Good Morning Kids. So SCOTUS came out yesterday with the decision that confirms the logical and to the best of my knowledge precedent that presidents do indeed have immunity from prosecution over things they did that fall under the purview of their official acts. Of course the Leftists are in complete freakout mode over this because they have been attempting to railroad Donald Trump as some sort of mad tyrannical dictator in claiming things he did while in office where tyrannical in nature and as such demand his being hung drawn and quartered:

Indeed, the Democrats have become the very threat that the court was meant to resist.
Recently, senators demanded that Chief Justice John Roberts appear to answer to them for his own decisions. (Roberts wisely declined.)
Senate Majority Leader Chuck Schumer previously declared in front of the Supreme Court, “I want to tell you, [Neil] Gorsuch, I want to tell you, [Brett] Kavanaugh, you have released the whirlwind, and you will pay the price.”
Now Rep. Alexandria Ocasio-Cortez (D-NY) announced that she will seek the impeachment of all six of the conservative justices. She was immediately joined by other Democratic members.
Notably, scholars have long disagreed where to draw the line on presidential immunity. The court adopted a middle approach that rejected extreme arguments on both sides. 
Yet, because Ocasio-Cortez disagrees with their decision, she has declared that this “is an assault on American democracy. It is up to Congress to defend our nation from this authoritarian capture.”
Previously, Ocasio-Cortez admitted that she does not understand why we even have a Supreme Court. She asked “How much does the current structure benefit us? And I don’t think it does.”
Other members, such as Sen. Elizabeth Warren (D-Mass.), have called for packing the Court with additional members to immediately secure a liberal majority to rule as she desires.
For these pundits and politicians, justice is merely an extension of politics and subject to the whims of the majority. . .

. . . None of these threats or bloviating will work. The court is designed to stand against everyone and everything except for the Constitution. It has been forged for his moment.

Unfortunately like so many others, despite getting it 100% right especially in that first sentence, he does not seem to realize that the Constitution and its underlying principles are no longer respected by a considerable percentage of the populace and at least one of the two main political parties of this nation and too much of the other alleged opposition party that looks the other way. What Democrats cannot control or bend to their will in their sending quest for absolute power is to either be destroyed, or delegitimized. This decision will only add fuel to their fire to fundamentally transform America as founded into yet another failed dystopian nightmare.

OF course, fresh from his disastrous debate performance, Sponge-Brain Shits-Pants' handlers thought it was a great idea to shove the corpse in front of a teleprompter to rail against the SCOTUS and rally his base. Cue the lead balloon:

Biden spoke for five minutes, from a teleprompter, on the court finding that presidents have immunity from criminal prosecution for “official acts” taken in office. After Biden criticized the decision, calling it a “dangerous precedent,” he quickly left without taking a single question as reporters shouted inquiries his way. . .

. . . “I know I will respect the limits of the presidential powers I have for three and a half years, but any president including Donald Trump, will now be free to ignore the law. I concur with Justice Sotomayor’s dissent today. Here’s what she said: she said ‘in every use of official power, the president is now a king above the law. With fear for our democracy, I dissent.’ End of quote. So should the American people dissent — I dissent,” Biden concluded.

HE's reading his teleprompter cues because he has a cold, right? In any case, let's not start initiating a venturi effect on our nether regions just yet.

Justice Barrett’s comments have created a critical, largely overlooked opening for Democrats and their Special Counsel. Barrett hinted that if prosecutors concentrate exclusively on Trump’s private acts, they might succeed in their legal efforts against him. This insight essentially offers a strategic roadmap for those aiming to hold Trump accountable.

The key question here is this: "When Trump was questioning the accuracy of the vote count, was he doing it in his capacity as the U.S. President or as a candidate running for office?"
The Biden campaign, or whoever his replacement is, can expedite the laser-focused case against Trump the campaigner, while niftily bogging down his campaign to fight the newly invented legal action. This perspective implies that Trump’s remarks and actions on January 6, for instance, might be reclassified as those of a candidate rather than a president, thus stripping him of immunity for those specific actions.

