Fifth Circuit: Only Ballots Received by Election Day May Be Counted; It Is Illegal and Unconstitutional To Count "Votes" Recieved After Election Day

The left has been fighting to count votes received four or five or more days after the constitutionally-specified election day.

This appeals court covers Louisiana, Mississippi, and Texas. It doesn't cover that state I mentioned the other day that will count votes four days after the election. However, this ruling could cause other courts to adopt this rule, or the Supreme Court to impose it on them.

The below tweet is incorrect -- a circuit appeals court's decision is only binding on the jurisdictions of the circuit. Sometimes a rinky-dink trail court judge will claim a decision binds the entire nation everywhere. We call those "Hawaiian judges." I've noticed a lot of those decisions get vacated.


We'll have to see. There aren't many days left for litigation!

Unless SCOTUS jumps in with an emergency stay this is going to stand for at least the next few weeks. There is literally no time for a full hearing by the 5th circuit court before election day and no other court has any cases before them to make a contrary ruling.


Problem is, the left has shown they are more than willing to ignore any court ruling they do not agree with.

47 Until a few years ago, Oregon had mail order voting, but ballots had to be in the hands of elections officials by 8 PM on Election Day, not just in the mail.

Now, Oregon has joined Washington in saying that they will count all ballots merely postmarked by 8 PM on Election Day, so ballots can keep being received for a week or so after the election.

Remarkably in both Oregon and Washington, ballots received after Election Day break very, very sharply to the Left.

It's the strangest thing.

At a recent Luzerne County BOE meeting, the manager revealed that an individual turned in a large quantity of forms on the deadline that were dated back to June. This had no connection to @EarlyVoteAction, either. (This batch should also be reviewed.)

I am going to disagree with you.

Within a HOA there is talent enough to get rid of the management company. They exist to do minor tasks and sit on the money. Money in the management company's hands is their goal.

I was President of a Reston, VA HOA (Control freak central) and ran it in such a way that the residents had low dues, less hassle, and the good stuff like trash, street lights, paving, was done. For 5 terms totaling 10 years. It was relaxation for me.

Not a lot of rebellion or grumbling from the residents, as I loved to explain why the actions taken were decided on.

All of the arguments that I have seen in regards to counting ballots received after election day or ballots not being correctly filled out have centered around the argument that blacks and hispanics are too stupid to fill out their ballots correctly and mailing them on time.

The rational is that some people mail it on election day, so it does not arrive until a few days later. There is also a concern that the postal service is not up to the task of delivering intracity mail in less than 2 weeks.


The real reason is that they understand that if an election is close, Dems have the ability to harvest as many votes as are needed. Also they do "curing" where they correct any ballots that have improper ID, etc. and they want to do this as long as it takes for a Dem win.

The main goal though is chaos enable fraud.

No there isn’t. The Post office has been handling elections since 1796. They know how to do this and is almost trivial.

The concern has shifted to “drop boxes” that have no chain of custody nor postmarks nor anything else, really. They are generically called “mail in” or maybe euphemistically called “Mail in” but they are just bins placed by golly knows who and picked up etc.

It's the voter's responsibility to properly execute their ballot. If they fail, their vote doesn't count. Period. Duh. There is no conceivable system in which "curing" or adjudicating ballots would be credible or reliable. It's absurd that any of this was ever allowed to start.

And of course mail-ins are ridiculous and should be banned. Rigorously authenticated absentee ballots - which IIRC always had to be into the county by election day - are the only exception.

I am just outside of Houston and in an HOA. It's okay. The HOA is more proactive than local government would be about issues, which is a curse and a blessing. I get why people hate HOAs. I'm more or less ambivalent.

239 Recall the contested Florida vote count during the Bush v Gore election. Prior to the actual election date, the Florida branch of the DNC sent out letters to their minions in charge of certifying local voter eligibility. Instructing them to use that power to reject ALL vote by mail votes received without postmarks under the argument that lacking such proof, even if they arrived before Election Day that was no legal proof they were mailed by/before Election Day.

Only problem is, there is one voting bloc which does vote by mail WITHOUT dated postmarks. Military voters posted overseas. Free mail, you see, granted by congress. Which voting bloc historically votes more (R) than (D).

So..... the letters asked their minions to reject as "too late" any votes Florida received from military voters from overseas hardship posts.... or from gallifrian Timelords.

Now... technically..... this was following the Letter Of The Law. however legal precedent was to count those votes and not disenfranchise Florida military voters. The majority of the (D) minions ignored the instructions. Count Every Vote - unless it's a likely not Hillary vote it seems.

So which is it, all mail in (so no need to take a day off,) or you take a day off?

I am against a holiday because we have to get back to basics with very very localized voting. Assigned precincts/stations that are so local everyone can stop by on their way to or from work. Or for lunch for those that work near home.

Our main problem is that we centralized and stretched out voting so that there is no real oversight. The ballots should be secure and under eyes from the time it leaves the voter's hands, until it is counted (also under public view, usually in the form of "watchers" designated by the parties.)
Mail-in hands the security to the postal workers - big mistake.
Extended voting hands security to gov. employees. - bigger mistake.
Centralized vote counting hands security to big city machine - biggest mistake.

258 Forgot - no "curing" ballots either. Just as bad as adjudication, and for the same reasons.

It's the voter's responsibility to properly execute their ballot. If they fail, their vote doesn't count. Period. Duh. There is no conceivable system in which "curing" or adjudicating ballots would be credible or reliable. It's absurd that any of this was ever allowed to start.

And of course mail-ins are ridiculous and should be banned. Rigorously authenticated absentee ballots - which IIRC always had to be into the county by election day - are the only exception.

This bull$hit dates back to the 2000 election bush vs. gore. The lower courts kept ruling absurd things about hanging chads, pregnant chads and voter intent based on down ballot choices where there was no vote for president on the ballot. That garbage has permanently stained ballot counting in this country since then.

Rogan's podcasts generally run that long. It is a mildly positive sign it wasn't cut short. Kamala's people claim scheduling wouldn't allow her to appear on Rogan's podcast. Also preventing her appearance, certainty of gaffes and an acute case of common sense.
