that, and the testimony in Daniel Penny's trial suggests that it was just another American who stepped in to protect his fellow passengers. No racial subtext, no class struggle...just a brave man who felt compelled to help those in need.

Jordan Neely was 'trying to attack everybody' before Daniel Penny intervened: witnesses

In the audio, 18-year-old Moriela Sanchez could be heard asking the 911 operator to send police and an ambulance because someone was attacking passengers on the uptown F train subway car. The audio was played during her testimony in the Manhattan Supreme Court.
During the 1 minute recording, Sanchez said about Neely, “He’s trying to attack everybody.” She described the attacker as black and that “There’s one white man holding him down, holding the homeless guy down.” Sanchez added, “Penny put his hands around [Neely’s] neck and then dropped him down so he wouldn’t attack anybody.”

Of course Fox News has already convicted Mr. Penny, as this line from their biased article suggests:

Moments before New York Marine veteran Daniel Penny placed the erratic Jordan Neely in a chokehold that proved fatal, the emotionally disturbed homeless man raised his fists in the middle of a subway car while shouting at passengers, a witness testified Thursday. [bolding mine]

Actually, the trial will determine whether Mr. Penny's chokehold caused the bum's death, but in their usual sleazy and backhanded manner, they are kowtowing to the leftist cant. Of course the mean white man killed the noble black man! How else can it go down in a post-modern society?

But the typical protests haven't occurred, and the gathering on the first day of the trial outside the courthouse by the usual suspects was lightly attended. Is it possible that even NYC is getting tired of rampant crime and chaos, and has a tiny amount of sympathy for the terrified subway riders and the brave young Marine who protected them?

Of course this is a New York City jury, and for all we know they will ask the judge to change the charge to 1st Degree Murder with the option for the death penalty. The racial divisions that the left demands are sadly ingrained in our society, and the reflexive assumption that if a white man is involved he is the criminal is all too common.

But Tuesday's election of a (relatively) tough on crime DA in Los Angeles and the recall of the lunatic Alameda DA suggest that the tide may be turning. If California can recognize the evil of allowing criminals free rein, then perhaps there is hope for the rest of America...even NYC!

Based on the witness testimony, I think he was justified in stopping Neely, and in restraining him.

Where it becomes problematic is him not letting go of the hold when Neely had "urinated and defecated" himself (as per a witness). The video doesn't show that, but it does show Penny holding his neck hold when Neely was clearly unconscious and no longer a threat to him.

Which takes it from self defense to manslaughter.

Which does suck for Penny, I certainly sympathize with the guy. And maybe the jury will look at it differently. But based on that video, I think I'd have a hard time not convicting Penny of something.

Oh, absolutely. I ride the subway every day, and that IS my worse nightmare. Not so much about getting stabbed or whatever, but of having to touch the guy. Penny grappling with him and dropping to the ground is ... hard for me to imagine.

That said, in the recently released video I think it's going to be hard for Penny's lawyers to get around the fact that Penny did not release the chokehold as soon as Neely stopped being a threat. He held it for at least another minute, maybe longer.

I'm just doing a legal analysis of a self defense case here, I'm not commenting on the larger picture.

My opinion is that it's horrible that the city allows these zombie homeless people to wander around the city. Its horrible for the zombies, it's horrible for everyone's quality of life, and it is especially horrible where it ends up in a situation like this where a poor kid trying to do the right thing may end up in prison for manslaughter.

Actually no Harry. You missed the bombshell court testimony that police refused to administer CPR and he was still breathing on his own far later than the media has covered. Narcan was administered first and eventually they gave him CPR.

Like Floyd, the case was shit from the beginning and designed for agitation.

Remember, beyond a reasonable doubt that Penny was the proximate cause of the demise of the crazed.

Regarding self defense law, it goes to when they cease to be a threat using the reasonable perspective and whether the force being used to prevent the guy doing it again is reasonable.

If Penny had used obvious lethal force like a gun or knife, then giving them a coup de grace would be excessive and not proportional to the risk at hand.

Without a lethal weapon per se, then it turns to whether or not Penny's actions in continuing to restrain (as considered by unanimous jury) as he did not have a weapon was reasonable.

That is where the reasonableness and the totality of the circumstances comes in. But the bombshell testimony earlier by the state admitting that the guy was breathing, the police refused CPR initially and administered NARCAN, leaves reasonable doubt that Penny was the proximate cause of the guy's death. Probably be dueling medical examiners on this case and Penny best have good expert witnesses for his defense. From my recollection, NY is not the greatest on self defense provisions unlike somewhere such as Florida.

Yeah, that's the terrifying thing about using deadly force.

The law judges you pretty harshly after the fact.

Which is why it's always preferable to not kill someone if avoidable.

Yes, he had no means of escape. Well, he could have gone between cars on an F train (they're not locked), but I don't think even NY would expect him to do that.

BUT the most recent video is shot from the platform. As in, the doors to the train were open at the time and everyone else was off the train.

I guess my point is: I think Penny was justified in his use of force up until the moment Neely was unconscious.

At that point, Penny should have let go. And we have cell phone video proof that he held on to the hold for at least another minute. There would be no reason to restrain an unconscious person. There was no more danger. There are people on the platform yelling at Penny to release the guy.

Like I said, we'll see what the jury thinks.

The witness testimony (other than the homeless advocate) all supports Penny using third party self defense to subdue the guy.

One of my relatives came home after her baby son died in neonatal intensive care and cut off all her long hair.

300 Point of information here: a "choke hold" comes in at least two, very different flavors. There's something that restricts breathing (cutting of trachea) and a blood choke where you (in this case Penny) get the "V" of your arm under their chin and your bicep and forearm cut off blood flow to the carotids, making the person unconscious.

You can tuck your hand behind their head for stability/style points, as Penny did here. If you WANTED to kill someone you go straight across the trache. Which Penny, who applied a blood choke in a very good-form way, clearly knew how to do, and didnt. And, if you really wanted to kill someone, when applying straight across the trache, you don't tuck that arm into your bicep, but do a gable grip and pull straight F ing back as hard as you can, which crushes the trache and the guy is dead, dead dead whether you do it for a second or a minute.

Anyone who trains Jiu Jitsu knows this.

Also, for those who say he "kept it on too long" the (blood) rear naked choke Penny had him in is all about the flex and amount of tension. If you relax just a bit the blood flows and you're not still choking, just controlling. You can't tell that from the platform.

Two guys got in a fight. The one who started it died accidentally. It's unfortunate. I wish he'd lived.

But let's face facts. He was a clinically insane vagrant whose life mattered to nobody, including himself. The other guy is a seemingly good dude, and a productive member of society who served his country in the war.

Just turn a blind eye to this and let him move on with his now very damaged life. Jury nullification would be nice; failing that, I'd personally hang tough and hang that jury.