Justice Barrett's suggestion does not merely reflect a hypothetical scenario. It outlines a tangible legal strategy. By urging the Special Counsel to fine-tune their indictments to emphasize unequivocally private conduct, Barrett indirectly points to a way to bypass the delays and complications associated with broader, less distinct charges.
This brings to light the broader issue of how legal interpretations can shift political dynamics. The Supreme Court’s ruling and Barrett’s remarks underscore the delicate balance between legal principles and political maneuvering. It raises questions about the extent to which legal strategies are influenced by the political landscape and vice versa.

How does one get actual originalists on the court who have fealty to the Constitution as written when every aspect of government and of course our academia brainwashing mills from K all the way through post grad and law school are seemingly dedicated to erasing that document and what it stands for from the collective memory.

Well, I suppose half a Solomonic baby is better than nothing.

Naturally, the preservation of "our precious democracy" means that Leftists can openly call for the assassination of Trump and the supreme Court justices either via a military coup or, by whatever means necessary. This is free speech, of course! In Soviet America baby splits itself.

I would have no issue with a (D) president having issues with an election and questioning the validity of the results if there were as many anomalies as in 2020. I'd say it was his duty to protect the integrity of the process.

22 Johnson vs Mississippi in 1867 decided that president had ministerial and discretionary roles and in both they was a protection afforded by the constitution.

Nixon vs US decided there WAS presidential immunity but in this case there we illegal activities that the people had a right to inspect these illegal activities.

So now I believe what each court must do is review the case to see if PDT was acting as the President. This could get tricky as in the case of GA Election Interference there was maleficence on the eve of the election so he can say as this was a federal election he was executing as the Pres.

USA Today/Suffolk poll dropped last night. 4 point shift to Trump since the debate, Trump leads by 3 in a 5 way race. This poll is one of the most favorable to Biden.

Biden released their internal polling to try to stop the hemorrhaging, making claim no change in the race since debate. Problem is Trump leads in their internal poll too.

the treatments have definitely zapped my energy. Appetite is still pretty good so I'm trying to have a nosh here and there. on top of this is the psychological aspect and the stress of it all. Breathing and meditation helps.

'Arab Attitudes To Israel' is for me THE roadmap and it's now relegated to 'collectible' if you can even find it. Preview on Google Books is still up, I recommend it.
Guy is likely to be hated by Israeli patriots and I get that. But I think he was a very lucid, realistic assessor of actual possibilities and I find his work compelling. I think accusations of being a 'Dove' are unfair.
He was in Intelligence, known as a gray area. He's now almost completely forgotten, which is a shame.

Just to remind people, I look at polls to gauge shifts in public opinion. I don't "trust" them to be predictive.

Is Suffolk calling the outcome in 4 months correctly? Almost certainly not, but they are capturing how voters are reacting to the debate (respondants said Trump win 5:1)

Also gives an idea of how Democrats will react, because they absolutely trust and react to polling.

They didn't just kick the can down the road, they actively prevented anyone from challenging Biden in the primaries. They were well aware of his condition and that's what they wanted.

It should be pointed out again, and again, and again, that the Democrats WOULD NOT PERMIT anyone to challenge Biden for the nomination. Further, Democrats refuse to deviate from "Biden's" policies. Biden is, for all intents and purposes, a "generic" Democrat. He is who they are.

88 As it happens, I recently read an article about Rocco Petrone, who was in charge of the KSC launch facilities during Apollo. He was famous, or infamous really for being a tough administrator. He expected people giving briefings to know their stuff. Most people agreed what he was looking for was if you were trying to bullshit him. It was OK to say "I don't know", in fact that's what he was looking for in a discussion. He fired someone on the spot during a briefing when the guy started trying to spin something he didn't know about. Lifted him physically off the podium and removed him.

I say all that, because I listened to the Nasa press briefing the other day about the Starliner. It wasn't a press conference, I could only stand to listen for a few minutes, so I'm not sure. But it was a mess. I know things change - but I suspect ole Rocco would not be happy with their answers or briefings.

