Hunter Biden Offers to Plead Guilty In His Tax Fraud Case -- But Only If He's Permitted to DENY All Wrongdoing

So he'll plead guilty while simultaneously maintaining his innocence?


I betcha he'll get his way.


He was charged in December as part of a wide-ranging probe of his finances and business dealings, becoming the first child of a sitting president to face criminal charges.

In the Los Angeles federal court where his trial was due to take place, Biden sought to enter what is known as an "Alford plea," an usual type of guilty plea where a defendant does not admit to the allegations against them.

Unusual, you meant, AP. Great "multiple layers of painstaking editorial fact-checking."


U.S. Justice Department prosecutors in the courtroom said they would not accept that plea. Federal prosecutors generally only agree to Alford pleas in rare circumstances, where they have approval from high-level officials.

The "Alford plea" kinda-sorta got blessed retroactively. A killer named Alford pled guilty to second-degree murder to avoid being convicted of death-penalty-eligible first-degree murder. He later tried to overturn his conviction, saying he had only pled guilty to avoid the death penalty but had always been innocent. The Supreme Court rejected his efforts, saying that if he was informed of the consequences of his plea by a capable lawyer, and still pled guilty, he was stuck with that plea, even if he maintained his innocence.

Having thus been blessed as a plea after-the-fact -- mostly just to shut up a jailhouse lawyer spamming out reasons he should be released -- such "Alford pleas" are now accepted in most jurisdictions, but are rare. You acknowledge that the prosecution has enough evidence to convict you, while remaining resolutely coy about whether that evidence actually proves your guilt.

Alford pleas require DOJ consent.

In 21 years at DOJ I never heard of a case where DOJ consented.

DOJ policy is that for a defendant to plead guilty, the defendant must make a factual admission of guilt.

DOJ policy is to not allow someone to plead "guilty" while not admitting factual guilt.

Hunter wants to enter an Alford plea for a simple reason: He knows, with near-certainty, he is not going to be sentenced to anything more than 100 hours of community service or something like that, and even that will be erased by a pardon from his father.

The princelings of the Regime do not go to prison, ever.

So the only real penalty he's in danger of receiving is the public exposure of his crimes and many, many lies to cover-up those crimes. (As well as the implication that his father has been protecting him through his long, long history of notorious crimes.)

And he wants to avoid that. So sure he'll accept a guilty plea knowing he'll face no actual sentence for it, so long as he avoids the one "punishment" he actually might suffer, the punishment of having his crimes be publicly acknowledged and all his years of lying exposed as the whining of a privileged princeling crackhead who has skated all of his life on family connections.

There's a cute little wrinkle to an Alford plea. You probably know that Hunter Biden is suing, in purest of bad faith, all of the people who have accurately and justly called him a serial criminal.

Well, if a court accepts an Alford plea, you have not officially admitted you're a criminal, so you can continue asserting your innocence in other legal cases, like civil lawsuits for defamation.

The Minnesota Supreme Court first explored the collateral consequences of an Alford plea in a civil trial in Doe 136 v. Liebsch, 872 N.W.2d 875 (Minn. 2015). In its decision, the Minnesota Supreme Court recognized that the district court had broad discretion to determine whether to admit evidence of the Alford plea in a subsequent civil trial. Though the court acknowledged that a conviction based on an Alford plea generally carries the same penalties and collateral consequences as a conventional guilty plea, it emphasized the fact that it had never stated that a district court must admit a guilty plea as evidence in subsequent civil matter. Further, it found that the district court enjoys broad discretion to determine whether to admit evidence under Rule 403. Thus, it determined that the district court did not abuse its discretion when it excluded the Alford plea based on 403 grounds.

That is, the other party was not permitted to introduce the highly relevant evidence that the Alford-pleading party had already accepted punishment for his crime (albeit without admitting he'd committed the crime).


He'd get his get-out-of-jail free card plus the right to continue suing all of his accusers, because he didn't technically acknowledge his guilt.