There was a caveat about Israeli patriots, and he did accept a degree from Harvard, which is the Kiss Of Death. I suspect if he had lived a little longer his inner pendulum would have swung back. As near as I can tell, a significant fraction of PhD work consists of being a slave for your advisor for a few years, put together a couple hundred pages of BS, and get approved by some of your advisor's buddies.

He texted me after the debate (which I did not watch, because I had better things to do) in horror. He was devastated and said that he was really disappointed that Trump was going to win.

I think there's a possibility of this. It depends on the conditions of the factions, who has what on whom, the risk profile, and who - if anyone - blinks first.

There are upsides to letting Trump waltz back in, some mid-level downsides (taxes, regulation, trade, border, potential SCOTUS action, but only maybe). They can hang the economy on Trump, fire the machinery back up to block him and contain him like last time, get their shit in order, whip the factions into line and unite behind an heir apparent that they then have four years to groom with the election in the bag from the jump in '28. Perhaps equally importantly, it would solve their Biden Problem *and* their Harris Problem in one shot. Plus, it would let them point and shout about how the system works and everything is fair and legal.

I wouldn't discount the possibility out of hand.

She's doing well, thanks. Oncologist appt is on the 11th and surgery is scheduled for the 22nd. We're hoping for a lumpectomy, then radiation for a few days and be done.

Her cancer marker test for hereditary cancers came back negative, so she was relieved about that.

I'm not. Powerful tech people are extremely crazy and evil, but they have a tendency to not be stupid. One of the major factors in that is the relative youth of the industry. The rulers came up, by and large, on merit from when High Tech was very much a quick-or-dead business. The next generation of rulers will be different, but not today (for the most part).

Because they're not stupid, they know that their megalomaniacal fever dreams of total control depend on three things: money, intelligence (in the state sense - spies and data sets and analysis) and energy. They have the first. They're building the second, and the second depends on the third.

To achieve their dreams, they need unthinkable amounts of stable, reliable power to feed the machinery of control that they're building. They know it because they're smart and they don't care about the laughable contradiction in their positions because they're both dishonest and pragmatic.

If they nuke plants to feed the machine, they'll build the nuke plants. Simple as that.

599 My sense of things is that the Deep State is fracturing. It's always had factions, they usually just stayed below the surface, with some leader (who may or may not have been President, depending on party and the individual) to give direction and some unity. Now, however, with it being increasingly obvious to most that Biden is and has been a non-entity, there is no one hand to guide the herd, just a squabbling Politburo that works at cross purposes as often as not...and more and more people see them for what they are, and they can't co-ordinate to save themselves, though they can still do a hell of a lot of damage.

This creates an opening. Whether it can be exploited or not...we will see.

Joe Biden was the worst possible thing to happen to the Deep State. Strange but true.

Ain't it the truth. People are so dug in and basically ignorant of the state of the country.

If Trump wins the presidency, I'm praying that he has the guts, power, and staff to follow through and communicate the hard choices he has to make with respect to deficit spending. All options left on the table involve huge reductions in the federal government as well as higher taxes at the high end of income. That means high unemployment which legacy media will pounce on.

We need to fund our military (not fund it by deficit spending), gut the federal agencies and delegate such functions to individual states, reduce the tax code to a handful of tax brackets eliminating loopholes at the very high end of income.

It's either painful restructuring, or within a decade economic freefall that makes the Weimar Republic or the Great Depression look tame. Our kids deserve better.

Article I, Section 6 also says that Senators and Representatives shall not be questioned in court or by the President for any speech or debate they give or participate in on the floor of the Senate or the House. This assures ample freedom of debate in Congress.

However, Hutchinson v. Proxmire, 443 U.S. 111 (1979) was a United States Supreme Court case in which the Court held that statements made by a Senator in newsletters and press releases were not protected by the Speech or Debate Clause.

The only way to answer this is to examine Trump's motives. But Roberts's opinion-in-chief expressly holds that the courts - when deciding the official-vs-unofficial issue, may NOT consider motivation.

Barrett is (apparently) desperate to prove herself not beholden to Trump for her life-time appointment. She is only hurting herself, and doing nothing to advance the cause of the Republic.