Is that how it works, Huntie? You're a lawyer, supposedly -- tell me, is that how it works? We accept plea offers from criminals who continue insisting they're innocent and that we have no just basis for punishing them?

And then we let them sue people calling them criminals, allowing them to maintaining their perfectly-fictitious "innocence" in other court cases?

Like I said, I bet this is how it all winds up working for "Huntie," the absolutely most-privileged rich, useless, legacy white man the world has ever known.

yeah I believe that's similar but nolo contendere is accepted as a plea in *misdemeanor* cases, you know, minor things generally punished by a fine and not worth the cost of fighting in court.

Good news is Conan stories read fast. Bad news is, "some of the good ones" can taken in a lot, and they're not all by Howard. I've never made it through all of the Elric stories myself, although I haven't gone out of my way to complete the set either. Elric is a guy who can really get on my nerves with his Stormbringer bromance doing more harm than a lot of the Chaos Lords & Animal Lords.

seriously it's not, the first half is a lot of track-laying, now I'm in the cart and racing down the tracks. I'm at page 277 of 392 or whatever, and it's mostly fast paced stuff from here.

I suggest the Fafhrd and the Grey Mouser series or Chronicles of Amber. I liked both better than Moorcock. Moorcock has his moments but the others are fun.

oh i love amber, just re-read it a couple of years ago, and bought the old science fiction book club editions I had as a kid off of Abe Books.

Also I've read a lot of the Fafhrd and Grey Mouser books, but, to my shame, never read them all. Some stories I've read six times, many I've never read.

I love the one where Fafhrd winds up walking down the street like Issek of the Jug. It's a whole story set up for one big joke at the end, but it's funny.

That book did it for me with Dune. I enjoyed the books until that one. I read the ones by his son, which explained the Butlerian Jihad, the rivalry between Atreides and Harkonnen, and the origen of Mentats, and it was long, drawn out and a bit grotesque, but helped set the stage for the Dune books somewhat. I got halfway through Silmarillion and had to stop. It required notes, charts and commentaries to understand it.

I suggest the Fafhrd and the Grey Mouser series or Chronicles of Amber. I liked both better than Moorcock. Moorcock has his moments but the others are fun.

The Hawkmoon series was better than Elric, to my mind. I really got into The Chronicles of Amber, and it remains a favorite. (I was told by a friend NOT to read the follow-up series.) Imaginative, the best Byronic hero since Byron, and Zelazny drops bon mot lines through the whole thing. I also recommend the Dream-Quest of Unknown Kadath, which was Lovecraft's fantasy epic (for him) which for some reason was rejected by Weird Tales. Cat fanciers will enjoy parts of it.

246 The Hawkmoon series was better than Elric, to my mind. I really got into The Chronicles of Amber, and it remains a favorite. (I was told by a friend NOT to read the follow-up series.) Imaginative, the best Byronic hero since Byron, and Zelazny drops bon mot lines through the whole thing. I also recommend the Dream-Quest of Unknown Kadath, which was Lovecraft's fantasy epic (for him) which for some reason was rejected by Weird Tales. Cat fanciers will enjoy parts of it.

I am in a Zoom book club that has been going on for 4 years. We started by (re)reading Dune because the movie was due out and then worked through all 6 of the Frank Herbert books (they got progressively weirder). Then we started picking things off the Hugo list (pre-2000) and for most of us it was a re-read. Then we branched out to some newer stuff. It's been like a college degree in Sci-Fi.

Some of the older stuff holds up well. Some, doesn't.

I finally read a book I've known about for years, Norman Spinrad's "The Iron Dream." In case you don't know, it's a meta book supposedly written by an alt-history Adolf Hitler, who left Germany after the Communist revolution of 1920 and settled in America to write... hack sword-and-sorcery fiction about a fictionalized post-apocalyptic fantasy Germany and its war against what are clearly Russians and what are clearly Jews, but turned into post-apolocalypse mutant monsters. It's... interesting. A lot of it just makes the same point, that heroic sword and sorcery has some "race-and-masculinity fascism" baked into it, but some of it's amusing.

Blish was pretty perfunctory at first with the good shows, but then as he got into it he had to turn some of the drecky shows into 200 page masterpieces. Pretty funny.

Kull and Bran Mak Morn were heroes that Howard started before Conan, so they're not what people might expect. Kull is more reflective and thoughtful than Conan, less ready to roll initiative. He's a sort of cultural prelude to the Hyborian Age. Bran is a cinematic Pict who is closer to Conan, the more so since he rejects civilization implicitly. There is a real banger of a story where Bran and Kull team up to battle a Roman legion via some Pictish magic & time travel. Soloman Kane is the guy who ought to be serving as the model for people attempting a D&D Paladin. Out to smite the heathens, always in some other strange place in each story, and he's at his happiest when doing so.

I think The Hobbit started as something literally for his own children, and The Lord of the Rings was a combination of his publisher begging for a sequel and Tolkien wanting to put all of his languages that he'd created into an epic tale.

The Silmarillion seemed to be the real literary passion of his life.

278 I loved God Emperor, best of the series! Nothing wrong with Chapterhouse but that we didn’t get the last book. I didn’t care for Brian Herbert’s stuff. Second Chronicles of Amber were very good too. Big love for Zelazny. Lost him way too early. Another good fantasy writer is Steven Brust. He’s been working on a series since the 80’s. 18 books in all for the main storyline and has many others in the same world.

He had been asked to do a sequel for "The Hobbit" and it morphed into something else. Originally, "The Hobbit" wasn't part of his legendarium, but once LOTR came out, he rewrote parts to make it fit. He even attempted a complete rewrite to make it even more compatible, but after a friend told him, "It's good, but it's not 'The Hobbit'," he dropped it.

It's something he worked on pretty much from shortly after the end of WWI through the end of his life. He wanted to publish both LOTR and The Silmarillion at the same time, but his publisher wasn't really interested in the latter (I've read).

He never got the opportunity to really polish The Silmarillion like he did LOTR. His son, Christopher, shepherded it through the final stages.

Elf-King's Daughter is indeed very, very good. Well worth the read.

The Night Land by William Hope Hodgson is an odd story that is difficult to read, but tells a very strange tale. There is a more modern translation that is probably easier to digest while staying faithful to the original. John C. Wright has a series of short novellas set in same universe "Awake in the Night Land" which is excellent.

do you know? it's because the first version of The Hobbit had gollum GIVING Bilbo the ring as the prize for the riddle game, but when he came up with LOTR, he realized that that made no sense, so he rewrote those parts of the Hobbit.

The whole beginning of LOTR, the author's note, retcons all that, and says the Hobbit is Bilbo's book in-universe, and Bilbo lied in that book, in-universe, and only later admitted the real story.

but this was just an in-universe explanation for an out-of-universe retcon.

Yes, he is a filthy godless commie, but a good reviewer. Haven't seen his videos in months. Last I knew he was travelling around living in a different country every month (?). He had some weird reselling op going before that. Not the kind of life I would aspire to - two steps above homeless.

Man, the Professor could really pack a lot of stuff into a few pages. Amon Hen has never gotten its proper recognition on film so far. I did like how WETA drew up a plan for an old Gondorian decorated fort for the hill surrounding the Seat of Sight, then artfully arranged its ruin. Apparently none of the rubble you see in the last scenes of the FOTR movie are randomly placed.

In the end the guy takes an Alford plea. This was a real case. it is explained to him many times that this is in fact treated like a guilty plea, you just don't have to admit guilty. Companies do similar sort of stuff all the time on the civil side, when it comes to class actions. So at least in that state, Alford is indeed a guilty plea, just a special kind of guilty. The victim's family made a point in their impact statement of nothing he would.forever be guilty. He's just not admitting it, but it's treated like guilty for all legal reasons.

It's pretty clear the line originally said "an unusual type of guilty plea" but the person reviewing the article decided, no let's just reverse that and lie, and change the Unusual to a Usual, but they are so bad at their jobs they didn't even think to change the preceding word to have it be correct English.
